I have to apply for a new visa and retrieved my old DS160 application and saw the error. What should I do on the new application? I feel that my situation is unique in the fact that I need to give specific information from my past, in the application process.

In 2000 I went to a Bible School in Canada. After graduating 1 year in 2001 during summer vacation period I have entered US illegally having just Canadian student visa. I regret this foolish act that I did ! 15 minutes after my entry into the USA, I was arrested and was sent to INS detention center in Seattle WA.
In couple weeks I went to see an immigration judge,who gave me a "voluntary departure" back to Canada. I was transported back to Canadian border. CIC officials would not let me in,because I had single entry Canadian Student Visa and because of that, I automatically became inadmissible to Canada because I had violated the immigration law.
I then was transported back to Seattle WA INS Detention Centre... In a day or two I saw an immigration official who told me that they will deport me back to Ukraine (my home country) and if I didn't have the money to pay for my ticket - I will get a 10 year bar into US. I was almost 19 and had no money to pay for the ticket.

Besides violating the Immigration Law - I have not committed any other crimes....this "road trip" to Seattle ,to see my friend was the only thing I've done illegally, and I regret my actions.

In June 2011 my 10-year bar has expired, I've been frequently traveling to many other countries (mainly in EU) ( between 2002 until present)

Here is my question,

- Do I need a waiver if I decide to apply for a US visitors visa?? Or because it’s been more than 10 years ago I can just apply?
- in your opinion, what advice would you give to me in relationship to me trying to become a visitor in the US?

Uche wants also to get passport for her other siblings. How will Uche go about it since Uche's siblings were born in Nigeria. Uche's mom is white and USC and still lives in Nigeria. Hello, VO, Please I need guidance. In 2013 while I was working in Nigeria, I applied for a US Non-Immigrant visa using an Agent. After I paid the Visa fees in the bank GTB, I noticed some funny character from the agent when she claimed she had scheduled me for an interview. I requested for a confirmation mail as a proof of appointment but she didn't send any. So I backed off the appointment to avoid ruining my immigration status. (Note. I didn't attend the interview because I felt it was a scam). Lately I have been to Germany (studies), Uk and Ireland. Now my question is whenever I am opportune again in the future to visit the US and I am scheduled for an interview, ''when the VO asked if I have ever applied/or rejected for a US visa, what should be my appropriate answer''?

Please note, the reason why I am confused is that I don't really know if actually the said agent truly booked any appointment for me since she couldn't provide me with a confirmatory email from the embassy and I don't want to go and embarrass myself in the presence of the VO in terms of lying.

In summary, booking an appointment and not attending, does it count as a visa application/rejection? and if appointment was booked but not attended what should be the appropriate answer when asked if you have applied for or have been rejected a US visa before?

Hello folks I need an advice/views about what am about to post here.I applied for American student visa in 2002. Before then I had attend and written a SAT exams in Lagos. Its a company that we paid to then to write the exams . On the day of myinterview in Abuja. I was asked every document which I presented until the lady asked me if I wrote SAT I said yes. She demanded for it and I presented it to her. After a close look at it she flared up that its fake and showed a colleague of hers and he confirmed its fake. She said she ain't gonna allow me enter her country and stamped my passport after inputting some stuff to her computer.Its been years since that happened. I alreadyfinished my bsc here in Nigeria and my Msc is in view presently. I have a paid employment and am relatively doing well. The issue now is was I banned? If I go to apply for a visa again will the last incidence crop up? I lost the last passport to fire and intend to go do anothe. Pls what's your candid take on this. Kind regards.

With utmost respect and appreciation i seek your assistance in shedding more light to my situation on the subject matter (Section 221(g) of the United State Immigration act and as it affects my application. We tried applying for a US Visa Visa in 2013 and 2014 as tourist but we were refused do to loss of memory on my side as i did forgot to mention that i was refused in 2002 and this counted against us in 2013 and 2014 i suppose.

Later, I got a Shengen Visa to attend an IT conference in Poland which also gave birth to our securing another Schengen Visa for my Family to visit France for the 2014 December holidays to resume work in January 2015.

Without further Ado, i was approved from work to attend a conference in the United Kingdom on IT and i applied alone again for the US visa only to be given a blue form (Form 221(g) herewith attached) that i will be called upon that further verification/investigations needed to be done on my case and this makes me so concerned as i do not know what this really means.

Please i implore you to further explain as to what and why this might be happening in my case and what outcome should i expect. The form is attached.

There are many reasons why we might do a site visit. They all boil down to wanting to verify that the petitioner and the beneficiary have the relationship they claim to have. The site visit will always take place after the initial interview.

Yes! You can absolutely include your child as a derivative in your F-2B application. The child will be able to travel with you.

I am still doubtful of continuing this application because the embassy in Warsaw is not helping at all with what should be common standardized knowledge to them - US immigration policy and law. They are handling it like something as simple as what you just explained from your understanding of US immigration law- " if you choose to continue, the officer will be most interested in making sure that you really are married to each other NOW and that you did not omit any spouse and/or children who existed at the time of your original entry" ... is the basis of the entire adjudication of our application when I have tried to let them know that this is just a small part of the entire application which they can help me understand. This is because a part of their FAQ says(I will highlight the areas of concern below)

"3. Some of my family members did not appear on my original entry form into the Diversity Visa
lottery. What should I do now?
If your family situation has changed since you submitted your original entry to the Diversity Visa lottery (for instance, you have gotten married, divorced, or had a child since you entered), you will be allowed to submit a visa application that reflects your new family status. that's why I need to be sure that we have not unforgivably broken the rules. As you know, there is no appeal process so if we get denied for such a silly reason this would affect my future travel plans and credibility which is something I value.

I just sent them an email again yesterday to try for the last time to see if they will clear this up. If we have unforgivably broken the rules, let them just come out and say it instead of misleading me to go on with the application and getting denied in the end. If we are able to get it, it would be valuable but We are not that desperate to break rules in order to get the US permanent residence and can afford to not continue the process if we have unforgivably broken the rules.

Meanwhile, I am gathering documents and the subject of the Police certificate came up. Before I left Nigeria in 2007, I made a Police Character Certificate which states that it expires 3 months after issue. Do you think that this expired Certificate would suffice for the period I lived in Nigeria while I get a fresh Police Certificate from Poland that would cover my stay since 2007 up till now Or would you advise me to have someone help me get a fresh Certificate from Nigeria which would accompany the other certificate I will be making here in Poland? (I wonder how they would make one in Nigeria in my absence since I would need to do some finger printing and I have the page with my fingerprints attached to the Certificate I have now)

Also what else can be considered financial documents other than bank statements? Apartment ownership title? Vehicle ownership titles? To compliment what is in the bank.

From what you've written I see no reason why you shouldn't continue your application. Even if you're unsuccessful, the application wouldn't have an adverse effect on future applications (unless you were found to have committed fraud -- which it doesn't sound like you're contemplating!).

Your Nigerian police certificate has unfortunately expired (we consider them valid for 12 months from issuance) so you would definitely need a new one.

You write, "If we have unforgivably broken the rules, let them just come out and say it instead of misleading me to go on with the application and getting denied in the end." Legally, we're not allowed to do that. You haven't paid the fee yet, so we can't adjudicate your case; and anyway, we can't adjudicate your case without seeing you in person. We're not trying to mislead you; but it IS up to you to read and understand the rules before you come to your interview. And it seems to me that you're making every effort to understand the rules! Again, from what you've written here, I see no reason to give up.

I think the safest course of action is to e-mail us with your case number and explain the situation. That way you'll have evidence that you were absolutely not attempting to misrepresent yourself.

Good morning Andriy,

Based on what you've written, your ban has expired and you are no longer ineligible, so you can just apply. The officer will likely be rather curious about whether you intend to use your next visa properly -- but now that you are in your 30s the officer will be more interested in your current situation than in a mistake you made when you were 19. If you are forthcoming about the experience in 2001, the officer is not likely to hold the experience against you. Good luck!

If Uche's mom was a U.S. citizen who had spent at least five years in the U.S. before each of Uche's siblings was born, her siblings are already U.S. citizens! If so they should make appointments for passports in Lagos or Abuja by following the instructions at http://nigeria.usembassy.gov/acs_abuja_passports.html .

If the mother was not in the U.S. long enough to transmit citizenship to the children, they would need to have I-130 petitions filed for them by a qualifying relative who lives in the U.S. As the mother lives in Nigeria, she cannot file for the children. Uche can file as their sibling -- if she lives in the United States.

It sounds like you were given a pick-up slip for a non-immigrant visa rather than for an immigrant visa. Immigrant visas take a few days longer to pack.

If you didn't attend the earlier interview, you never actually misrepresented yourself to a Consular officer. Just be sure to be completely honest about what happened if the next officer asks.

Greetings! I imagine your sister is here today. Her visa category will change from F1 to F3, and she will need to wait a few years before her case becomes current again. But she will be able to travel with her husband and children, so it will all be worth the wait.

Nope, not true. Travel history is just one factor among many.

You should just be able to walk right in and say "I am EUma." They can check your identity against your passport. Please let me know if that turns out to be a problem......
