No, you can't bring the child to the U.S. with you unless the adoption is already full and final. The two years of legal, physical custody means just that; the child should live in your care in Nigeria; sending money is not enough. If you can't meet these criteria, and it doesn't sound like you can, you might consider adopting the child in Nigeria now and filing the I-600 as soon as you or your husband naturalizes.

I need help concerning my CASE STATUS. I had my interview in Lagos on the 15th of January and the VISA was approved. The VO told me I should be able to collect my passport yesterday (Thursday, 22nd Jan). However, I checked the CEAC website for my case status and its stuck on READY ('your case is open and ready for interview'). I am really confused mostly because the date of last update changes every day but it still says READY.
I will appreciate it if you can find out an update on my case.
My Case number is LGS2014810001.

While I've read just about everything there is to know about the process, I think getting advice from a Visa Officer is priceless. What can she expect at the interview, and does the fact that we have a child together make it easier for her?

just a few questions to ask kind VO. i am very much aware that Nigeria is no longer eligible to participate in Visa lottery program. does this mean the waiting years for family petitions will reduce from longer years to lesser number of years? since you wont be handling visa lottery cases anymore? and also, when is the visa lottery process going to end?(for those precessing the last visa lottery win). as this will allow more focus on petitions.

It depends whether the spouse in the U.S. is a citizen or a Legal Permanent Resident. If the spouse is a U.S. citizen, the case will likely be scheduled for an interview approximately six to eight months after filing. If the spouse is an LPR, wait times are currently running around 21 months.

Unfortunately there is no visa category for married children of Legal Permanent Residents. Your petition was thus rendered invalid on the day you got married. You should inform NVC. I must warn you not to try to hide your marital status, as if you do and we find out, you will incur a permanent ineligibility from entering the United States. It's much better to wait until your mother becomes a U.S. citizen and can file for you again.

The VO should have told you Jan. 29, as K visas take a bit longer to process than other immigrant visa categories. Sorry about that. Your visa will probably be printed today, barring the unforeseen. Thanks!

Don't worry -- using a space is the right way to deal with our cranky software. Our systems can't handle hyphens or apostrophes (so all the O'Neals out there become O Neals when they see us). It won't be a problem during your interview.

Greetings! Every case is different, but having a child together is indeed pretty darn good evidence of a relationship.

However, we are expecting to see our regular IV numbers increase substantially and significantly this year (starting in February!) because USCIS has released a great many more cases than expected. We're excited about the increase, and my goal is to make sure that everyone is scheduled for an interview as soon as they are eligible. It's going to be fun!

I would like to ask a question regarding a chum of mine. His girl friends family would like to see him and sponsor his trip how would he go about it. And what are the document s he has to submit and what his girlfriends family would submit. Its actually the girls maternal and partnernal how like to see him and know his intention. Would want to know sojourning with a virgin passport would it be of any problem? I would like to know ties that would meet the requirement of the embassy. And thanks for the help u have rendered to me Ma'm.

That's the correct phone number -- maybe the network is experiencing problems. The visa was printed on Friday, so it should be ready for pick-up Wednesday at the very latest. But it is always best to call before making the trip.

in reference to Olatosin2020 question, what if his mother is already a US citizen and just got approval from USCIS for filing under Unmarried son(above 21yrs) of a US citizen. And in the process of waiting for his interview date which probably is years away from the approval date, he gets married and have kids. Does this automatically render the application void? And if it does, it means the program isn't favorable to him as he might have enter his late 30's and not gotten married all because he wants to migrate to the US. Nobody would like to marry late, everyone wants a family of their own. What's your say on this my gallant VO. *no offense*

Maam I keep dialing the number ‎094601748 its never connecting on my mobile phone I have dial it over 100x even put +234‎94601748 its not connecting at all. Going by this, I am presuming those of us scheduling for K1 interview may likely have nearest available dates to select for interview? ... Although my case is still with TSC which presently are so slow cos they claimed they have a lots of backlogs... Hoping to hear from them soon as it appears they are currently working on July 2014 filers now which mine too was in July. How I wish NVC would grant us a special speed considering the time TSC has wasted on our cases unlike their CSC counterpart...lolz
