AyoSire: It's absolutely fine to apply for a non-immigrant visa while you have a pending immigrant petition. That said, it is more difficult to convince an officer that you intend to return to Nigeria when you're clearly an intending immigrant; but it's not impossible. We recognize that people have valid reasons to travel temporarily to the U.S. while awaiting their immigrant visa interviews. Good luck! |

Richmond996: There's no adverse effect to sending several e-mails in terms of visa issuance -- but in terms of making things happen, one e-mail is just as effective as ten. |

Hello VO, Please just a quick question. Been scheduled for another interview after Administrative processing, is that a good sign or good news? Does that means the visa is been approved? I know all cases are different, some are asked to drop off their passports, some are asked to come in for a second interview please can you shed more light on this processes. |

Helo ma,I ve finally gone to join my hubby thanks very much for ur help.pls ma I have 2 questions.1, is it true dat immigrant cases are been witheld till July cos of security reasons.2, one of my friends who is a LPR applied for visiting visa for his wife unfortunately she was denied and was told to tell her hubby to file for f2a, does it mean f spouse of LPR can't visit their hubby/wife?. |

omotfavy: 1. What?!? No, where'd you hear that? 2. While I can't be sure because I didn't do the interview, it sounds like the officer didn't believe she wasn't actually an intending immigrant. It's possible to obtain a non-immigrant visa if you have a spouse living in the U.S., but it is difficult, because all non-immigrant visa applicants have to overcome the assumption that they are intending immigrants. |

Hello VO Good day to you, My CEAC status for a while now has been in "Expiring Soon". We are in the process of resubmitting the petition. So do I need to withdrawal the petition at embassy or at USCIS? Or is it already expired and done. This case came to embassy in 2013. Expiring Soon Immigrant Visa Case Number: LGS2012XXXXXX 01 LGS Case Creation Date: 16-Aug-2012 Status Updated Date: 11-Aug-2014 "Section 203(g) of the Immigration and Nationality Act requires that your registration be canceled and any petition approved on your behalf canceled, if you do not apply for your immigrant visa within one year of being advised to do so. You were advised of this requirement over 1 year ago, but we have not received a response from you since then. As a result, your application for a visa has been canceled and any petition approved on your behalf has also been canceled. Your application may be reinstated and any petition re-validated if, within one year, you can establish that your failure to pursue your immigrant visa application was due to circumstances beyond your control. hello v o,weldone for the good works God will bless you.please i used a false identity ignorantly some years back through D V lottery in which i was denied and after that i changed my passport to my real data in which my company has sent me to germany for some intensive trainings that was early last year.please i intend to visit U S A and i dont know whether, (1)i will be arrested if they finally discorver because i dont want my image to be distroyed and i dont wanna loose my job,(2)will i be granted a tourist visa if i tender my leave application form from my work places.thanks as i await a possitive response. |

mugisco: You could try writing a letter explaining all this to USCIS. Did he marry and divorce his first wife under Islamic rites? Was there ever a marriage certificate? If not, just write and explain that he listed his first wife on the petition in order to be as forthcoming as possible, but because the marriage was under Islamic law there was never a marriage certificate, nor is there a divorce certificate. You could try submitting an affidavit explaining all that, but we don't generally put a lot of stock in affidavits because they're so easy to get. On the other hand, in your situation, I think one might be warranted. It's a little more official than just a letter... Good luck! 1 Like |

bigsamo: At this point you probably won't be arrested. However, you will be found ineligible under INA 212(a)(6)(C)(i) for material misrepresentation, use of a false identity. If the officer doesn't also find you unqualified under 214(b) as an intending immigrant (because, after all, you now have serious credibility problems with us), the officer will tell you how to apply for a waiver of the 6C1 ineligibility, which may or may not be granted. |

Yes there was a marriage certificate from court.they migrated to usa together in 1996 but he divorced her in 2006 under islamic law.but that divorce wasn't documenter during that year.a friend of his told him he nneeded a divorce certificate from the court before he can file for us.we went for a divorce cert but the date of which the divorce certificate was sealed is 2014.help please. |

mugisco: Ah, that is true. Because he married in the court, his 2006 religious divorce did not dissolve his legal marriage. Thus, under U.S. law, your 2008 marriage is not valid. He needs to divorce his first wife through the court, marry you again, and file a new petition. |

mugisco: Since you married in 2008 and 2009, before the court divorce document was issued in 2014, your marriage will not be considered valid for purposes of immigration to the United States. It doesn't matter that the court divorce document says you were free to marry in 2006, because that isn't true. Only a court-issued divorce decree can dissolve a court marriage, and it cannot do so retroactively. |

Good day vo, i got married in September last year to a US citizen, prior to that i had an american visa which i used 3 times.I live and work in nigeria and my husband will like me to have our baby in the US this year,i will like to know if having our baby in the US on his insurance will affect my future visa application.Because i do not intend to leave nigeria anytime soon. I also believe his filing for me might debar me from getting a visa for sometime if my visa expires, and my job might take me anywhere at any time. Kindly enlighten me VO.God bless you |
