It's not so easy. They can't just bring their dad back.
10 years after he has been out of the US, he can apply for approval (not sure of the name) for his kids to apply for him.
His chances are less than %1 because he was deported for fraud and he's from Nigeria.
Nigerians are known for fraud hence his chances of getting any compassion are very very slim.

I know two people in a similar situation that I'm trying to help now to get back to the US.
If he had been deported for lesser crimes, he would have had a better chance, but fraud is seriously frowned upon, especially for Nigerians.

Attorney here—deportation is definitely in his future. Good behavior can, in some cases, earn a shorter incarceration period but it won’t stop removal proceedings. You said he was sentenced to 36 months. His attorney should’ve already discussed expectations with him prior to sentencing.

As long as he's NOT a US citizen, he's deportable. And MOST likely while he's still serving his prison sentence, the US Immigration would put what's called a DETAINER on him. That means when he's done serving his prison term, BOP (Bureau of Prisons) will hold him for US Immigration to take him into their custody. Then while in Immigration custody, he would appear before an Immigration judge who decides his fate. If he's lucky, he might be granted a bond and if he can make his bond, he will be let go to appear later. But if the judge decides at the bond hearing that he will be deported, then he will remain in custody until he's deported. The US Congress especially with Immigration gave discretionary power to NOT only the Immigration judges but also immigration officers. That's the reason why an immigration officer at the port of entry could deny you entry even if you have a valid VISA.

He will be deported either immediately after serving his prison sentence or later.

For sure, he is not not qualify to Naturalization and become a citizen, hopefully he has gotten his ten years Green Card as that would buy him more time in case he is not deported after serving his sentence.

If he is not deported immediately after serving his sentence, advice never to file for citizenship even if he is qualified to do as that will give immigration another time to give his whole file another look.

If he must renew his Green Card, he should look for a good attorney and should do that after having acquired a substantial period of good moral behavior e.g. five years after finishing his sentence. This good behavior period is not a get out of jail card, but it is a mitigating behavior to show immigration that he has ‘learnt’ his lesson, but they can still close the books on him regardless.

Even if his kids file for him done the road, this will still stand in his way. The best defense against not reaping the consequences of a crime is not to commit the crime.

Certainly he will be deported so long has he has not yet acquired American citizenship. The restitution they will overlook but in future it might be an issue when he tries to legally return which has a remote chance of succeeding. I don’t even think he will be able to enter any of the Euro countries, I know someone in an identical situation who was returned in 2011 and has not been able to get even into Ireland 🇮🇪.

I think what he meant is, there are some States, especially blue States that don’t share immigrant prison information with ICE.

In those cases, ICE will not even know if he is convicted of any crime and won’t know if he is serving in prison or not.

In those situations, he will more likely ‘fall through the cracks’ but he would have to remain in those cracks for almost forever and later become illegal.

If his Green Card expires and he tries to renew it or if he try to file for citizenship; that is when ICE would pull his files and get the 411 on his felony and would definitely deny his application and put him in deportation proceedings.

But all these are hypothetical because he committed a federal crime so ICE would get the 411 from day one.

Every case of an individual is different. He who never go never know.
He can be deported and he cannot be deported.
Lawyers dey vary. Head are not the same.
I have seen someone on tourist visa commit a crime, went to prison and came out, immigration was there to pick him; law is law and they argued in court, he got out. Note: 10 out 10 people said he will be deported , yet he was not deported. Today, he is a greencard holder.

I have also seen someone arrested for drug related offence. Lawyer argued his kid is autistic,the kid has strong bond with the dad, no one can handle the kid but the dad. There were proofs and they won the case. The guy was not deported. He is a greencard holder.

When things becomes worse, na lawyer you go look up to. Also, someone's head and another person head no be the same.

First case, na govt lawyer wey fight the case. Note: people said. "Ah! Govt lawyer no go do anything, if na private lawyer, we go say en-hen, maybe something fit happen but I no sure".

Second case, they paid the lawyer.

After his done with his jail sentence, he will 1st be sent to Immigration holding, then he will be processed for deportation. Good behavior and zero criminal record are conditions of maintaining a Green Card, going to jail for a criminal offence(misdemeanor or felony) now automatically triggers placing the foreign national on removal procedure. After deportation based on the crime, will be banned from re-entry into US for 10-20 or life.

Now about the restitution, since it is a condition of his sentence, his 10 or 29 years ban starts the day he finishes paying the restitution, if he wants to come back to US after the 10-20 year ban then he must pay the restitution, but if he can't pay, then he can't pay and should just move on and then forget about yankee.

Is he a permanent resident...meaning a Green Card holder? What was he convicted of?

I am not sure. You have to talk to an immigration lawyer for matters like this. The fact that you have a kid who is a US citizen does not cover a parent who is not legal in the country but there are bends to this which a lawyer can tell you.

One bend to it might be if the child is autistic and the dad is responsible for the child's welfare as the child as so much bond with the dad.

There are other options but the one I can remember is what I listed above.

No Sir. That is now America justice system works. Prosecutor do not deport. ICE deport people from America. Once you're sentence to a prison, the prison official will inform ICE when a non citizen arrive and ICE will put a detainer on your name. The detainer prevent the prison from releasing you after you complete your sentence. ICE will pick you up from prison the day of your release and transfer you to ICE holding prison waiting for deportation. They wait because it's cheaper to deport people in groups. They charter a plane, load people going to countries closer to each other like Ghana, Nigeria etc and off they go. Case closed.

There's a good chance that he will be deported after serving his sentence.

ICE will definitely be notified of his conviction especially with the name fraud and Nigeria on it. In fact, they will be having erection by now. grin

Dude will not have the opportunity to do the restitution which will be on file to fight him when he plans to return to the US after a possible 10years ban. Also, he may likely not be able to enter US ally countries ever again.

If his Nigerian wife loves him and wants him to smell the country again, she should join the US military immediately or push one of their kids to join.

Doing so will help make his re-entry a reality. If not, he should come to Obosi park and join us keke drivers. We are not doing badly you know. wink

You're right but things has changed lately. You will be deported if you go to federal prison for a felony. That is automatic. State prison depend on the State. Some State will not report non citizen to ICE and will just release you after the end of your sentence but the guy in question was sentenced to federal prison and homeland security prosecute his case. People who know him should have advise him to run when he was on pre-trial release cos Naija better pass jail oo.

He will work during his term through jail and pay,and most probably his bank account would have been seized to cover for part of his restitution plan.
Lastly, he's coming home to you after his term,I guarantee you that.
His GC will be destroyed because he already violated his terms and conditions for obtaining such benefits.
I don't know if any miracle can happen after his release for his deportation not to happen but the chance is next to zero.

My primary school mate just got convicted in the USA for 36 months.

It had to do with money laundering, aza man issues about 200k USD.

He has a green card but not a citizen.

He has been in the USA since 2017.

He has 2 kids he gave birth to there with naija wife.


He impregnated an akata, akata oyibo woman gave birth while he was in prison because he was already in detention till the court conviction last week.

Even if he has 100 children with all women in America he will be taking before an immigration judge for hearing on his breach of oats he sworn before and proves to the judge reason why he should not be deported especially on fraud case. The immigration system here will look for every opportunity to expunged him not even now that the entire country is complaining about changing the policy and makes it more difficult for immigrants to apply for immigration benefits.
Like I said I don't what which miracle will happen to change such decision,but I wish him luck.

The only clause is if he's already a citizen, then once he's served his time and paid restitution, he won't be deported but he will live with the damage on his record for life, and he may not be able to get good job except he has his business, even at that he get blacklisted, the list of repercussions are endless.

But remember he is PR holder and already has a case file with the homeland security as someone who's originally adjusted his status. So tell me how he wants to go back after a federal felony requesting for an asylum. We all learn everyday I would like to know how he wants to wriggle himself out of that quagmire.
This are few that messed up the country name abroad, I can tell you for a fact how the name Nigeria has cost me alot of opportunities even though am law abiding and honest.
Things that ordinarily won't cost a Kenyan or Somalian citizen much effort to do will cost a Nigerian double the effort because there's this general notions that all Nigerians are fraudulent.
Honestly he should turn a new live incase he made it out of this case,I wish him best of luck

ICE detainer means immigration want you to be transfer to there custody when you finish serving your time and they will start deportation proceedings. Since he has a green card, he will go thru immigration court and he can make bail and be release while his case is going thru immigration proceedings but the law is written in black and white. A green card holder who commit a felony is subject to deportation.
He need God's intervention because he is closer to Naija than anything bro. That is the fact.

At this point, You should rest and allow the law to run its full course. There's nothing you can do for him unless you were the one that got him into the trouble in the first place. If the 200k$ is still available, he can use thst to start a new life in Nigeria and if you really want to be a good friend to him, start preparing for his arrival in Nigeria since ICE already have a detainer on him.

Cos of $200k, he spoilt his life. Now he will have to communicate with his family on zoom. I'm sure with time, his wife will move on as well due to work and those lonely nights. Money he could have made in a legit way down the line.

The goal is to take every chance. Asylum is yet another chance.

Irrespective of what homeland has, situations change and he can now claim that his life is being threatened.


Please trust that I do not have sympathy for anyone that does crime. I am only providing information because I know people deserve second chances.
