Ummuslimah: Greetings! If you intend to immigrate to the United States, he should file the I-129F for you as his fiancee. If you don't intend to immigrate, you can apply for a non-immigrant visa. Like all non-immigrant visa applicants, you'll need to convince the interviewing officer that you intend to abide by the terms and conditions of the visa. |

Now that I'm caught up, I want to repeat something I wrote in an earlier reply. I have to say I'm getting a little uncomfortable with being asked about specific cases in this forum. Really specific cases that necessitate the sharing of people's case numbers should be directed to LagosIV@state.gov. That's because not all cases are as straightforward as others appear to be. On some rare occasions, Nairalanders are asking questions about their specific cases when I'm privy to information associated with their cases that I would never discuss in a public forum. So it's impossible for me to provide a candid answer, because I'm privy to more information than the person has shared online. Thus, I'm going to attempt to bring this forum back to a more general level -- answering the questions asked, but not looking up the specific cases unless there's a compelling reason to do so. I'd also add that I can never give additional information about cases under administrative processing. There are many different reasons for administrative processing, and discussing some but not others is simply unfair to everyone. So I'm afraid my answers about people's administrative processing are never going to be satisfactory. Thank you all for your understanding! 2 Likes |

VisaOfficer: Thank you so much for the prompt reply . For the visitor visa application ma, does he have to indicate in the invitation letter that the we r now back together (Cos in 2009 he sent them a letter that we r no longer in a relationship and that was why the fiancé visa application was revoked). I also want to know that if on getting to the embassy , will the last fiancé visa that I was denied (due to what my husband wrote to them initially) not stand against me. Also do I need pictures of our reunion to convince them we r now back together among other documents. Thanks for ur patience. May God reward u. Kindly help answer the 3 questions |

omotfavy: It's actually good in this case that the husband is still a Legal Permanent Residents. If he were a U.S. citizen, he would need to file a whole new petition for his child. IR1 and CR1 petitions don't allow derivatives. |

VisaOfficer: Hi VisaOfficer, Welcome back and thank you very much for your response. I have been reading about cases that get transferred from the consulate back to USCIS and it says that they can take anywhere from 2-3 months before they reach USCIS. Our K1 petition is set to expire January 10 which is less than 2 months away so I will reach out to USCIS and hopefully they will allow me to submit the additional proof. Since the interview my fiancé and I have been speaking about the possibility of me traveling to Nigeria next year to do the wedding since we're not sure anymore that having the wedding in the US will be a possibility, that's if the K1 is revoked. As much as I would love to travel back to Nigeria to be with him and his family and don't mind having the wedding there, so much time, money, tears, etc. have been spent on the K1 process to just let it go.. especially when we felt that the validity of our relationship would be apparent during his interview . Hi VO and welcome back to the forum.We really missed you here..I will like to ask if you have an idea of when case would be completed/ approved after sending it to USCIS....(months)??.My wife who is a LPR just sent out the I-130 form this week..Am trying to prepare myself for the wait time as I know how tiring the process is because of the loneliness.. Hello C/O I have a question regarding my pending I-130 case. My husband applied for a travels visa in October 2012 . At that time we was not married he was denied. While preparing to apply for traveler visa he hired a person to assist him with the paperwork. At this point the travel agent informed him to put married on his application so he did and so a married certificate was given to him to use by travel agent but the visa was denied . In 2013 February I went to Nigeria to Marry my husband unbeknown to me the previous had happened. We filed our case in March 2013 case complete in April 2014 interview June 2014 at that time in the interview he was question bout the wife that was used on travel visa . We got denied . My question is will he ever make it to usa now ? Please please help !!!! |
