That would be a question for my non-immigrant colleagues at https://www.nairaland.com/1792662/u.s-non-immigrant-visas-listening .

Hello VO,

Thank you so much for helping on friday..if i had to wait till 16th to interview the anxiety would have been overwhelming ...My worry is i checked my status on CEAC and it is showing ready for interview even after i have interviewd on the 10th and was approved it is getting me worried because of the rescheduling problem i had..i know i cant interview twice so the 16th is not possibel but he status is worrying.

Also i went to the page i scheduled my appointment and it is showing no appointment is currently scheduled and that my passport is still with the US consulate

Dear VO
I hope you still remember me in my previous inquires about DNA. One of my children was able to submit the passports to the embassy on friday, last week. And was given the pick up letter and location circled out in the letter.
Pls. My enquiry is their status has not been updated and also still on Administrative processing. I don't just get it, are they in the queue or what.

They're fine. It just takes a few days for the status to update itself. All is well. It does appear that there will be a holiday at the end of the week, so it's possible that the cases won't be ready for pickup until next Tuesday, though.

No, you're good, I can see your case moving through the queue. Remember, K visas take around two weeks to be ready for pick up.

You previously stated that your father has passed away, and I've already informed you that when a petitioner passes away, the petition is rendered invalid.

If you attempt to conceal this fact during your interview, you will be found permanently ineligible to enter the United States -- not only for material misrepresentation, but for the much more serious infraction of attempted human smuggling. (Your children and spouse are derivatives on your petition -- you are responsible for them.)

And if your petition were still active, which it is not, you would also need to tell us that you are married, or you would again risk becoming permanently ineligible to enter the United States.

Honesty is absolutely the best policy here. Concealment will only damage your chances of going to the United States. Also, it hurts everyone else's chances, because now I'm going to have to remind all my officers that for all F1s, they should carefully double-check whether the petitioner is alive and whether the beneficiary is married.

Hello VO, I eventually wrote to nvc(like u suggested) to make enquiry about the status of my case that has been pending/under review since march 2014 that I wwas being told by the consular that my petition will have to go through further review.
Here is the reply I got

Subject: RE: EAC1390186149 / LGS2014516018 / I129F, PETITION FOR FIANCE(E)

Thank you for your email. Any further inquiries regarding the processing of this case should be directed to DHS/USCIS as the case is considered closed in Lagos. Contact information can be found at www.uscis.gov.

Sincerely,

Please, what should I do.because anytime I check with uscisn they always say its still under review since march 2014. I'm sad.

To quote an earlier response that applies here as well: Please e-mail LagosIV@state.gov and ask what's happening with the case. You won't get a detailed response, but it's likely that the message will be forwarded to me. At that point I'll contact the person handling the case and ask for a status update, which sometimes makes things go slightly faster.[/quote]

USCIS is probably not going to prioritize a review of the case, because it's based on an I-129F petition and those do expire. It may be that your best bet is for the petitioner to file a new petition, if you two have a bona fide relationship.

If your humanitarian reinstatement is granted, you should also inform USCIS that you are married with children so that they can change your visa category to F3. Thanks!

Hmm, the oldest one should have received the letter since she's over 18. IR-2s who enter the U.S. before they turn 18 don't have to pay the fee because they immediately become U.S. citizens (if the petitioner is a biological parent). Here's the USCIS fee letter...

If USCIS doesn't allow humanitarian reinstatement, then your mother can file a new petition for you and your family.

Please apart from copies of documents my fiance applicant filed for our K1 visa and the approval notice, I'm aware he is also expected to send me an original affidavit of support as well as his letter of intent to marry me. Can you kindly tell if there are any other documents original/copy apart from what I listed which he has to send. Thank you and regards.

Re: U.S. Immigration Questions: Ask A U.S. Consular Officer by DV2015APPLICANT: 5:33pm On Jul 14, 2015
Dear VO,
Thank you very much for your reply . KCC scheduled my interview in the first week of July and notified me of the same . When I showed up at the embassy on the interview date , I was informed that the embassy has rescheduled my interview to late August . I tried to explain that my DV case is charged to an African country that has a limit in the DV and that visas might run out by the time my new scheduled interview is due . This explination was of no use and I was asked to leave and come back in August . They asked me to provide the confirmation number of my sent DS -260 , which I did . Two weeks earlier , I submitted all my supporting documents for their review . I also pointed out that the technical issue with the visa system was resolved before my KCC scheduled interview , still no use .
My concern is that by August , the new scheduled interview , visass for DV2015 will be exhausted . Can the post hold the available visa slot till the new rescheduled appointment ? Or as long as they did not interview me at the exact date scheduled by KCC , this visa slot will be available free back to KCC to use for present ongoing interviews?
Your input will be highly appreciated . Thank you in adavance .

Well, then I couldn't find it over there, so I modified my response to include: Anyway, you can apply, yes. Whether you'll be issued depends on whether you can convince the officer that you intend to use the non-immigrant visa for its intended purpose.

Hello VO,

Just wanted to say thanks for the help.

Picked up my passport today with the visa. Without your assistance, I would not have applied. My kids owe you a gummy bear!

Off to the conference next month. Then flying home to see the fam immediately after. Cant wait to surprise them. Told them the application was denied. So they won't see me for a while.

This should be good!

Wish this wasn't so public so I could share pics/video when it happens. Last time I did that, was absolutely hilarious.

VO,
Thanks for all your help so far, we(my wife) finally have an appointment date from NVC for Aug 20th at the Lagos consulate. Our 2nd year marriage anniversary is on Aug 15th, so by the interview date we will be beyond 2 yrs of marriage. what do we need to do to change our case from CR1 to IR1 ? The interview date was schedule today so im pretty sure the case file is yet to arrive at the consulate. Here is our case # for reference(LGS2015579046). I do appreciate all that you do.

Hello VO,
Thanks for a wonderful work here.pls I need some clarity,ma.Early last year myself and wife were interviewed at the consulate for a dv 2014 lottery. My wife being the PA.After a wonderful&interesting interview,to our shock we were denied. But that's in the past now.We are not very clear on the paper given to us by the CO.It reads"this office is unable to issue a visa to you because you have not been able to convince the CO that you have a bonafide spousal relationship.
Now,my Wife will be having our first child anytime soon, and we will want to have a family vacation next year in the US.We want to be sure the meaning of the letter,if we are still qualified for a nonimmigrant visa.We need clarification on the above ,ma.

I'm going to direct you to our website, because there is so much good information there for you. Please see http://nigeria.usembassy.gov/immigrant_visa_forms.html and read the paragraph on fiance visas. In that paragraph there is a link to http://photos.state.gov/libraries/nigeria/487468/pdfs/Interview_Prep_Packet_K1-K3_SEP14.pdf which has all the information you're requesting.
