Why do I feel there is more to this case. Luxury car imports have been widely used to launder illicit funds. I think this is a case of scammers trying to outwit each other. Because how can you as a clearing agent arbitrarily on your own convert someone's properties for yourself without recourse to a court ruling. 4 Likes |

mcjokee: Cost of clearing a vehicle in Nigeria ports sometimes exceeds the cost price of the vehicle at purchase. It's a clear case of breach of contract by both parties. Client abandoned vehicles with Emeka after he has committed his own money to paying for clearing the vehicles for more than 2 years. (All this are obvious in the press release) No business man will tie his funds down on another person's business for that long (2 years plus) without any sign the other party will meet up with his payment. If this case goes to court, na settlement go end am. Cos both parties are in the wrong. My personal opinion is Emeka is only liable for the cost of the vehicle at the point of purchase with accrued inflation on the value for 2 years. If he had left the vehicle with Nigerian customs, the owners will have no case atall cos it would have accrued so much demurrage or auctioned. 6 Likes |

carzeem1: Like I said, there is more to the story than what is being reported publicly, and I agree with your last paragraph, he will definitely pay for the vehicles and but the company would also have to pay for accrued Demurrage and some facility cost. AuschwitzPrefec: If you fail to meet your obligations in a business deal such as this, you create loopholes. Emeka can also claim he borrowed money to clear those cars and used the cars as collateral to offset the loan if the client defaults. That could be hidden in his terms and conditions which the client based on relationship or whatever didn't take into account. He doesn't need to sue if it's part of his terms and conditions to claim vehicles if client fails to meet thier financial obligations after a specific period.
