Transaction has been completed without you even knowing. If I was your neighbor, I will proceed to a court and have an injunction restraining you or anyone from driving that car until the suite has been entertained by the court to determine the legitimate owner of that vehicle. Mind you this suit can take five years to determine, no issue will drive that vehicle and the good thing is that he already has his money back as a guarantee meaning he has nothing to loose in making life difficult for you as a dishonest business man. An oral agreement is admissible in court mind you and he has bank transactions to corroborate his oral evidence. People like you who think you can repudiate an agreement when the other party has fully complied with the terms of the agreement should be taught shown a precedence so that you don't do it to other people in the future. In your mind you are smart, you don't even know the buyer has lost money because of future value of money. That you find yourself in this predicament has nothing to do with the buyer, business has been completed and there is nothing you can do about it. No court will give you custody of that vehicle of this matter gets to court. If your story is true, allow the mumu neighbor to do his gra gra finished.. Then come back to him when you found any crash or damages in your car.. He will still calm down, if you react now, he will get more evaporated which may not be good to you. I have encountered people like that your neighbor.. The moment you said you returned after paying you the last installment indicates he has done his own part of the deal and you can't change the goal post while the game is on without consequences. That dude needs a restraining order on that car, he should make it useless for the next five years in order to teach you a lesson as pertaining to sales contract and the disadvantages of repudiating one without recourse to gentleman agreement. 17 Likes |

You knew all along before he completed his payments, you should have infomred him then. You just dashed his hopes when he was sure he had a car. If the neighbour has paid the last instalment and depending on the time frame taken to make the complete payment, he may just be in the right. Don't take rash action, you need a man-to-man talk. Don't go into arguments or call the police yet. Don't pitch adding any extra money rght away as well. Let him gas all his heat down then ask him what he wants: anything different from taking the car. Blame: you should have made your research about your next intended car before placing the initial one for sale. 8 Likes |

Missowombo: TO avoid unnecessary troubles, add a little interest on it. If he still goes ahead to cause wahala... Get him arrested, make sure you're the first party to report to the police. Sucre6: The fact that there was no written agreement between them made him susceptible to manipulation too. Money has exchanged hands through bank accounts, and that alone serves as evidence there is something between them. You might think you have an upper hands because there was no written agreement, but what if the man also claims that he promise to pay him double if eventually decided not to sell the car again? He need to apply wisdom in this case. You don't just return people's money when you fail on your part, you offer them interest even before asking. This is the only way you make victims not to feel cheated. In 99% cases, the affected person don't collect interest because they are already at peace with your attitude. 10 Likes |

Going by your gentleman agreement, there shouldn't have been an issue since it was an informal deal all along. However, keeping his money even for 2 weeks before returning it back is a loss for him going by our galloping inflation. You denied him good use of his funds and now returning it without interest. By reneging on the deal, he comes off the greatest loser. Thanks Man. The total duration of all these is 5days, from the payment of the first installment to the refund of his money. The delay with refunding his money stemmed from his refusal to release his account number to me. I have had previous transactions with him not related to the current issue, so I got his account number from there and refunded. |
