Prosecutors usually charge people to court for multiple offenses even when only one offense is committed. That way they are hopeful of getting the maximum possible sentence for at least one or two of the charges.

In the case of these Robbers it was three: conspiracy to commit robbery, armed robbery and stealing.

Now both conspiracy to commit robbery and armed robbery carry the maximum sentence of death. Usually the judge would have handed two death sentences for both counts but since you can't kill a man twice, he handed a death sentence for one and a life sentence for the other. If there was no conspiracy charge, the judge would have still handed the death sentence for robbery.

for every count charge in law there is a corresponding sentence. When there is a multiplicity of charges then there will be a corresponding multiplicity of sentences to run either cumulatively or concurrently depending on the court's discretion. according to the article the sentence for stealing was 3 yrs which is appropriate because stealing is a simple offence. The sentence of death was passed for a sepetate crime altogether. Do u see where the Op's topic is misleading? because they were not sentenced to death for stealing. If stealing was all they were charged for they wld hv only a 3 yr jail term hanging over their heads.

No matter what you think and say the judgement is still very harsh. They did not kill anybody with their weapons and now they are gonna die.
Nigeria laws are stupid laws.

Its not my opinion. Its the law. Not just Nigerian law but the law of many common law coumtries that still hand out death sentence. It is not so harsh because the law considers that any one who is armed is capable of causing grevious harm. If a person can point a gun then he is capable of shooting it.

Totally right. While we may agree on sentiments that the sentence is harsh, but on the principles of law it is totally right and the judge is not a monster.

Infact the Robbers are the monsters.

Not for stealing, for armed robbery.
For stealing, it is 2yrs imprisonment and or N1.2m.
For armed robbery, it is death by hanging. But don't worry, we lack hangmen in Nigeria, most people just die on deathrow anyway.

I still believe the law is hostile and should be changed. Even common sense is enough to know that the sentencing was very harsh.

They got life sentences for armed robbery but were Sentenced to death for "conspiracy". I honestly don't see the justification from my lay view and so far, you've not made a persuasive let alone compelling case for such a judgement.

I doubt the source of this news because by our criminal justice system, an accussed dou can only be convicterRd upon facts and evidences before the court. H®owever, when charged with a capital offences e.g murder...that's when deth penalty attracts the offence and not stealing which is criminal in nature. The Judge erred in his conviction and this should be up turned on appeal. I so submit

I too agree with you on that. But then the law is the law. What criminals should do is to find ways to steal without arms. That way you beat the law at her game.

the law is at it is and not as it ought to be. Pointing a gun at me doesn't means he is capable of shooting me. The intent of a man can't be tried for devil himself knows not the intent of a man. Though treat to life is a criminal offence and it is punishable but it must be proved beyound reasonable doubt.

OSOGBO—Justice Jide Falola of an Osun State High Court sitting in Okuku has sentenced two robbers to death for stealing fowls.

The convicts, Olowookere Segun and Morakinyo Sunday, were found guilty of forcefully breaking into the house of one Mr. Balogun Tope, a police officer attached to Divisional Police headquarters, Okuku, in April 2010 and carting away some of his belongings.

The convicts were charged with conspiracy, robbery and stealing contrary to Section 6(b) and 1(2)(a) of Robbery and Firearm (Special Provisions) Act, cap R 11 Laws of Federation of Nigeria 2004 and Section (390)(1) Criminal Code Law, Cap 34, Laws of Osun State, 2002.

The prosecution team, led by the state Solicitor-General, Mrs Abiola Adewemimo, called six witnesses and tendered several exhibits during the prosecution.

The prosecution told the court that on November 13, 2010, men were sighted around Balogun’s home armed with cutlass and a dane gun, and that while two of them were arrested, others escaped.

The convicts were said to have confessed that they stole the complainant’s fowls, adding that they had been in his house before to steal.

Adewemimo said: “They also stated that they had earlier robbed Alhaja Umani Oyewo in her house and stole broilers, eggs and kegs of vegetable oil from the house.”

In his judgment, Justice Falola convicted them on only three counts: to death for conspiracy; life sentence for robbery, and three years imprisonment for stealing.

Justice Falola recommended that the governor can decide to commute the death sentence to 10 years imprisonment, considering the convicts’ ages.
