The Code of Conduct Bureau will not make public the details of assets declared by President Muhammadu Buhari and Vice President Yemi Osinbajo due to limitations in federal laws covering such release, the office has said.

There has been controversy over the release of the details of the president and vice president’s assets since their inauguration May 29.
Mr. Buhari pledged to publicly declare his assets despite the lack of a law requiring him to do so. The Nigerian Constitution stipulates that senior office holders declare their assets, without requiring them to do so publicly.


Despite his promise, the president has yet to publicly declare his assets three weeks after taking office. His office said those details will be made available after the Code of Conduct Bureau authenticates claims in the declaration forms.

A civil society group, Stop Impunity Nigeria, an affiliate of the Centre for Social Justice, had on June 1, 2015 applied to the CCB to request copies of the completed assets declaration forms by the President and his deputy.

The application, signed by the Lead Director of the Centre, Eze Onyekpere, was pursuant to the provisions of the Freedom of Information Act (FOIA) 2011.

But, in its response CCB/HQ/670/G/1/104 dated June 10, 2015 and signed Ijeanuli Ofor on behalf of the Chairman, the CCB declined the request, citing the absence of prescribed law by the National Assembly authorizing the release of such information to the public.
The Bureau conceded the right by Nigerians under section 1(1) 3 and 4 of the FOIA 2011, to “access or request information, whether written or not in written form, in the custody of any public agency”.

Regardless, the Bureau said sections 12(1) (a) (v), 14(1) (b) and 15(1)9a) of the same Act empowered it decline any request, which it considered an “invasion of personal privacy”.

“Assets declarations by public officers contain such personal information, which falls within the exemptions to the disclosure of information in the FOIA,” the Bureau said.

The office explained that paragraph 3(c of the Third Schedule, Part 1 of the 1999 Constitution (as amended) empowered it to “make assets declarations of public officers available for inspection by any citizen of Nigeria only on terms and conditions prescribed by the National Assembly”.

“However, the terms and conditions under which that can be done have not yet been prescribed by the National Assembly,” the Bureau said, adding that the group’s request was rejected in view of the absence of the prescribed “terms and conditions”.

Following the heightened criticism against President Muhammadu Buhari’s secret declaration of assets as against his campaign promise to make public his assets, reports have come to light to reveal that Buhari who claimed to be unable to buy the March 28 Presidential form is set to declare an estimated N879 million in assets.
Dr. Katchi Ononuju a Peoples Democratic Party, PDP, Chieftain who first spoke to the African Independent Television, AIT, correspondents and later to Post Nigeria authoritatively stated that Buhari had a lot to explain as the APC was making frantic efforts to give the President a soft landing on the matter.

According to Ononuju; “An e-mail which emanated from the office of the President is set to declare almost a billion Naira in assets.

“This is a major reason why the President has decided not to declare his assets because the APC is hiding under the pretense that Buhari is broke and could not pay for his presidential form.”
He went ahead to state that the National Publicity Secretary, Lai Mohammed and the Governor of Kaduna State, Malam Nasir El-Rufai called him via telephone pleading with him not to unravel the mystery behind the secret declaration of assets by President Buhari as against his earlier electoral promise.

President Buhari who claimed to be “broke”, took a bank loan of N27 million to purchase the APC presidential nomination form to contest the 2015 general election.

Buhari had lamented the high cost of the nomination form, but said that he was fired by his ambition to procure a bank loan, through the assistance of an unnamed bank Chairman.

And the N879 million is just a tip of the iceberg, wait till BreakingTimes reveal his real estate in Dubai.
Lets agree Buhari made good use of the $2.8b he looted, he invested well in Dubai.

We have been scammed.

Anyway, I seriously doubt that Buhari will want his assets to be declared publicly. Reason is, he sold himself to the majority of Nigerians as an austere man without any proclivity for avarice. Almost every of his supporter believes that he has no house in Abuja, has only 2 houses and 150 cattle to his name.

What do you think would happen if this illusion is unravelled?

For the records, Buhari and Osinbajo did not say code of conduct will make it public. He said he will after verification from code of conduct according to constitution.

The law does not permit the asset to be released to the public doing so implies go against the law . However, since PMB promised to declare his assets during his election campaign , he should go ahead declare his asset to enable others follow suit. Not doing so will make him loose the respect and public confident in fighting corruption in the face of many Nigerians including the international community . cool

Oh! When Jonathan said he had no shoes I was able to relate myseff with that because it sounded "real" but when Buhari said he had to obtain loan to purchase presidential ticket of N27m I never for a second believed it. How I wish the campaign was during ramadan he would have fear the rout of lying in the holy month. Lai Mohammed will talk less now because truth isn't easy, and pages won't be so full like it used to if he's to speak the truth. Forward Nigeria we pray for, we shall overcome!
