The newly appointed Rivers caretaker chairman are at the disadvantage with the Supreme court Ruling striping the Governor of All the power to dictate the funding of LG, we expect an interlocutory injunction from Abuja supreme court to bar any election into the Rivers LG....its a loss for fubara

Rivers isn't the only state where that nonsense happens. At least this SC judgment will compel governors to start conducting a proper election - even though their parties will eventually win everything.

With this SC judgment, those states that depend on Abuja allocation to get by go suffer wella. Governors will have to start thinking out of the box.

We seem to allow partisanship to becloud common sense. When the current president created LCDAs in Lagos State, then President, OBJ withheld funds from Lagos.

Yet, the SC ordered the release of the fund to Lagos. Whether funds are withheld or not, immediately the LG (s)elections are held, the funds will be released and all man go chop his share o.

Don't too d reason Nigeria matter o

You can not elongate tenure it's not posible the case is as good as dead

Nigeria constitution does not recognize caretaker chairman... Meaning that No funds will be released to fubara on LG matters

Following today's Supreme Court ruling on Local Government financial autonomy, it simply do not translate in any way to mean nullification of already existing ad hoc LGA arrangement (CTC) rather it now behoves on those affected states to expedite the process of conducting local government elections.

The directive from the Supreme Court to the FG to withhold funds from states operating Caretaker Committee (CTC) chairmen underscores the recognition by the Supreme Court of the presence of CTC arrangements in certain states.

Moreover, as the leadership of various Local government currently using the CTC arrangement cannot afford to exist in vacuum, it becomes imperative for stakeholders of those affected states to ensure the smooth conduct of the Council elections moving forward

Council elections will begin....but i think most governors might keep council elections from Oct to December..guess the supreme court should give INEC an order to carry out all council elections of affected states to carry out elections same day nationwide
Re: Fate Of Rivers Caretaker Chairmen Dampened by 3gpvids: 7:56pm On Jul 11
Supreme court is not the constitution,a section of the constitution if not amended, will cause a problem in implementing this jugdement.

To get a 2/3 majority of votes from states house of assembly to amend that section wont work.

For your information zamfara state House of Assembly just enacted the extension law, the extension is not automatic, it becomes imperative when state government do not conduct elections before the expiration of Local Government chairmen tenures. Why do state governors wait for tenures of Local Government chairmen to elapse before conducting elections? Does INEC wait for tenures of Presidents and Governors to elapse before conducting elections?

The law that allows for CTC in Rivers state has been expunged by the state house of assembly.

Sometimes I wonder where una de keep una brain, what concerns Fubara and PDP for LGA chairmen election, Fubara movement is going to another party, that would win all LGA elections in the state. Fubara is done with PDP, except the party gives him the state structure, if PDP has lost Rivers State

So what law is there now? Extension of tenure right?

Tenure extension is even more illegal than CTC so for now we head for the council polls

it's not illegal, zamfara state assembly enacted same law last week, tenure extension doesn't take effect if state electoral bodies conduct elections before the expiration of Local Government chairmen tenures.

Sim will sweep the council polls, its common knowledge, he pays the piper(RISIEC) and he will definately dictate the tone(winners)

You are misinforming us.
No Assembly has the powers to extend the tenures of elected or even appointed/CTC LG Chairmen. Even if anything like extension will take place, it will not exceed 6 months (not more than twice, making one year) and that request will come from the Governor.

Zamfara Assembly extended the tenure of interim/transition LG Chairmen at the behest of the Governor. The Governor wrote to the Assembly on 24/4/2024 and the House obliged.

It wasn't a bill or a law but an approved request that came from the Governor.

The appointment of caretaker Committees and/or request for extension is an Executive function, the Assembly only has to ratify or deny.

You can't elongate tenure of Chairmen but you are defending appointment of caretaker Chairmen. Have you ever heard of appointment of caretaker Governor before?

Be using English to deceive yourself. Justice Emmanuel Agim JSC said the judgment takes effect from today, Thursday.

States with caretaker Chairmen shouldn't expect to receive allocation. Those under that "arrangement" should collect their own allocation from the state and not the FG.
Shishi, they won't get from FAAC.

Fubara who appointed CTC and his Caretaker chairmen couldn't enter Secretariat is the one you're saying will win election. They have been holding office in Nkwobi joints and under fruit trees.

No worry. Let's see if Fubara himself will be allowed to move about that day.

All candidates of fubara can contest under SDP and they will still clear everything. PDD will likely have two set of candidates same as APC and RSIEC will just banned both of them
