How? Isn't he above 60? If they made it 65 you'd have a point

So...the next in line to be IG will be retired but the IG who is already 60 will stay till 2027??

This particular amendment was done last year to enable the IG to remain in office for four years

Why is it difficult for Nigerians to see that SOWORE is a good deal for Nigeria... He deserves to be the president of this country.

I actually voted for him after the 1st tenure of buhari then voted Obi in the last election. I gave up on Nigeria after the last election. However, if Sowore throws in the hat , I'll have to please my conscience. He deserves it. I strongly believe he can make a huge positive change

una sha see say sowore is a good solution for nigeria. but now the blowback; he just stepped on the toes of high ranking police officers who did not want to retire. they would fight back and make him public enemy.

Actually, the high ranking police officers would still go whether he talked about this or not.
The problem is why the IG will not go while his juniors are going.

You would be surprised to know that a lot of the IGP's juniors and the ones outgoing are secretly supporting Sowore.

Imagine you're next in line to be the IGP. And you will be say 60 by 2026. Yet the current IGP is not going for retirement even though he is 60.
He will stay till 2027 while you will retire by 2026.
Will you be happy?
Do you not know that the peak of a career officer is IGP, COAS, CDS, CNS, CAS, DG, CG??

Either way justice Omotosho had already delivered judgement in 2023 stating that the 4 year term is sacrosanct and overrides retirement age for the IGP. As the interpreters of the law unless a superior courts says otherwise. There is no need to amend the law because interpretation of the great area has been delivered.

Furthermore you provided no evidence that it was actually amended.

I am no lawyer but once as judge has given judgement on the interpretation there is no need for amendment and to the best of my knowledge there was no amendment. Probabaly another set of ignorant people. Who were not aware that a judge had delivered judgement on the matter in 2023 and laid it to rest.

This was what Buhari signed.....

Section 7(6):
The person appointed to the Office of Inspector-General of Police shall hold office for four years subject to the provisions of Clause 18(8 of this Bill.

What does Clause 18(8 say;
Every Police Officer shall in recruitment or appointment serve in the Nigeria Police Force for a period of 35 years or until he attains the age of 60 years, whichever is earlier;

So in 2023 after the appointment of Egbetokun, it was hurriedly passed in one week by the Senate! Another clause 18(8A) was added... So the contentious aspect was passed after Egbetokun was appointed IGP.

Where is the evidence of this? I am not aware of any amendment. All the police acts 2020 I have viewed are the original one passed in 2020. The architect of the bill Yusuf Gagdi was on channels and spoke extensively and passionately on the bill. If there was an amendment I am sure he would have mentioned it. He didn’t!

I am not denying they wanted to amend it but like I said one a judge has interpreted Afis repentance in a law it become law so no need to amend. Therefore please provide a source to this amended law.

I have searched and I cannnot find any such amendment. Please feel free to point me in the direction of a police act as amended that has this section 8A.

Don't follow headlines, read the judgement proper:
Justice James Omotosho dismissed this suit because of lack of jurisdiction.

He held inter alia; that the plaintiff has no jurisdiction.
The Supreme Court in a list of judgements has held that:
Any judgement no matter how finely delivered comes to nought if the Court does not have jurisdiction.

Justice Omotosho had expanded his judgement because it is the Court of first instance in this matter and the issue of Public Interest Litigation has always been contentious, that is to say, could go either ways.

However the meat and purport of this judgement is that the Court held Idoko had no jurisdiction, called him a meddlesome interloper, a busybody, an activist who has not showed how his special nterest on this matter overrides the Public Interests.

I read the whole story. I provided the headline does not mean I didn’t read the article. I provided the headline because I know most Nairalanders will not read the story if I just provided the link. I am not your typical sloppy and poorly educated Nairalander. When we went to school if you make claims without evidence you get punished or beaten so academically we were trained only to make assertions or submissions we can back up. This is why if you go through my posts I often provide the evidence without being asked. He dismissed the case for lack of jurisdiction but went on to say the 4yr term is sacrosanct

I am still waiting for your evidence of this amended section 8A

I have a hard copy of the Police Act 2020 signed by Buhari.

This contentious one was brought to the NASS on July 23 last year and passed in less than one week. It specifically only amended the tenureship of the IGP.

This clause was added as Clause 18(8A
Notwithstanding the provisions of sub-section (8 of this section, any person appointed to the office of Inspector-General of Police shall remain in office until the end of the term stipulated in the letter of appointment in line with the provisions of Section 7(6) of this Act.”

Oga I didn’t ask you for the one passed in 2020. I already posted that in a different thread at 12:28pm well before this thread came to life if you go through my post history.

What I asked you for is to support your claim that the police act 2020 was amended and this clause 8A inserted ….simple!

I will even take a newspaper headline stating it was amended.

PS: I am not having a go at you. I genuinely want to know.

Egbetokun should retire honorably.
Someone left the post for him to occupy so he should humbly leave as his time is due.
Egbetokun should not destroy the police force culture, no man knows it all.

Ok. Acknowledged. This is the kind of fact based engagement I like on Nairaland.

You are right! I stand corrected.

Funny though that the sponsor of the original bill will spend almost an hour talking about the bill and fails to mention that the age issue has been resolved with a subsequent amendment. I am assuming since the bill was sent by Tinubu himself, it is safe to presume he has signed it.

There is no favouritism in government, what applied to other officers must be applied to the IG. There are so many competent officers who can be appointed as IG. Any Act that goes in contrast with our constitution is null and void.
