I think this may be one of the reasons why land lease is preferred to purchase by businesses. To reduce your exposure

Yeah. But if I was in this Landmark owner's shoes I will first try and dialogue with the government to see if there's a way they can reroute the whole thing in order not to affect my investment that is providing jobs for fellow citizens.

If I get a negative response , then I will file for compensation ASAP and get an injunction restraining government from carrying out demolition immediately . If they decide to disobey the court order, no wahala . I will sha pursue my right go compensation to the last kobo.

Once I get the monetary compensation, I will never look back at ever investing in Nigeria ever again. I will face my business interests in other saner environment .

There should be some limits and caveats to that land use act. If it is for really crucial purposes like environmental preservation etc, then it makes sense, but to be booting people out and making them homeless because of any silly government white elephant project is tyrannical IMO.

Three different petrol stations were demolished at Maryland for a mega bus terminus by ambodes admin. The project has effectively been on hold since he did not return. Whenever I drive pass I dey vex. All for nothing.

But of what use to the Nigerian people is their government sef? cheesy
I mean is there any benefit at all? And is there any aspect of life where the government does not phuck its citizens?

This should be one of the focus of our house of assembly members . They should be able to look at historical events , identify the need for the people and property interest be protected from the recklessness of Executive governors . They should be championing the amendment of the Land use act by importing such caveat .

That is why the senators and HOA are called the representatives of the people . They are the ones saddled with that responsibility . But look at that fighting over constituency allowances , padding budgets and what have u. Some of them are even more concerned about regulating social media . πŸ€¦β€β™‚οΈ

At least if the law has such caveat , anytime a government at the executive level wants to transgress , the victim can always have a legal leg to stand on and challenge them in court .

Based on the Land Use Act, the government owns all the land in Nigeria. A certificate of occupancy is issued to the holder for a period of 99 years and can be revoked anytime for the purpose of public interest with adequate compensation or resettlement.

The Governor has the power to deny compensation if any of the terms listed on the right of occupancy have been breached e.g holder has not been paying ground rent. It is worse if Landmark doesn't have a Certificate.

Landmark should accept LASG request for 50 metres right of way and move on.

So Lagos state has been issuing notice to people with properties along the corridor where the road is to pass and Landmark resorts has been given a quit notice notifying him that the $200m resort will be demolished .

The man has come out to plead with the government to reroute about 1.5km out of the 700km so the property won't be destroyed . He mentioned how he got the land in 2007 long before there was any plan to construct any coastal highway so it's not as if he bought a land knowing fully well the government will demolish it one day.

The business employs 4000 Nigerians directly and 12,000 indirectly . Even if FG gives him compensation for demolishing his property ( which I doubt they will ) ; what happens to those people working for the company that are about to join the ever growing unemployed pool in the country ?

Yes I corrected it. Its 50 meters. The road didnt touch any of its building, just the beach front, same way it affected Oniru beach front.

The project is not even a LASG project, it's a federal govt project, I dont know why Lagos is the one sending them letters of RoW and not the federal ministry of works.

If the land belongs to the state government then they have to handle it.

I don’t think FG can chase people away from the land since the land does not belong to the FG in the first place. They have to use the LASG to do their dirty work.

Exactly ! Na state government get all the land for their state except for those already designated as under federal government from inception

Well the compensation should come from the FG coffers and not the state coffers since it's an FG project. When the FG was building the Lagos - Ibadan rail line, it was the FG that paid compensation to all those whose house was demolished for the project.

And per the letter LASG sent to Landmark, they are not evicting the man from the land, they are asking for a 50meter right of way for the coastal highway.

If you check the new mapped route for the highway, the route will pass through both Oniru, Landmark and even swallow up a GT Bank property in that area. If they are to follow the old route, na inside water the highway go dey.

Check my response to Blue above. Most of the FG project where they have to demolish some structure for the project to pass through, the FG has always been the one paying the compensation and not the state govt.

Na why i will first consider buying a house in a govt built/owned estate like Mile 2 or igando, before building a house in Lagos. A colleague built his nice 4 bedroom bungalow at Mowo somewhere along badagry axis, years later it was claimed that the land belongs to Govt and all houses where demolished. Dude hasn't gotten over this loss since, building house in Lagos is risky even when you have relevant documents.

How does this highway benefit Lagos State? Would investing the funds on high speed rails or heck connecting the whole of Nigeria via decent rail not be a better use of the funds? Or spend the money on the existing federal highways to these areas to make it safer.
