As long as she has access to the original documents of the house, whoever owns it doesn't really matter. Cos the bank or whoever granted her access to the loan are only interested in the originality of the collateral and not who owns it. Bad kids do this all the time. They steal their parents house documents and sell off the property

I think it's possible, why do you think people quickly lock doors to a deceased person's apartment and why it's possible for sons to sell their fathers properties without the man's knowledge. However, I think our judicial system need to educate us on the right of any individuals in possession of property documents, regardless their financial commitment in the property. This one easy na.
I will give you an example. A man took a loan with family property from the bank. The property is owned by his father, who is late.
The man has the same name as his late father, so he filled the bank forms and took the loans with the help of the bank officials. When he defaulted on the loan, bank tried to claim the property and the family sued that it is family property.
The matter is still in court for over 5 years now.

by all means, let me ask:
- so if the husband has debts, can they go after the wife's property (since they are recognized as one)?
- if the husband is sued for defamation, can the wife be sued too for defamation (since they are recognized as one)?
