Hello guys, I need your advice on this matter. I am presently in Canada studying and I want my family to join me here. I have an individual (not a relative) who wants to sponsor my family to Canada and his statement of account meets or is more than sufficient for the proof of funds requirements. He has also confirmed that the letter he gives together with statement of account can be notarized by me. Also, I have little savings which I can add to support the application for my family.

Kindly advise me on the best way to go about the proof of funds thing based on the above narration.

Firstly, hope you are a master's /PHD student, cos they are the ones only allowed to bring in their families where the spouse can work. As a mature student, using a friend as sponsor will be very delicate, it is expected that either you or your spouse have enough funds to foot your expenses.

Is the friend willing to send the funds to your account? If he is, that will be better cos as third party, it will be difficult to explain when he is sponsoring you with funds when you guys are really not related.

Using a third party for POF is a red flag. Also be careful with this move. Let me share a recent case with you.

A Masters student wanted to bring his family to Canada. He did not have the required POF. He then asked people to boost his account with funds. He got the required POF and submitted the SOWP application in March 2024. In May 2024, medical request was sent, and was done. In June 2024, IRCC sent an ADR for an updated bank statement from the day the applucation was submitted till date.

This was where the problem started. The money that were transferred to the POF account were returned immediately the application was submitted. After the updated bank statement was submitted, he got a PFL from the IRCC to explain why those money were withdrawn after the application. They also queried the recent lump sum into the account to boost the fund. He responded to the letter. In the first week of August, the application was refused for misreprensentation and the wife and the three children were rendered inadmissible to Canada for 5 years.

See what desperation has caused him. The implication of this is that the husband studying presently in Canada wont get PR based on the admissibility issue. Based on Section 42(1) of the Immigration and Refugee Protection Act, he will also be rendered inadmissible to qualify for PR.

42 (1) A foreign national, other than a protected person, is inadmissible on grounds of an inadmissible family member if

(a) their accompanying family member or, in prescribed circumstances, their non-accompanying family member is inadmissible; or

(b) they are an accompanying family member of an inadmissible person.

It is real. If not that it is illegal to reveal identity (Privacy Act) in Canada, I would have given name, and application numbers. IRCC is now scrutinizing bank statements for SOWP applications. They have discovered that most people do not have the money that they claim they have in their bank statements. People should be very careful with what they submit now. Presently, the number of temporary residents in Canada is more than their PR slots. They are looking for a way to send some people home after their studies. Please do not give them the rope they will use to tie you. If you work more than the allowed 20 hrs, you are giving the rope they will use to hang you.

Secondly, how much fund can we show for proof of fund.
Thirdly, will I show the proof of fund or my spouse will need to do that.

The compensation (monetary or other) indicated in your job offer and your assets and financial situation are insufficient to support the stated purpose of travel for yourself (and any accompanying family member(s), if applicable).

we applied for open work spousal permit and kids Study Permit.
I told my wife that I am done applying, this is not a best time to apply.

January, after that January 22 announcement. I applied the following week and got approved after 3 weeks.

Dont quit, get the GCMS notes and reapply. But be careful with any information and documents that you will use to reapply

Could you provide the following information so we can advise you on the next course of action
1. How much was the POF?
2. In whose account was the POF?
3. What is your spouse's present occupation in Nigeria?
4. Did you add spouse's payslips if your occupation was a 9-5 job?
5. How long is the course you are doing and how much tuition has been paid?

Please if you can, respond so we join our big heads together to think of strategies to reapply.

Your child will be VV

Your spouse needs to show some while you also need to show at least funds that will be taking take of you, But the spouse who is the principal applicant now will show the bulk funds

I think now is the best time to apply if you have sufficient fund, because bringing spouse with pgwp requires you securing a job in Canada for your spouse to qualify for SOWP. However your fund should be enough if you have paid your complete school fees and two of your children are eligible for VV.
If the three children are applying for study permits, and your school fee is yet to be paid, then the VO is right.That money can't be enough.
You should consider increasing the fund or maybe bringing your wife and a child first, later the other two children can join.

So you have a total of $38,229.52 as total POF. Using the IRCC POF guide, for a family of 4, you will need $38,346. This fund will be for living expenses only, so Tuition is not here, and flight cost is not here as well, so you will need to increase the fund.
That being said, you need to look at the sources of the funds and how they were raised, if the VO does not understand how the N25mm and $17k was raised they will flag the application due to insufficient funds. So, look at the explanation you gave for the sources of fund, bear in mind that whatever explanation you give for the sources of funds has to have documentary evidence backing it up.

My children got a scholarship to attend a Christian school in my province. The ages 5, 7, 9. They are all of school ages.

My school fees are not paid yet, but I'm considering paying the school fees. And at the same time, I had a full-time job until the new law of 24 hours. But the job is still guarantee once I'm done with school. I will still continue to do the work under the 24 hours rules.

With information, what would you suggest that I do? I have traveled to Nigeria two times in a year to see my family. It's really hard for me leaving my family. We didn't apply together as family because their passports refused to come out at the right time.

Resubmitting the application means you have fix the highlighted problem which is insufficient fund, without making a significant change there is no need applying again.
It will be nice if you can pay your remaining school fees without affecting much or non of the fund you have currently, add the children scholarship letters or prove, in your SOP state the reason why your three children were awarded these scholarships and how it has reduced your financial burden. You should also state the full time job awaiting your graduation with evidence.

Be aware of home ties, though it was not mentioned in your rejection letter, because you are eligible for SOWP, but it might be the reason since you are relocating four family members. Strengthen your home ties.

In your SOP state reason for previous sowp visa denial and the new changes.

immediately you get your visa, go ahead and extend your passport to 10yrs validity in Nigeria. be serious with this advice. renew/extend your passports in Nigeria.
also, its best to come with PR, because student pathway to PR has casted & its extremely expensive. not worth it, in my opinion. this advice will save you alot of money & stress

If most of us were younger and had high language scores, we will all be in the EE pool waiting for ITA. Most people going through the study route is because it is the easiest way for them, agreed it is expensive but when the "desirable is not available' the available become desirable"

Good Evening House, my wife and son submitted their passport for stamping on the 28th August 2024, by 30th we got a mail that the passport with the tracking number belonging to my wife is ready for pickup, while my son tracking number is still showing that, it is under processing at IRCC office. my wife already collected her passport, ticket has been booked and since then no updated on my son's passport.
please i need advice on what to do.

I think you are misunderstanding his message, IRCC requires applicants to submit passports with more than 6 months validity, that is what he is saying.

Go ahead with your renewal, it is better.
