Ha! No, Tinubu is evil and if I have the means to impeach him, I will be glad to that. I don't support him at all because he brought the hardship to Nigerians.

I know how everything skyrocketed and since his emergence as the president, there is no single day that things has been better.

Kobojunkieee:
I get what you are saying about your employer "trying" for you. Nigerians typically use that as an excuse to allow the status quo to continue without realizing that they harm the country by such pronouncements. The law is there as a guide to help make things work better for all Nigerians combined. You can't create pockets of exception when it suits you and then wonder why the country as a whole does not work at all for you and everyone else. undecided

It's kind of similar to what people keep saying about Tinubu doing his best. Yes, many Nigerians are hesitant to call for his immediate impeachment at this point even with all the many reasons piled up over the last 16 months in favor of just that. When you ask, some think it makes sense to let the man have until the next election which is about 3 years away even knowing that the current level of suffering in the nation is way too much for them to handle. Why do people do this? What you expressed there in your response has a lot to do with it. undecided

■ Aunty, I do not have full information on how the law applies and I believe ideally, every organization should comply however, we have seen instances where some states claim they cannot afford to pay. Besides, some companies are registered outside of the Federal Government thus, they may not be obliged to abide. I think we should leave this to labor lawyers to educate us.
You do. The Constitution in Nigeria works pretty much the same as it does in the U.S. and most other democracies. Federal Laws supersede State Laws and so on. States in Nigeria, much like their many politicians are notorious for violating the laws of the land. But that does not in any way mean they are to serve as examples of how things ought to be done in even Nigeria. undecided

■ Stop what you don't know! Which law that says I should pay you above what I received as Income? So,if you have a business and you hire, people as Support group, which labour law, will make you run- down the Organisation, just because of Minimum Wages? May I ask you to tell this Nairaland Forum, where your business is,so that Nigerians can come for their Minimum Wages!
Besides, why do you think the Private Entrepreneurs are saying Govt and Labour Leaders did nothing for Private Sector to follow the govt,in payment of the Newly agreed Small Scale.
Payments of Workers Salaries is based on the Workers Productity and assurances of Continuous Existence of the Organisation Not on you pay today ,no more business tomorrow!
Get that rule and stop advocating about the law that can't guarantee the Sustainability of the Business.
Private Organisations all over the World are not the same as Government entities - that can Create Money anytime and even decides to riddle with Corruption of the resources.
You either take what is offered to you or run to govt for employment. Life is full of Choices!
The Law says that you should not hire anyone if you are not able to pay that person at least minimum wage. That is what the Law in Nigeria now says. No need for the other storytelling which is nothing but the usual excuses Nigerians give for why it is OK for them to flout the law only to then wonder why Nigeria never seems to work at all when everyone else is doing exactly the same. undecided

To answer this question of yours, there are no states in America where the Federal minimum wage is flouted. undecided

That some states have yet to update their minimum wage acts at DOES NOT imply that they are in violation of the Federal Minimum wage. undecided

Don't be in a haste to use just google when you can make reference to the department in charge. Here is the link to the department of labor website and you can see for yourself that some states have minimum wage below the Federal minimum wage and usually, employers with less than 50 employees are not subject to the FLSA.

The means to impeach the senators, governors, representatives, vice president, and even Tinubu has always been in the Law. But as I said before now, most Nigerians make excuses for why the law should NOT be followed when it favors them to do so. Then they wonder why others do not equally follow the Law. undecided

Anyways, below are ways to get rid of the government and other dirty politicians in Nigeria. Impeaching them all would make no sense if they are not immediately prosecuted afterward to ensure they are made examples of for those to come after them. undecided

You would have done a lot better to investigate those particular businesses that are not subject to FLSA instead of pretending that your initial claim somehow makes sense. undecided

Most employers are subject to the FLSA, but there are a few notable exceptions. For example, these employees will be exempt from FLSA minimum wage and overtime regulations:
► Employees at businesses with fewer than two employees
► Employees at businesses that have an annual revenue of less than $500,000 and who do not engage in interstate commerce[i]
► Railroad workers (covered instead by the Railway Labor Act)
► Truck drivers (covered instead by the Motor Carriers Act)
► Independent contractors and freelance workers (they’re not employees)[ii]
► Some agriculture workers
► Babysitters[iii]
► Newspaper delivery workers
► Apprentices
► Movie theater employees (specifically excluded)
Separately, there are some types of employees who may be exempt from some portion of the FLSA but work for an employer that is subject to the act. Most commonly, this applies to employees who fall under one of the overtime exemption categories:
► Administrative
► Executive
► Professional
► Computer
► Outside sales
► Highly compensated individuals
For employees who qualify for one or more of these exemption categories, the employer will not be required to pay overtime for hours worked in excess of 40 hours in a workweek. They’re still subject to minimum wage obligations (except for the outside sales exemption), but typically, this is a nonissue because one of the requirements for most of these exemptions is that the employee must be paid a salary that is at least $684 per week.

There are many businesses that falls into these category such as small business with limited revenue, family owned business, some seasonal businesses such as agriculture, even some charity organizations etc. Summary is that they are not enforced to pay the Federal Minimum Wage if the state in which they operate their business has a lower minimum wage.

My initial claim still remains unless we know the number of students, location, etc. we cannot come into a conclusion. I backed it up by stating that I am not sure of the Nigerian law on minimum wage however, some state government pays below the minimum wage as such, unless a labor lawyer educate us, we cannot be certain. You in your almightiness came to argue that any business who cannot pay the N70000 has no reason in business when some government cannot even pay it. This I responded to that the US allow some certain employers be exempted from the FLSA as such, they can pay below minimum wage.

I will take such a job only if I am not fit enough to do bus conductor or sell groundnuts.

One can earn more than 26k monthly by opening doors at banks or restaurants.

I blame able-bodied people that apply for such teaching jobs in such schools. I blame parents that enrol their children in such good-for-nothing schools. No school with a good standard will advertise vacancies in this manner.

I don't think any school actually advertises and put the salary of their teachers out like that, it's usually job agents that paste such adverts. Also, we don't know how long ago it was but I am aware that a lot of mushroom private schools pay ridiculously low wages to their teachers, that's why they teachers are always leaving...

I posted a list of employers who are exempted by the FLSA in the USA and nowhere on that list are teachers included. undecided

1. Again, the minimum wage for all businesses in Nigeria is set at Naira 70,000. The only exemptions that exist under the The National Minimum Wage (Amendment) Act 2024 which was recently amended are for those
6.Who is Exempted from complying with the new Minimum Wage?
All Employers are required to pay the new Minimum Wage to all workers as described above. The following employers are, however, exempted from complying with the Amendment Act:
► establishments where workers are employed on a part-time basis and paid on commission or piece rate (paid according to the quantity produced regardless of time);
► establishments with less than 25 employees;
► workers in seasonal employment such as agriculture, construction, tourism, etc;
► workers employed in vessels or aircraft to which merchant shipping or civil aviation laws apply.
https://www.mondaq.com/nigeria/employee-benefits-compensation/1510034/the-national-minimum-wage-amendment-act-2024-key-updates-and-practical-tips-for-employers-in-nigeria .
So, it does not matter the location, the number of students, and all of those other ideas you have thrown out so far. undecided

2. That state governments have for so long violated the rights of the people without even so much as a peep from the people themselves DOES NOT in any way make right their acts nor serve as a valid reason for normalization of such injustice. undecided

3. Nigerians are not happy with being bilked of their right as far as pay is concerned. They are not happy that they are not being paid at least the minimum wage they deserve for even their efforts. asserting here that the status quo — the injustice — should be allowed to continue as is simply because it is Nigeria we are talking about is pure wickedness. undecided

Don't be too harsh on the school.

There are schools and there are schools.

Take a look at the school buildings roof.

Where is the school located?

What kind of community is it situated in?

How many students are registered in the school?

How many of them are feeling paying students?

So many questions to be answered......!

This is most sensible comment I read here. You can't just blame school withiout knowing what you stated above.

Salary capacity of a school depends largely on its standard and location. Contrary to popular believes, some schools are even running at lost these days.
