Representatives members in the
All Progressives Congress (APC)
have vowed to go to court to
challenge the eligibility of
President Goodluck Jonathan to contest the 2015 presidential
election, reports Daily Independent. The lawmakers based their
premise on the Supreme Court’s
ruling on former Adamawa State
Governor, Boni Haruna, who was
stopped by the court from
seeking another term in office after completing the term of
Atiku Abubakar as Adamawa
State governor.
Disclosing the plan to drag
President Jonathan to court,
one of the APC lawmakers, Hon. Nasiru Sule Garo, said President
Jonathan’s decision to contest
2015 presidential election is
illegal having been sworn in twice
as stipulated in the constitution. Also read: Jonathan to declare on November 11 He noted that Jonathan would
have violated the laws of the
land if he eventually wins the
2015 election.

However, if there was a precedent to such, then they might end up winning in a clean and fair trial.

I wonder where our law makers, I mean APC, got their facts from. Atiku was not sworn in as governor of adamawa state when Boni Haruna took over from him. Atiku had just won the election in 1999 when obasanjo named him as his running mate. Boni Haruna being atiku running mate automatically stepped in as governor elect, and was duly sworn in. Boni completed his four year tenure as governor of adamawa state and contested and won a second term of another four year in 2003. He handed over to nyako in 2007. Atiku was never governor of adamawa state.

What happened to the part in which the constitution states a person may only be sworn in as a president 2 times?

Whether u like it or not, both incidents are similar. Both never contested and both ended up taking positions of contested and elected people.

There is no such "sworn in twice clause" in the constitution.
The constitution only says you can only run for office twice.
GEJ ran for office of VeePee in 2007.
He ran for office of president in 2011. His first time ever. Tell us of any other time he has run for president.
If he runs for president in 2015, that would be his constitutionally allowed second time.

GEJ is not a candidate that will be too difficult to defeat in the forth coming election, so dey don't need to waste such time fighting his eligibility in court. They should rather focus on mobilising the whole of northern states couple with the south west complementing it with votes from Edo, Rivers and Kogi, then GEJ will have no option than to be heading to kirirkiri.

Jonsathan has been sworn only once as president.

He was sworn in as acting president then after the death of yaradua he constituitionally assumed the office of president. So far jonathan has only been sworn in once after trashing that gerriatic phuckup in 2011

Unfortunately by law there is nothing like "completing" someones tenure. The constitution and the SC ruling on Haruna Vs INEC and the SC ruling that sacked 5 Govs in 2012.
1. The ticket is a joint ticket, and both the candidate and running-mate are a team not separated.
2. The tenure is 4 years for every term. Yaradua/Jonathan won the 2007-2011 term as joint. Jonathan only succeeded his boss, who he won the ticket with.
3. By law, a person canNOT spend more than 8years as a substantive President but can spend less (SC ruling on the 5 Govs in 2012).
4. Jonathan took his first oath of office as the substantive President in May 2010 for his first tenure-actually in continuation of 2007-2011(According to SC ruling on Boni Haruna) and another in May 2011 for his 2nd Term. Taking a 3rd oath will represent an unconstitutional 3rd term in office.
5. Should Jonathan win 2019, it wÍll mean thÀt he will spend more than 8Ýrs in office which is unconstitutional(SC ruling of 2007 and 2012)
6. It is a big legal hurdle for Mr. Jonathan.


My Verdict:
He is not qualified to run! But I leave it to learned Judges

I think they should forget about Jonathan eligibility they should focus on how they will deliver their constituency to apc because I don't have faith in our judiciary arms of government
