The erudite Prof has hit the nail on the head by stating that we do not have the minimum systems and processes to tackle corruption as is being done in other countries.
The APC have up till now decided not accept that the freedom of information law applies to them or even domesticate it if they insist that it is on the concurrent list, despite the rulings of various high courts to the contrary. This has made it nearly impossible for the public to access information on the looting going on at the state level, just as we are accessing information as to what is happening at the federal level. Is it not an irony that the APC are the ones singing about 'change'? I guess that one of the first thing they will do if they get into power is to water down the FOI law, or scrap it altogether so as to protect themselves from public scrutiny.
There is presently before the national assembly, the asset forfeiture bill that has been gathering dust since 2010, which will go a long way in ensuring that people do not benefit from loot of any kind. The law bill stipulates that any asset traced to you would be confiscated by the government if you are unable to prove how you earned it. It seeks to transfer the burden of proof from the government to the accused making it cheaper and faster for the prosecution of corruption cases. In addition to the passage of this bill, there is the need to amend the constitution, removing immunity from prosecution on corruption cases for the president and all the governors, a special court to handle corruption cases, a new evidence act to ensure that computer print out of bank account statements of can be tendered in court to also ease the difficulties in prosecuting corruption cases etc.
The combination of the FOI law and the asset forfeiture law will definitely be a game changer in the fight against corruption. Infact, it will make political office unattractive because a corrupt politician will not get away with corruption. These are the basic minimum systems and processes existing in the US, UK, even South Africa.
So, when Dr Ngozi Okonjo-Iweala is saying that Nigeria presently does not have these systems/processes to effectively fight corruption, she is absolutely correct and people who are clueless about this issue should just shut up. Beyond going on the social media to post "Sai Buhari", you guys should ask the relevant questions as to how Buhari wants to prosecute the so-called anti-corruption war if voted into power, operating within the legal confines of the extant laws of the land.
It is pertinent to note that a lot of the Senior Advocates of Nigeria (SANs), who presently are part of the so-called progressives like Wole Olanipekun and co, have become specialists in defending politicians accused of corruption in court. They have perfected the art, in collusion with some corrupt judges, in getting adjournments after adjournments of corruption cases to ensure that EFCC gets tired of prosecuting cases over so many years without even the court looking into the main substance of the cases. In some of these cases, the defense counsel will be contesting jurisdiction for as many years as possible. How do you expect the government to continue to pay its prosecution lawyers for close to ten years just to get a conviction that may never happen. Out of frustration, EFCC would then end up settling for the plea bargain option which is basically allows the thief to go home with more than 80% of his loot.
In summary, nigeria must restructure if she must move forward because the corrupt national assembly becomes bipartisan when it comes to protecting itself from anti-corruption agencies. They have become so powerful that the only way in ensuring that the asset forfeiture bill is immediately passed into law is a mass action from the nigerian people, demanding that these systems and processes are immediately put in place. This is beyond all the noise making by the self appointed APC "change agents" who we all know are as corrupt, it not more than the PDP. |

Developed worlds are looking for ways to limit or even phase out traditional policing to be replaced by technology, you are here talking rubbish and feeling intelligent. A relative of mine who have worked in the police force for more than 32yrs now always says to anybody that would listen that she has seen too many armed robbers killed by the police but yet robbers are still robbing. She says that even in the venue where robbers are being executed, others are coming to steal and pick pockets there. Go to the ghettos in New York where many black people are being thrown into jails everyday, yet the crime rates are still high there. All you guys want to see is people being jailed, how about prevention for a true change. Even the US is tired of building jails cause they are expensive to maintain and operate in the long term. I agree with what our finance minister said but i would like the government to make sure that notable people get purnished for those crimes if busted and also political forgiveness for criminals should be discouraged. Let those presidential pardon go to people who were wrongly convicted or those that had sincerely change. |

On a scale of 1 to 10 of leadership skills and intelligence, 10 being the highest, a leader on level 3 like we have now can only attract people with level 2 and 1 around him that is why we are saddled with the likes of Abba Moro, Okupe, Obanikoro, Fayose, Sambo etc around Jonathan. If he manages to attract a 6 or 7 like Okonjo-Iweala, the natural occurrence is for her intelligence to head south and tend towards 4 or even 3. Before you blame it on the law makers hence absolving Iweala and Patience Goodluck, let me quickly remind you the laws that were passed in recent times.
NERC act as amended was quickly passed into law, we didn't even get the chance to peruse its contents before the legislation express tickets was granted, as Nigerians what we noticed is that a 750 naira access charge have been smuggled into the new law and implementation to commence effective immediately.

Another law that will interest you is the indigenisation policy act as amended we did not know the details of the law till SPDC decided to dispose off 5 oil blocks OML26, 30, 34, 40 and 42, BPE insisted that the new law must be followed to encourage indigenous companies to participate in oil and gas acquisition, before we could shout "blood of god", 5 oil blocks estimated at 2 billion barrels of crude worth over $200b flew wings and landed in the pockets of friends and cronies of Mr president.
Till date I am still in shock how the legislature was able to block the PIB, could it be that the legislature have seen the thick choppings there in and they have not agreed on a sharing formula? OR the prayers of men and women in the oil sector have been answered?

If the problem Nigeria is facing is just evading tax, then we dont have a problem.
In those countries, before u even start working and earning you need social security or some form of id in the system. Govt can track how many employess it has and the salaries paid. In Nigeria govt does not even know how many employees it has and they are still paying salaries .
Even if you are a police officer who books people for over speeding or u sell ticket at the train station. Every ticket given and fine collected is stored in the system.
Here a police officer stops u and tells u ur fine is 10 but bring 2k. Someone who is suppose to be collecting a levy for govt, prints his own fake reciept and is collecting the money.
Is it better to chase after each individual engaged in this corruption or ensure that there is a computerized system that documents all revenues collected.
why do u think offices in govt often get burnt when a director is about leaving office? This is just to burn the paper so he or she does not have to account. But if the info was in a database somewhere, a report on their activities will just be generated. Dont be shallow in ur thinking because of politics. |
