(I know, not helpful.) On one hand, applying for the DV program shouldn't hurt your chances of getting any other visa; submitting an entry isn't really an expression of intent to immigrate, it just shows that at some point you decided to spend a few minutes taking a chance, and why not? On the other hand, if your photo shows up associated with 15 DV entries all under different names, or if you have a DV entry and 17 recent non-immigration applications under various visa categories, at that point we may decide that you are probably an intending immigrant. But from what you've written, it doesn't sound like your record will adversely affect your chances of getting a student visa. The important thing in a student visa interview is that you convince the officer that you intend to use the visa properly, regardless of whatever other visas you may have applied for.

Please, if anyone ever asks you for any money related to any visa case, check with the Embassy or Consulate to confirm that it's for real. You should only ever be asked to pay visa fees, whatever it costs to get copies of birth and marriage certificates, panel physician fees, that sort of thing. We absolutely do not charge anyone for background checks.

I have applied for an immigrant visa for my mother and we are nowhere near completing the process; AOS and Civil documents are still under review at the NVC.

However, because of health reasons, (having a C-Section next week), I was wondering if we can apply for a B1/B2 visa for her to come temporarily to help me when I have the baby. Will this be feasible? I have read its really hard to get a visitor visa when an IV visa is pending but I really need her assistance as I will be alone with the baby. Can this visa fall under the emergency health reason category? Please let me know what to do.

Congratulations in advance on the new arrival! Well, your mother can apply for a non-immigrant visa, but it's doubtful that she'll qualify. She is an intending immigrant, and your C-section doesn't really qualify as a health emergency for your mother. She can try, but I don't want to give you false hope. Do you think with that i can easily apply for Tourist/ visit so as to see her and maybe then there is something we can do when i get there..

I'd advise you to be patient and do everything legally.

Well lately I got married and it appears that may be changing.

My wife has been pressuring me to make a move to migrate to the US. I've always maintained that I wont be moving to the US unless of course I have course to visit which would only be a visitation anyway.

Now just out of curiosity, and not wanting to read this entire thread, I'll ask some questions. If I wanted to migrate with my family (my wife that is) to the US what would I need or be required to do? I was reading somewhere that Nigeria is no longer eligible for the DV lottery.

I also ran into an information that I could make some investment in the US economy and be granted citizenship or something like that. Is that true?

The best place for you to start is http://travel.state.gov/content/visas/english/immigrate.html . My advice is to review that information and let me know if you have specific questions.

I can't give you personal advice. But in general, it's difficult to qualify for a non-immigrant visa if you have an immigrant petition pending.

I have a few questions regarding my moms pending immigrant application at the national visa center. Her application was approved by uscis and was forwarded to NVC. I got all the supporting documents sent to NVC few months ago and I got a response yesterday about missing documents.
1. They are asking for my moms birth certificate. I had sent her baptismal card and the birth registration from the national population and it seems like that's not sufficient. They are asking for a "certified statement from the appropriate government authority stating the reason that the applicants birth record is not available". My mom was born in the 1940's and hence, there were no registration of births at the time. Do you know what agency I should get this letter/statement from?
2. My dad passed away 15 years ago and my mom never remarried. I included a copy of his death certificate from the hospital in Nigeria and according to NVC, that isn't sufficient enough. Do you know what else I need to include?
3. They are also asking for a Nigerian police certificate. I thought it was only required before/during the interview in lagos.
4. They are also asking for my birth certificate even though I had included my baptismal card and birth registration from the national population.

1. Maybe a notarized declaration of age, including the information that government birth certificates were not issued in Nigeria in the 1940s?
2. Hmm. Do you have a government-issued death certificate? (You might also ask them why it's relevant to an IR5 case...)
3. NVC wants to see the police certificate and pass it to us.
4. So you sent them your NPC birth certificate already? In that case, I really don't know why they want anything different.

I'd get the new one -- and make sure you tell us it's new, so we can update our records. Otherwise the visa will show the OLD passport number, which could be problematic at the point of entry.

We should switch to IR1. That lets you obtain the permanent LPR card rather than the conditional one, so it's in your best interest. Please remind us at your interview -- or let me know what your case number is and I'll make the change myself.

We're mostly interested in what you declare on your 1040s, but if you can provide evidence of the nontaxable income and the new job, we'd take those into account too. You might need to bring the nontaxable income and the new job emphatically to our attention -- we're used to directing most of our attention to the 1040s.

Yes, he can file the I-130 for them (just one if he's still an LPR; if he's an American citizen, one for each of them). We will have extra questions about his relationship to the wife and children, as from our point of view they have suddenly sprung into existence as if by magic. But if it's a bona fide relationship, they should be all right.
