On June 7, Niger’s head of state Abdourahamane Tchiani, seen here declaring himself the country's leader after a July 2023 coup, reintroduced prison sentences and fines for defamation and insult via electronic means of communication, news reports said.
“The changes to Niger’s cybercrime law are a blow to the media community and a very disappointing step backwards for freedom of expression."

Nigerien authorities must decriminalise defamation and ensure that the country’s cybercrime law does not unduly restrict the work of the media, the Committee to Protect Journalists said on Thursday.

Abdourahamane Tchiani, who overthrew the democratically elected president in July 2023, reintroduced prison sentences of one to three years and a fine of up to 5 million CFA francs ($8,177) for defamation and insult via electronic means of communication, according to news reports.

A jail term of two to five years and a fine of up to 5 million CFA francs ($8,177) were also set for the dissemination of “data likely to disturb public order or undermine human dignity,” even if such information is true, according to CPJ’s review of a copy of the law.


“The changes to Niger’s cybercrime law are a blow to the media community and a very disappointing step backwards for freedom of expression,” said CPJ Africa Program Coordinator, Muthoki Mumo, in Nairobi. “It is not too late to change course by reforming the law to ensure that it cannot be used to stifle journalism.”


Previously, the crimes of defamation and insult were punishable with fines of up to 10 million CFA francs (US$16,312), while dissemination of data likely to disturb public order carried a penalty of six months to three years imprisonment.

The government abolished criminal penalties for defamation and insult in 2022 to bring the 2019 cybercrime law into line with the 2010 press freedom law.

On 12 June, Niger’s Minister of Justice and Human Rights Alio Daouda said in a statement that the 2022 amendments were made “despite the opposition of the large majority of Nigeriens.” He said that decriminalisation of the offences had led to a “proliferation of defamatory and insulting remarks on social networks and the dissemination of data likely to disturb public order or undermine human dignity” despite authorities’ calls for restraint.

“Firm instructions have been given to the public prosecutors to prosecute without weakness or complacency” anyone who commits these offences, he said.

CPJ and other press freedom groups have raised concerns about journalists’ safety in the country since the 2023 military coup.


This April, Idrissa Maïga, editor of the privately owned L’Enquêteur newspaper, was arrested and remains behind bars on charges of undermining national defence. If convicted, he could face between five and 10 years in prison.

Several Nigerien journalists were imprisoned or fined over their reporting prior to decriminalisation in 2022.

CPJ’s calls to the Ministry of Justice and Human Rights to request comment went unanswered.

That the Nigerien military is misbehaving doesn't even add a flower to the Nigerian civilian regime. Journalists are also being persecuted here as well, amidst state-backed widespread corruption.

Do you know how many journalists and social media users have been locked up since Tinubu entered alone? it might even be more than what this military junta has done...

The bad part in Nigeria's case is that even civilians who have money lock up people because they can influence illegality with the law which is not the same over there, only the military is most likely wielding such power.

I witnessed 3 military regimes in Nigeria before democracy came, you guys just come out and be talking nonsense, I'm not supporting the military regime, but based on what I witnessed during the military regime with the way they hyped having a civilian government and benefits in human rights, I can tell you with all confidence that the difference is almost the same thing, up till date soldiers are brutalizing civilians and so on ...

What exactly is the difference ? even the president here still oppresses people.... you guys just gulp everything they tell you guy because they want to keep enjoying the fake democracy they claim to offer....

the few military leaders in Nigeria have done much better than their many Democratic counter parts for instance all our refinaries were constructed by military leader to civilians couldn't even maintain them ,the biggest estate in Nigeria which is gwarinpa estate was constructed by a military leader,3rd mainland bridge was constructed by a military leader infact all our major high ways that really matters in the country were constructed by the military. I think our longest rail line was constructed by the military. One thing about military leaders is that they have interest of the country at heart and the can't be threatened by foreign powers because they're willing to die for what they believe in same can't be said with democratic leaders in Nigeria. Certain Freedom maybe contrailed but even in democratic rule can't be totally free

In as much as our politicians are corrupt and are not performing below expectations, calling for military take-over should not be encouraged. Though things are hard and people are really suffering due to unfavourable govt policies, however you can't quantify the freedom in democracy with that of military rule. You can protest, drag govt officials on social media for mis-governance to make them adjust but this freedom is never guaranteed under military regime.

If they are prosecuted here, and Rufai Oseni wouldn't still be doing his cho cho cho if they were, it isn't set in stone as law like the Nigerien mandate thieves are doing.

Like I said, let them prepare a table for handover and publish it sharpish.

That aside there is no guarantee anywhere that millitary regimes worldwide, maybe Sankara's excluding (RIP sir), are not corrupt, even moreso than Civilian ones.

Certainly in our country, they haven't proven any different.

It does beg the question why Obidients like mandate thieves in other West African countries but don't like President Tinubu who they claim is a Mandate thief (he isn't of course, I am just making a point).
