Read this to educate yourself on the matter; Setting up of CTC in Rivers State illegal Reports just received by the Rivers State Chapter of All Progressives Congress, APC, allege that the Governor of Rivers State, Barr Nyesom Wike last night appointed and swore in Caretaker Committees for 22 Local Government Councils in Rivers State presumably based on the illegal pronouncements of Federal High Court I sitting in Port Harcourt and presided over by Justice Lambo Akanbi yesterday. The APC would like to unequivocally state that the aforementioned judgment by Justice Akanbi yesterday was illegal and, to that extent, unacceptable to the APC. Our rejection of that illegal judgment is based on facts. Firstly, on the 29th of April, Justice Lambo Akanbi acknowledged that he was on notice that the jurisdiction of his Court was on appeal by Counsel to the RSIEC and Rivers State Government and therefore adjourned the matter before him sine die pending the outcome of the appeal. Consequently, all parties retreated to wait for the decision of the Court of Appeal fixed for 12th October for which all parties are already on hearing notice. Secondly, the application to join by the APC which Justice Akanbi turned down was appealed and that appeal is still pending at the Court of Appeal. Thirdly, there is a subsisting court Order in Suit No: NICN/YEN/26/2015 by the National Industrial Court, Yenagoa preventing the Governor and other parties from undertaking any action to dissolve the 23 Councils and/or remove the Chairmen and Councillors from office and both courts have co-ordinate jurisdiction. Therefore, the APC believes that Justice Akanbi cannot reverse his earlier decision to adjourn sine die and reopen the matter without the Court of Appeal dispensing with the matter of jurisdiction before it and other pending appeals followed by service of hearing notice to all parties in the matter. Based on these facts, the APC rejects the illegal judgment purportedly given yesterday by Justice Akanbi dissolving Local Government Councils in Rivers State. We therefore urge the Council Chairmen, Councillors and members to reject and not to recognise anyone parading himself/herself/themselves as Caretaker Chairmen and members in the 22 Local Government Councils. By this publication, the APC would like to also call on the Inspector-General of Police, the Director-General of the DSS, the Rivers State Commissioner of Police and all other security agencies to be on notice to continue to provide security for the duly elected Chairmen and Councillors as the only legitimate persons in charge of the 23 Local Councils of Rivers State. Wike is going down. An accomplished expert in stealing local govt funds. Even as minister of education Wike was taking N50 million monthly from Obio Akpor LGA. A few Rivers people can say all they like about Buhari and Amaechi but when a fat buffoon is stealing their grand children's money they should open their eyes and resist it. bakila: You are missing it.. The federal high court has jurisdiction on matters involving federal government agencies. The Local government election involves INEC because INEC has to release the voters' register to RSIEC. And the court ordered INEC not to release the register and ordered RSIEC to stand down from conducting the election until the hearing in the case is completed. INEC obeyed the order but RSIEC disobeyed the order to maintain "status quo ante". The Court only cancelled the election on the basis of RSIEC disobeying the court and rightly so. As for the jurisdiction, I'll let the lawyers decide. But in my opinion, Since the Election involves INEC which is a federal government agency, the Federal High Court has jurisdiction 1 Like |
