The Law, please i need a guide. I purchased a plot of land in one village in Ibadan, i've done the land agreement with my lawyer (a friend), how do i perfect my document? yes i need to start with the land survey and the rest but could you please state detail and forward to my email or you send it here if you so wish, thank you sir. Email:johnalabi01@yahoo.com I want to know where to go (be it LG or state secretariat) i want to do all necessary documents because i'm no longer trusitng my agent together with the land seller, even the agent is a family friend but i do not want to take 'anything' for granted please help bro. |

Hello Lawyer. The plots shown to me at Omi in Ibadan do not have any documents apart from Family receipt. No survey plan and no deed of assignment. |

Ok, let me start by saying you did well to take the time to put this together. As an executive assistance/marketer with a reputable property company, I can put it to you that you are probably not in this business. Sorry to bust your bubble sir. I have been doing this for more than 10 years so i know the industry inside out. My basis for that assumption is that you should know that most of the documents you mentioned above are strictly confidential. No document is confidential as it regards sale of land. The basic documents that must be shown to any propspective buyer is the reciept you used to purchase the land that shows you validly own the property to sell, the deed of assignment conveying title to the company selling the land and the Survey plan describing the Land the company bought. Anything less shown to a prospective buyer is fraudulent and deceptive to any prospective buyer. I don't know how these mushroom's property companies operates. But where i work, you wouldn't bother to ask for such and such when you see what we have on ground. What ever you have on the ground does not equate with the paper work you need to show me that validates ownership of the property you intend to sell to another. You can build 17 bedroom flats on it and design it with Gold for all i care but i am only interested in your title documents because its the title documents that would determine whether i am buying from the right source or not and if i am violating any Government rule in case i buy your lands. It is hilarious to think of showing these documents to every body that works into my office to make inquiries. That's a very sad statement to make. Why are you hoarding the documents that would determine a prospective buyers choice whether he should buy it or not? And whats so funny to you that you cant show these documents to everyone who shows interest to buy your lands? How do you determine who is serious and who is not? Is it after they have paid that you would show them the documents? What if your papers are not complete and you tell me its under processing, do you think a prospective buyer would take it lightly or trust you? I have not even seen some of them myself Then your not adequately qualified to market your company's product more especially if someone like me is contracted to investigate your properties and i meet you. What if i don't meet your legal secretary or M.D? How would you adequately answer all my legal questions concerning ownership and title if you yourself have not seen some of them? Bro you just lost a customer with your last answer. There are several other ways of knowing the status of a property before purchasing it. Such as? There is no other way apart from you showing me the documents your company possesses that gives you the authority to sell. And I think you should be overly concerned with some of these documents when you dealing with individuals and not organisations. That's not true. Companies owe a greater degree of responsibility to Buyers than Individuals because if the company defaults, the buyer has very little recourse to recover his money due to the rules of Bankruptcy, Company Liquidation and payment of damages. Dealing with an individual provides more stability because you know who is selling directly coupled with the immediate risk. You expect Dantata & Sawoe or Cahaah Nig Ltd (where I work) to show you their survey plans and Government consent because of one three-bedroom you may end up not purchasing. hahahaha Yes i do and i would advise people not to patronize your company until you are ready to open up your books and show them your documents conferring title and ownership to you that you intend to transfer to me. A defective title would not cure any problems i might have concerning that land in future and its best for every buyer to investigate it before purchase. Finally its your right to show a future buyer all documents irrespective of whether they are buying now or not. Thats what is known as due diligence and that person who isn't interested in buying now, may recommend someone else to you tomorrow. Don't be too cocky to underestimate people. 7 Likes |
