The family of a Nigerian business leader who died in a Southern California helicopter crash that killed six people in February filed a lawsuit Wednesday, April 10, claiming the flight should have been grounded because of treacherous weather.

Relatives of Abimbola Ogunbanjo, the former chair of the Nigerian stock exchange, allege in the court filing that the charter company, Orbic Air, improperly flew the helicopter despite a “wintry mix” of snowy and rainy conditions in the Mojave Desert where the crash occurred on Feb. 9.

Ogunbanjo, 61, was killed along with Herbert Wigwe, chief executive of Nigeria’s Access Bank, and Wigwe’s wife and 29-year-old son. Ogunbanjo was on his way to Las Vegas to attend the Super Bowl.

Both pilots — Benjamin Pettingill, 25, and Blake Hansen, 22 — also died. They were licensed as commercial helicopter pilots as well as flight instructors.

Andrew C. Robb, one of the attorneys who filed the lawsuit, said Ogunbanjo’s family is seeking “answers and accountability.”

"Helicopters do not do very well in snow and ice,” Robb told The Associated Press. “This flight was entirely preventable, and we don’t know why they took off.”

Ogunbanjo’s wife and two children filed the suit in San Bernardino County Superior Court against Orbic Air and its CEO, Brady Bowers, alleging wrongful death and negligence.

The suit also names the unidentified successors of Pettingill and Hansen, who Ogunbanjo’s family also faults.

Orbic Air did not reply to an email and phone call seeking comment.

The National Transportation Safety Board is still investigating the cause of the crash. In February, the agency released a preliminary investigation report that outlined the helicopter’s flight path and provided details about wreckage that was strewn across 100 yards of desert scrub.

The engine and the metal deposits that were found would indicate that it was operational at the time of the crash.

The report cited law enforcement, saying several witnesses who were traveling in vehicles along Interstate 15 had called 911 to report observing a “fireball” to the south. The witnesses reported that it was raining with a mix of snow.

The helicopter left Palm Springs Airport around 8:45 p.m. and was traveling to Boulder City, Nevada, about 26 miles southeast of Las Vegas, where the Kansas City Chiefs and the San Francisco 49ers were set to play that Sunday in Super Bowl 58.

The lawsuit seeks a jury trial and payment for Ogunbanjo’s burial and funeral expenses, as well as other damages.

Robb’s firm, Robb and Robb, represented Kobe Bryant’s widow, Vanessa Bryant, in her lawsuit against the pilot and owners of the helicopter that crashed in Calabasas in 2020, killing the NBA star, his daughter Gianna, and seven others. The lawsuit was settled in 2021 for an undisclosed amount.

Very good. The Nigerian Government will give the Ogunbanjos all the support too.

That helicopter company must be held to full account. If they love to waste the lives of their own citizens, too bad for them, but the Ogunbanjos of Erunwon, Ijebu Ode, will have none of it.

It's so upsetting how they kill people in helicopter crashes in the US and just move on as if it's normal to waste lives. It's alien to us here in Nigeria o. We value lives and family from where we come from.

The worse airframe you can risk your life on is an helicopter. Infact I still believe,whoever invented it was very high because there's a lot wrong with it....Too stuffy, underpowered with one too many hard points that causes drag therefore, as a pilot, it always tries to kill you in a crash instead of staying in flight like a normal aeroplane. That's why it's was originally made for military purposes because soldiers taking risks and dying isn't a big deal, but civilians? Especially billionaire civilians ??

If these will help them with closure then it is very good besides people needs to be held accountable when they are in the wrong. If they knew the weather was that bad they shouldn't have allowed the helicopter to fly but like most selfish humans, they were looking to make a quick buck

The company will do a counter suit by providing evidence proves that it was actually your son, his wife and son that were inpatient.

That they insisted the pilot should fly the plan even with all the bad weather signal because they don't want to miss the SuperBowl....

As a Nigerian who has watched the "Blacklist" from season 1 to season 10, I have always suspected the fishy mysterious circumstances surrounding the death of this our Nigerian STAR banker.

After watching one of his interviews where he outlined his plans on how he's going to position Access Bank to lift the African economy like it's done in other parts of the world, I sense someone who's envious of his daring courage must have snuffed out his life.

With the world of Chips and coordinated GPS tracking device, systems and technologies, anything is possible.

They should investigate further about his. It's important, even though that's not going to bring him back, but it will go along way to serve as a cautionary measure for the aircraft manufacturers to tighten their security measures.
