The lead judgement by Justice Bada did not seek status quo, the 2nd concurrent judgement by Justice Balkisu Bello did also not order for status quo.

It was only Hamma Barka who ordered for status quo and that's why vanitybwanti posted the screenshots of Barka alone but that is an orbiter.

Again, the Gov started acting on budget on 13/12/23 and the FHC gave that judgement on 22/1/24, so if the Amaewhule-led House decide to say No way, the Gov will refund or what?

Sorry sir,the hamma barka judgment is not an orbiter but a concurring or supporting judgment and it has same effect as the lead judgment.the supreme court laid to rest this issue in pdp vs Shettima ors 2023 when pdp tried to downplay one of the concurring judgment as an orbiter...

What I am saying is that the budget and everything done by Edison was null and void as declared by omotosho whether the governor was already acting or not.the governor must henceforth stop drawing from the state accounts till he resubmit the budget.
Anyway,the governor has gotten another order from SHC barring the clerk and chief judge from dealing with the house

The court of appeal doesn't even need to make any pronouncements on statusquo. What was the situation before the state high court gave the exparte order? Right hon Martin was speaker of the house. The only legal stand oko jumbo had was the pronouncements of justice wali of the state high court. Once that order was nullified by the appeal court over lack of jurisdiction, right hon Martin and his colleagues automatically resume their functions. There's nothing that needs to be added.

I'm shocked that people like you will still be supporting an obvious illegality in this manner. As of today,there's nothing that gives oko jumbo any power to still be sitting as Speaker and carrying out legislative functions,because the only thing that gave them power has been nullified by the appeal court. No stay of execution or notice of appeal to the Supreme Court. So where does he get the power to still be carrying out legislative business? And you as a custodian of the law is supporting this? There's no hope for Nigeria!


By the way ,neither oko jumbo nor Edison even had the quorum to sit in the first place. The judiciary is messed up. The bench and the bar are grossly corrupt and filty. Indeed there was a country!

Which money? The year has not ended, I think there is a provision in the constitution that allows an elected individual to spend without budget for 6 months, that time has elapsed and that is what they are acting on

There is so no such law of spending public funds without budget.
What is being done is supplementary budget.

That was what PBAT did upon assumption of office and that's what everyone does.

They're not spies at all. Majority of these guys are members of the pdp legacy party led by Dan orbih. These are seriously aggrieved persons who can even shoot obaseki if they have the chance.

I thought the court order was for reinstatement but not granular such as reversing every details to status quo otherwise , the governor will have no right whatsoever to exercise his executive rights and consequently there will be a lacuna in such judgement if it gets too granular....my take.
So far, this will go back and forth for a long while and in the process only few of those in Wike's camp will survive this crisis politically ...even Wike is fighting for his own political life as it is now.

If care is not taken, as e dey go so, these lawmakers will impeach Gov. Fubara (We can argue it will be an illegal way of impeachment, but it will be done) and it will be enforced by the security agencies....the Gov. will then have to go through the courts to the Supreme court to vacate the impeachment and he will win, but would have been out of government for some years.

The case of former Governor of OYO State Rasheed Ladoja comes to mind...same as Peter Obi sef.

Now according to your argument of representing the budget, if Fubara is impeached and a new government is sworn in, then the impeachment is later declared illegal by the supreme court, will all budgets presented by the government during the illegal impeach be represented? Or if a government is sworn in after a rigged elections and the courts later declares another candidate governor, will all previous official decisions carried out by the illegal government be reversed?

In matters pertaining to membership of HOA the FHC has absolute jurisdiction
