Dude101:No need for a lawyer bro. Take a stroll to any court around and inform them of your predicament and they guide you on how to go about it. You can also get a lawyer at the court you visit to guide you. Make sure to collect every dime the tenant is owing you. |

erico2k2:Whether there is an agreement in place or not, as long as his rent has expired and he has overstayed for three months, he can only give 7 days notice to recover property and after that begin a court case to both retrieve his rent and recover all the accrued rent the tenant is owing. |

This sounds more like a verbal situation, no notice nothing The landlord is even lenient by telling him to pack out. He is wrong na he should just move out quietly as the landlord is not even interested in the arrears. Even the 6 months notice he's clamoring for after expiration if the matter gets to court he will pay for those months. He should just leave as the landlord doesn't seem interested in pursuing the matter legally 2 Likes |

Dude101:just go any federal high court or tribunal near you. Pay some small fee with little tips That tenant go park middle of night or he go pay for that two years. As far his rent don expired Or instead remove roof untop house find snake put inside that roof. Or every morning put red chicken feather with black rope for his door front 1 Like |

Some people don't get it. The six months notice is in between the during of his rent. The notice should have been after the expiration of the rent. That is not proper. If only we know our rights as tenants and landlords |

He is not obliged to get an extra 3 months. As an annual rent-payer, he is entitled to 6 months. Now, if he is on good terms with landlord, asks for extra (which of course he'll pay a prorated amount for), and the landlord obliges, then good. But there is no legal obligation. AlphaNugget: 1 Like |

kingphilip:I repeat, if the rentis paid yearly.The Landlord must give notice for up to 6 months for tenant to leave.,once this xpires the tenant now has 7 days. However most persons don't live, the negotiate with landlords for xtra 3 months, there is nothing in the law that states that you should have xtra three months, its up to you and landlord to have a gentleman's agreement and you must pay this three months up front! |
