If Fubara refuses to abide by the Supreme Court ruling , there is a high possibility that the Senate may assume plenary over the Rivers state legislative branch.

This will open the doors very wide for a possible impeachment by the Senate.

Fubara can not be allowed to continue to act with impunity .

The 27 man faction form the vast majority of the House and all of them were duly elected into the House

Fubara can not decide on his own who he chooses to work with at the State House of Assembly.

If he refuses to ensure that the 27 members are allowed to resume full legislative functions, then it's up to the Senate to take over the proceedings of the House because an executive can not be allowed to wantonly spend state resources without the neccessaey oversight and checks and balances from the legislature.

All it takes is for a Senator to raise the motion at the floor of the Senate to get the Senate to take over the day to day plenary session of the Rivers State House of Assembly.

It's from there , that Fubara's rascality will be made obvious and an impeachment move initiated.

But what's on ground is that we have contradictory judgement on ground sha but common sense is telling us 27 lawmaker are the majority as against the four lawmaker on fubura side sha

There are provisions in the constitution that allow for the Senate to take over the day to day plenary proceedings of any given state(s).

One of which is when a state of emergency has been declared over a state and marshal law instituted.

Another scenario arises when the majority members of the house can not meet up to their duties owing to an unforeseen tragedy.

I have said this before that the person who advised these guys to defect should be ostracised from that group. Fubara & co have no business on who wins or loses but to drag this case until the next cycle of election.

There is another case before the FHC in Port Harcourt which will most likely rule against the "27", the case now re-commences again and before you know it, its 2027.

Governance stops in August 2025, the rest is Primaries and election...

The Supreme court ruling was consistent with that of the High Court that ruled on behalf of the Plaintiff's .

In the course of that trial, Fubara's defense hinged on urging the court to dismiss the suit by claiming the plaintiffs were no longer members of the House of Assembly to which the Judge disagreed and asked Fubara to present evidence that the Legislators had lost their seats automatically owing to defecting to another party. Fubara could not provide proof in court and the judge then went on to entertain the suit by the lawmakers as being more than interested parties. The judge then ruled in favour of the 27 man faction.

The final ruling gave birth to 2 outcomes :.

1. Fubara illegality appropriated and spent Rivers state funds without legislative approval and oversight.

2. That the Plaintiffs remain valid members of the House .

The Nigerian Constitution allows the National Assembly (which includes the Senate and the House of Representatives) to take over the legislative functions of a state under certain conditions.

Legal Basis:
Section 11(4) & (5) of the 1999 Constitution (as amended)

Section 11(4): If a state House of Assembly is unable to perform its functions due to a crisis, the National Assembly may make laws for that state.

Section 11(5): Such laws remain in effect until the House of Assembly can resume its functions.

Conditions for Takeover:
The state legislature must be unable to function due to a crisis (such as political instability, security threats, or legislative deadlock).

The National Assembly must determine that it is necessary to intervene.
The National Assembly will then assume the legislative duties of the affected state.

This provision is meant to ensure governance continuity and prevent constitutional crises in cases where a state legislature is paralyzed.

I am not from Rivers and I am more bi-partisan when it comes to political issues because all the politicians and political parties are rogues (no exceptions including the Agulu fraudster).

But one thing is clear is that Fubara is a tyrannical despot.

The fact that this faction of Rivers state assembly is the first since 1999 to stand up against the excesses of these thieving governors who see themselves as Tin gods should naturally get real democrats on their side.

Rivers State has always been a political workhorse since 1999 & has sponsored & influenced all presidential elections till date.

Rivers influenced 2015 election , 2023 elections and will still influence 2027 elections .

An affidavit is a written statement or affirmation on oath before the Court.[
It is a written testimony or evidence in Court which lying on oath is perjury. (See Section 118 of the Criminal Code)

The suit of defection has never been decided or tested before any Court since this saga.
Justice Donatus Okorowo (now in the Appeal Court) granted an ex-parte injunction on the suit but no judgement until today. Ex-partes always have a finite period.
The defection case as we speak is before a Federal High Court in Port Harcourt.

If Fubara refuses to allow the 27 man faction to resume their seats, there are 2 options available:

What is the Supreme Court ruling on re-presentation of the 2024 budget?
None because there was neither any ruling nor judgement.
This was what the appellant wanted so that the Supreme Court does not make a pronouncement and the matter will continue to delay.
The Supreme Court on the request of the appellant, simply struck out the appeal.
Now, what did the Appeal Court say?
Amaewhule should receive the 2024 not 2025 budget.
The Court cannot overreach itself, it circumscribes itself to the matter before it.

I will reference you to a decision by the full bench of the Supreme Court in Abegunde v Ondo House of Assembly in 2015.

A full bench of the Supreme Court of Nigeria is 7, any decision made by the full bench can only be upturned by another full bench of that Court.

Abegunde was a HoR member representing Akure N/S, he had issues and factions with then Gov Mimiko and he defected. Hear the Supreme Court:-
