Dear VO, My husband's interview (LGS2014651001) was November 14 and we were put in administrative processing, but no additional information was requested on the form he was given. I brought my dad, children, stepmom, and cousin to wedding. My husband even met all my family before we married. I have made numerous trips to Nigeria. I am quite confused. My husband did have a previous petition, but it was withdrawn. Is that the problem? Please help me understand what additional information the embassy is looking for in our petition. Thank you for even taking the time to read my request. |

Hello Ma, I applied for a B1/B2 visa twice and was denied on grounds that I don't have strong ties here in Nigeria,all in Us embassy Abuja.I never changed any information in my DS160.First was to visit my fiance who is US citizen,My wedding was to be held in July 2014 but denied the 2nd time.we pushed the wedding to September here in Nigeria.I applied for another visa interview to visit my husband and get to meet his family this holiday season.My interview date was 22 Oct. 2014,after the interview ,the consular took my husband's biodata page,my marriage certificate and my passport,I was given a slip stating that my case needs additional administrative processing.its almost 1month now and no word from the embassy.Is there a way to expediate this as my husband is worried.Here is my case number AA004EKSBI. Dear VO, Thanks for taking the time once again to read this post, its well and greatly appreiated. this was on 23rd of October Adeyinka2014: Good evening visa officer, thanks so much for taking the time out to answer questions, really much appreciated. My question is this, my husband filed an immigrant visa petition for me in 2012, it was approved by USCIS, but I was denied a visa at the visa interview in lagos. I was told I was eligible to file for an i601 waiver on grounds of inadmissibility, we have since filed the i601 waiver, and the waiver was Approved on the 13th of August 2014. I was also mailed a confirmation notice of approval, which indicated that all processing by USCIS was now complete, And we should wait for the us consulate to contact us. It's been a little over 2 months now, and we are yet to hear from the us consulate in lagos. I sent an email about a month ago to lagosIV@state.gov, indicating my email address and contact phone nos. I just wanted to know if it usually takes this long, or if they had been trying to reach me. Thanks This was your response VisaOfficer: After which I sent an email to LagosIv@state.gov, mentioning Nairaland, and also updating my contact information with the embassy, but I got no response at all. It's been over three months since the approval of the i601. Please I would appreciate any help given as I am confused as to why its taking this long. Thanks so very much and God bless |

llo consular, am new to the forum. Kindly assist me pls in ur advise My fiancé filed for a K1 visa for me and my daughter in 2009 but we had a fight and in our second appearance at the U.S. embassy I was told he stopped te application. 4 years later we got back together and this year2014 he wants to invite me to visit him first . My question 1.is does he av to write the embassy of our reunion or 2.should we assume they no longer have my denied application in their achives 3. He is saying he doesn't want to open up an already forgotten issue by the embassy if they no longer make reference to it 4.his work documents av been with me for six months now, can I still use that in December at the U.S. embassy? reeq: It's a strong SHOULD. USCIS won't issue your Legal Permanent Resident card until you pay the $165. Bt, technically, you can enter the U.S. before you pay the fee. You're supposed to pay it before you travel, though. |

pambenjay: Assuming all else is well and your medical reports / police certificates haven't expired, a positive DNA outcome should lead to visa issuance. I have to say I'm getting a little uncomfortable with being asked about specific cases in this forum. Really specific cases that necessitate the sharing of people's case numbers should be directed to LagosIV@state.gov. That's because not all cases are as straightforward as yours appears to be. On some rare occasions, Nairalanders are asking questions about their specific cases when I'm privy to information associated with their cases that I would never discuss in a public forum. So it's impossible for me to provide a candid answer, because I'm privy to more information than the person has shared online. Thus, I'm going to attempt to bring this forum back to a more general level -- answering the questions asked, but not looking up the specific cases unless there's a compelling reason to do so. oluwayemisi19: Sounds like your husband needs to divorce his first wife properly and remarry you so that you can file a new I-130; or, if his Diversity Visa marriage was a sham and that's why his documents aren't real, he should tell us so honestly so that we can figure out what his next steps are. If it was a sham marriage, he'll likely be found ineligible under INA 212(a)(6)(C)(i) for material misrepresentation, but then he can apply for a waiver of the ineligibility and move forward. |

Ummuslimah: Aside from the fact that that petition would have expired years ago, under U.S. law (8 CFR 205.1), upon written notice of withdrawal filed by the petitioner, the approval of an immediate relative or other family-sponsored petition (other than Amerasian petitions) is automatically revoked as of the date of approval, and the petition cannot be reinstated. So the petitioner would need to file a new petition on your behalf. |

teetee12: Greetings! The waiting time for sibling petitions is running around 12 years, and you can include your wife and son as derivatives. Because you are married, your mother cannot file for you until she becomes a citizen, which will take around five years; and the waiting time for married children of U.S. citizens is running around seven years at present. JASM: Hi JASM, When a Consular officer is not convinced that a K1, IR1, or CR1 relationship is bona fide, the petition is returned to USCIS with a memo explaining the officer's findings. The cases remain in "administrative processing" status because they are still open pending action by USCIS. In IR1 and CR1 cases, USCIS will contact the petitioner and ask for more information. Unfortunately, because K1 petitions are only valid for four months, USCIS usually does not contact K1 petitioners. Instead, the petitioners can file a new petition if they so desire. You can reach out to USCIS directly if you feel you can present a compelling argument as to why they should reaffirm the K petition, but if it has already expired, they usually will not do so. I hope this information helps. |

Your fiance should have received an e-mail which begins: "The U.S. Consulate General in Lagos is ready to begin final processing of your approved K1 visa petition. Kindly request your fiance/fiancee (the applicant) to visit any branch of Guaranty Trust Bank PLC in Nigeria to pay the K1 visa processing fee of $265; and after that, follow the instructions for fiance/fiancee visa applicants attached to this email." mazifavour1: Thank you for your kind words! Every relationship is different, so bring whatever you have. The most important thing will be how you talk about the relationship -- whether you are able to answer questions credibly, and not just quote memorized information. We don't expect you to know every single detail about your fiance(e), but you should be able to talk with us the same way you'd be able to tell an old friend about the relationship. The beneficiary does not need to show any financial documents, by the way. |

Ma can he still invite me as a visitor or it must be on the fiancé visa? If yes, does he av to write the embassy an invitation letter stating that we av renewed our relationship now and he wants me to visit himwith our daughter. fasiel: Well, I can't speak for Ethiopia, and I don't know the details of your case, so you should ask them. But I can tell you that if a person has EVER received any time of immigration benefit as an adopted child, that person can never obtain any type of immigration benefit for or from his or her biological parents afterward. I remember that you wrote that the case is in Ethiopia? |
