But In the course of my appeal can i include documents that were not included during my application. All the supporting evidence from the spondor I, e payslips, bank statements, tenancy agreements, empoyer's letter etc have to be submitted in the UK. You only need your passport, 2 passport photos, print oit of your payment confirmation and appointment letter at the VAC. They will not take "ANYTHING ELSE" from you. I had to lost my marriage certificate, English language test certificate and the TB test(done here in Nigeria) back to my Wife in the UK for submission. Hello house i went to pick up my passport but it was a sad new because the refused me on what i don't really understand, Firstly...Suitability-entry Clearance requirement------Met Relationship requirement------Met Other requirement like English and TB...Met Refused reason......Your sponsor is not exempt from the financial requirement as defined as paragraph E-ECP 3.3.I am not able to take into account any potential employment you have available to you in the uk or any offers of financial support from third parties. In order to meet the financial requirement of the rules your sponsors need a groos income at least 18,600 Pounds per annum. from the evidence provided your sponsor's has 16,544.62 from her employer per annum. In order to qualify or to meet the financial requirement you and your spouse requires the shortfall between the income threshold and your salary(i.e 2077.38*2.5*1600)=21.193 in savings in order to meet the financial and your salary. I accept that you provided evidence to show that your sponsor have savings of 23.131.27, however you have not provided satisfactory evidence to show that the entire amount has been held in her account continuously for the past 6months prior to your application. i therefore refused your application under paragraph EC-P1.1(d) of Appendix FM of the Immigration Rules EECP.3.1) Please house i need your advice because I just can't believe if the UKBA look at all the dates on the accounts we provided to them. we have had my savings from 13 April 2012 and the loyalty saving account was open on the 14 February, 2014 and the application was logged in November 2014, that's a 9 months gap that I have the money in my recent account and we submitted a 6months bank teller..Please help me because i need to appeal |

Nope she earns 16.544.2 but that why we have a savings up to 23.131.27 pounds more then the 21.193pounds they requesting! and we submitted a 6 months payalips justwise: |

Bolssos: That does not meet the financial requirement, it says the sponsor needs to be earning at least £18600, they are not relying on your savings but on your yearly earning. |

Bolssos: Bro that is the 2rd point of the refusal, that was not the only reason for the refusal, so even if you met that requirement you still have to meet the other one. |

HIGHER SPOUSE INCOME, 5 YEAR SPOUSE VISA, NO THIRD PARTY FAMILY SUPPORT & STRICT HUMAN RIGHTS REQUIREMENTS - The UKBA are introducing a new minimum income threshold of £18,600 for sponsoring the settlement in the UK of a spouse or partner, or fiancé(e) or proposed civil partner of non-European Economic Area (EEA) nationality, with a higher threshold for any children also sponsored; £22,400 for one child and an additional £2,400 for each further child. This is expected to be the amount after accommodation costs and expenses are deducted. No third party support will be allowed which means that the UK spouse/sponsor has to be earning this amount at present (a future job offer will no longer be valid) and no financial support from family or friends can be taken into account. Only savings of £16,000+ can be considered if relying on savings also. If you do not meet the rules, you will not be given a visa. i won my review and i subnit my passport to d embassy on 8 of jan, i now received a email on jan16 that my visa has be processed and is ready for collection,we aim to return your passport at d visa application center where you first lodge ur application within two workings days. it has pass 2 workings days i hav nt yet received any sms for collection,it now getting to jan 22 |

Bolssos: Definitely. As long as you have evidence to prove that those savings have been available to either yourself or your spouse over the last 6 months. Your main focus is on the financial requirement so you need to resubmit your finance paperwork. Highlight the wages received and make sure the bank statements correspond. Then provide statement of the savings, I hope the account is in either yours or your wife's name. These need to show the balance in excess of the minimum savings requirement over the past 6 months. Now i know it wont count since the dates will be outside of the application period but I expect that these savings are still in your account. So it might be worth including a current statement and then making the note that these funds continue to be a available to the both of you. When you are writing your statement. Use the refusal points as your headings and then list the documents you've supplied to support your case under that refusal point. As long as the evidence is good, I don't see any reason why this refusal won't be overturned, you've both passed all the other elements and as long as these savings are genuinely available to you, then you'll be able to provide all necessary documents. |
