Pardon the typographical error, it's written on the way to church.

Please help is needed on this matter.

My landlady gave one of the tenants a 3 months quit notice to leave the house. The notice lapses at the end of june(Tuesday).

The woman has been threatening fire and brimstone, to show him pepper tomorrow saying the guy will not go to work if he doesn't pack out.

The said guy just told me dat he has paid for another apartment but the apartment is not ready. And won't be ready in a about 3weeks.

The question now is what should he do

Some pple said the landlady ought to give him six months notice, What should he do before things get out of hand.

Was it a court issued quit notice? If not then he should call her bluff. If she harasses him he should take legal action. If it is a court issued notice and if it was given three months ago like you said, then let it be known to you that no court will evict a tenant upon the expiration of such a notice. They will usually give an extra month or so before throwing the tenant out. So op either way, tell your friend to call her bluff, any harassment from her will amount to a violation of his rights in which case he should take legal action. Sorry for booking space. grin

Let him tell the landlady he is making effort to pack out and probably give her a definite date when he is sure the new apartment is going to be ready.
If she stills want to be "uncooperative", let him make a report at the nearest Police station alleging that she is threatening his life and wellbeing and that she should be "advised" to calm down.

He can also take a further step of going to make a complain at the nearest LASG Mediation Centre.

Anyone that knows the Landlady should advice her not to take laws into her own hand...... a lot of "Agbero Landlords" have ended up behind bars for this.
The days of impunity are in the past.

On the part of your guy (tenant), let him move-out ASAP, three months is about adequate to get a new house though it can be difficult but l dont want to encourage any sort of truancy on the part of a tenant.

The LASG Tenancy Bill is there to protect both Tenants and House Owners.... with punishment for both parties if need be. undecided undecided

It is not the duty of a court to issue QUIT NOTICE.

It is and will be legally and properly issued by the owner of the house or her Agent/Lawyers.

It is when the Tenant refuses to vacate the premises that the Landlord would apply to the court to have him forcibly ejected.
And YES, the court, through the Bailiff, can forcefully eject a tenant, seize his property and auction them off, to settle any owed rent.

But ofcourse, the tenant must have over-stayed his quit notice, for that to happen.

The proper notice for a Yearly Tenancy is 6 mths. After that a landlord must issue a 7 days notice of owners intention to recover possession. After that the landlord goes to file papers and issue a writ in court. Then the court matter starts. A tenant does not just pack out because a landlord has issued a quit notice. It is a very long process that takes a minimum of like a year

I am more informed than you. Courts don't throw tenants out without giving them additional notice. If you are any landlord's agent then go on and throw out their belongings you hear? Or remove the roof of the House (like i hear they sometimes do in lagos) and one day a tenant will use the damages your client the landlord will pay to build his house. Even after giving three additional weeks the court will still give one more week before confiscation of the tenant's property and his ejection. Continue una agbero agency, one day you will meet your match

If your friend is sure he can leave in three weeks then he should relax op, no one can legally evict him from that house, any form of aggression from the landlady should be fought legally. He should try not engage in a physical brawl with her so that he can completely have the law on his side

My aunty (a landlady) once had a problem with a tenant who claimed he paid his rent even though he did not. It is a case that could easily be resolved in court as the tenant had no receipt, but my aunty allowed her macho son to harass the tenant. Mr tenant went to court and stayed a total of one year and six months without paying rent. I was angry but what could I do? She took the law into her hand and the law defended the criminal.

After going to work, the woman gets a padlock and locks his door before he comes back from work.

The tenant should try by all means to relocate today if he knows that his appeal to the landlady is not yielding. Btw, he can keep some of his properties with friends around including you. He can then manage around. He may consider doing a night shift at work if possible. Landladies are known to be more toxic than landlords.
