Missowombo: Why did you wait for him to fulfill the last installment before notifying him of a change your mind? That's where the whole issue borders on. You were too slow to decide. The moment you realized that the deal wasn't favorable to you, you should have immediately told him you wanted more. Then he would either have agreed to the new pricing, or totally called off the whole deal. As it stands you must do all you can to pacify him including monetary compensation. You may win through legal means, but you never know how far (illegal and spiritual) the said neighbour may go to plead his grievances. |

There's is no sale here.....he paid but there was no exchange of goods or receipt...... He can't force the seller to sell his goods..... He can only argue other technicalities in court ...... like if he has official proof he borrowed money with interest to pay for the car ...which can make a judge award small compensation . No judge will force a seller to sell his goods |

advanceDNA: That car does not belong to the seller the monment the last payment was made, even if there was an initial payment, the car does not belong to both of them anymore except an agreement was breached. |

Bobochicago:I disagree. There's no way for op to claim it was loan because he received installment payment like he mentioned. Honestly if the justice system works, he won't win the case. There are lot of ways a good lawyer for the plaintiff will punch hole in any argument the OP comes up with. |

advanceDNA:Guy, are you so dull to realized that contract can be entered orally? A contract can entered through the following. A written Contract Oral Contract And a contract by implication. What ever the buyer claims can be argued in the court of law. During the period of the said payment of instalment, the buyer or the saler must have reveal the condition of the contract and the agreed amount to a third party who would be made to swear jury in a court of competent jurisdiction. I have told you, you lack knowledge on the said matter of discuss. Keep quiet and learn.

A contract involve offer acceptance and consideration. Once all the three are in place, a contract becomes valid and enforceable. In your case, there was offer, acceptance and consideration (payment). I am sorry for your situation here, but your neighbour has an upper hand here based on your submission and you have no basis to rescind the contract. Written document is not needed once these facts have been established as contract can be deemed to be valid by word of mouth and actions. Any lawyer would tell you that the car belongs to your neighour and you are duty bound to deliver it. Your neighbour resolve to violence however is needless because the car is his lawful property under the law. |
