Supreme Court To Deliver Judgment On LG Autonomy Suit Thursday by Dapromzy333(m): 5:02pm On Jul 10
The supreme court will deliver judgment on the suit seeking full autonomy for the 774 local governments in the country on July 11.

Notices on the development have been dispatched to lawyers.

The federal government instituted the suit marked SC/CV/343/2024 against all the 36 states of the federation.

In the suit filed by Lateef Fagbemi, attorney-general of the federation, the federal government is also asking for an order preventing the governors from arbitrarily dissolving democratically elected councils
, News360 Nigeria reports.

The federal government also requested the apex court to authorise the direct transfer of funds from the federation account to local governments — in accordance with the constitution.

The suit is hinged on 27 grounds.

“That the constitution of Nigeria recognizes federal, states and local governments as three tiers of government and that the three recognized tiers of government draw funds for their operation and functioning from the federation account created by the constitution,” the originating summons reads.

“That by the provisions of the constitution, there must be a democratically elected local government system and that the constitution has not made provisions for any other systems of governance at the local government level other than democratically elected local government system.

“That in the face of the clear provisions of the constitution, the governors have failed and refused to put in place a democratically elected local government system even where no state of emergency has been declared to warrant the suspension of democratic institutions in the state.

“That the failure of the governors to put democratically elected local government system in place is a deliberate subversion of the 1999 Constitution which they and the President have sworn to uphold.

“That all efforts to make the governors comply with the dictates of the 1999 Constitution in terms of putting in place a democratically elected local government system, has not yielded any result and that to continue to disburse funds from the federation account to governors for non existing democratically elected local governments is to undermine the sanctity of the 1999 constitution.”

The federal government asked the apex court to invoke sections 1, 4, 5, 7 and 14 of the constitution to declare that the governors and state houses of assembly are under obligation to ensure democratically elected systems at the third tier.

Supreme Court should be aware what most state governors do, is to bend the local govt executive chairmen into accepting to leave their allocation for him to manage, in return they get re-nomination.

If Tinubu approves state police, we should kiss local government autonomy goodbye cos state governors will use state police to rig and steal INEC conducted elections.

Local govt chairmen should get backing from Federal authority by making themselves available for INEC-conducted local government elections, and getting backing from Army, a federal police., et cetera.

Because left for state governors, they will use state police to kill autonomy of local government chairmen by continuously harassing and bullying them.

Local government autonomy will ensure that money flows in rural areas which is what we need to ensure drastic poverty alleviation. As against when money used to flow only in Abuja and state capitals only; thereby encouraging rural to urban migration and leaving those left behind in rural areas under stark poverty.

United Nations have said majority of Nigeria’s poverty dwells in rural areas. So if we get LG autonomy, the LG chairmen can be able to spend money in rural areas; fix rural roads, fix rural primary health care Centers, fix rural markets and make them clean to avoid infectious foods getting sold, fix rural water supply.

A “rich rural area” is a rich country.

It would also make federal politics like that of the Senate and HOR less attractive to corrupt politicians.

It will also reduce the power of the governor.

Nomatter his convoy, when he visits a local government, he may be looked as a normal person.

Some local government chairmen, especially those who don't share the same political party, may not even tolerate him. Political illiteracy will reduce.

This will become one of the best legacies of BAT administration.

Most governors argue that their would be to much corruption in the local government but is there not too much corruption in the state?

The Beginning of the whole thing :
The Nigerian government had filed a suit at the Supreme Court against governors of the 36 states.

In the suit, the Federal Government is seeking full autonomy for the country’s 774 local governments.

The Federal Government also requested the Supreme Court to authorise the direct transfer of funds from the federation account to local governments — by the constitution.

This will be a good judgement for the Local Government as long as the Logal Government chairmen/women ain't thieves and rogues like their bosses.

Slow and steady we will get to the land flowing with milk and honey with barbecue 😋.

Anything to move our Darling country forward in all ramifications is what we want at MANNA.

Hopefully, tomorrow will be the beginning of the freedom of LGs from the shackles of the emperor Govs.

Next is to mandate INEC to conduct elections into the councils.

Maybe then we'll see real developments and know who to call out.

I'm afraid the emperor Govs may still device another means of stifling the LGs.

Fingers crossed.

This is long over due.
However, bearing in mind the endemic nature of corruption in Nigeria, how are we sure that this will translate to real transformation and development of the people at the grassroot.

If this is achieved, Governors will loose relevance as all attention will be focused on lg chairman

They should do the needful. Absence of strong and responsible leadership at local government areas is directly responsible for insecurity in the country.

State Policing doesn’t get in the way. I’m sure once this LG autonomy is ironed out, state police is next. Most govs are in favour of it. Careful planning is what’s needed.

Part of the measures when state police is put in place is to stop governors from using it to interfere in any election within the state.
