casualobserver: You are really mistaken. Do you really think a High Court Judge will assent to a matter that is not within the jurisdiction of the court. Do you really understand what that even means to any Judge who does that as a career public officer? |

Akpakomiza2: Federal courts have no jurisdiction over traditional/customary matters. They are not recognized under Federal law. You can only preside over something that is under your purview. If you knew what you were talking about, I was expecting you to say the injunction was made based on violation of human rights which is a federal matter. But that was just legal skulduggery to obtain an injunction which will not hold water. If you knew the law you would have mentioned the above. 3 Likes |

bixton: Like I said, not only do you not know the law, you cannot read. The injunction was made based on human rights. It was also an ex-parte order (I am sure you don’t know what that means) It will be thrown out. No federal law or the constitution recognizes the existence of any King in Nigeria. 1 Like |

Akpakomiza2: They won’t get anywhere. An exparte order is a tool of abuse of court process by rascal lawyers. Ex-parte means the other party is not present. Exparte orders are temporary orders pending the presence of the other party to present his side of the story. For example I am your landlord, you haven’t paid rent for years, you go to court to obtain an exparte order prevent me your landlord from entering my property. The judge will ask why? You claim I violated your human rights, the judge grants you the order pending when he can hear from me. The exparte order either expires or I come to court and the real matter will be heard or dismissed. In the case of Kano, either the exparte expires or when they get to court it will be struck out because there is no human rights violation and kingship matters is not under the jurisdiction of a federal court. 4 Likes |

Court only operates with extant law and as of today, the provisions of repealed Kano Emirate law is the only law any ongoing judgement on Kano Emirate will be based on. |

casualobserver: The Federal High Court is limited in its jurisdiction to the items enumerated under Section 251 of the 1999 Constitution. I fail to see where Justice Liman derives jurisdiction (in a matter regarding the Kano State House of Assembly) from. Even if the matter was brought under the Fundamental Rights Enforcement Procedure Rules (which means it can be filed in Federal or State High Courts), jurisdiction is no longer exercised 'piece meal'. A court cannot have jurisdiction in some parts of a case and lack jurisdiction in other areas. |

legallysly: He doesn’t, the matter presented before him was human rights. On that basis he granted ex parte injunction. Ofcourse ex-parte means the other party was not present. Ex parte injunction either expires or other party appears and states his case. At which point the case is thrown out because federal court has no jurisdiction over kingship matters and there is no rights violation. 1 Like |

casualobserver: The order will likely not be set aside on June 3. 2024 which is the next adjourned date. The stakes are just too high for the court to do that But I expect the Respondents to file Preliminary Objections before then. And I doubt if they will be able to serve the Respondents with the order of injunction before Sanusi's coronation. I am sure the principal officers of those organisations and government bodies will be unavoidably absent until Monday. |

Federal high court has no business with kingship and this has been enacted into the state constitution. This is the kind of see finish our judges involve themselves, overnight court order. Poor people obeys court order, nothing concerns politicians or wealthy people with court order. Those ones has strong head We still handle your drywall or gypsum board ceiling installations

Akpakomiza2: Federal high court, which is where the injunction was obtained and the subject under discussion. You are just being pedantic because you know what I meant. Kingship matters are strictly state matters. The federal court of appeal and Supreme Court only come in as appellate courts for the state high court . A federal high court has no jurisdiction over Kingship matters,they don’t exist under federal law. Any matter relating to kingship has to originate at the state high court. 1 Like |
