Supreme Court Upholds Right of Female Child to Inherit Properties in Igboland by Tdarry: 6:11pm On Jul 14, 2015 |
The Supreme Court has voided the Igbo law and custom, which forbid a female from inheriting her late father’s estate, on the grounds that it is discriminatory and conflicts with the provision of the constitution. The court held that the practice conflicted with section 42(1)(a) and (2) of the 1999 Constitution. The judgment was on the appeal marked: SC.224/2004 filed by Mrs. Lois Chituru Ukeje (wife of the late Lazarus Ogbonna Ukeje) and their son, Enyinnaya Lazarus Ukeje against Mrs. Cladys Ada Ukeje (the deceased’s daughter). Cladys had sued the deceased’s wife and son before the Lagos High Court, claiming to be one of the deceased’s children and sought to be included among those to administer their deceased’s father’s estate. The trial court found that he was a daughter to the deceased and that she was qualified to benefit from the estate of their father who died intestate in Lagos in1981. The Court of Appeal, Lagos to which Mrs. Lois Ukeje and Enyinnaya Ukeje appealed, upheld the decision of the trail court, prompting them to appeal to the Supreme Court. In its judgment last Friday, the Supreme Court held that the Court of Appeal, Lagos was right to have voided the Igbo’s native law and custom that disinherit female children. Justice Bode Rhodes-Vivour, who read the lead judgment, held that “no matter the circumstances of the birth of a female child, such a child is entitled to an inheritance from her later father’s estate. “Consequently, the Igbo customary law, which disentitles a female child from partaking in the sharing of her deceased father’s estate is breach of Section 42(1) and (2) of the Constitution, a fundamental rights provision guaranteed to every Nigerian. “The said discriminatory customary law is void as it conflicts with Section 42(1) and (2) of the Constitution. In the light of all that I have been saying, the appeal is dismissed. In the spirit of reconciliation, parties to bear their own costs,” Justice Rhodes-Vivour said. Justices Walter Samuel Nkanu Onnoghen, Claral Bata Ogunbiyi, Kumai Bayang Aka’ahs and John Inyang Okoro, who were part of the panel that heard the appeal, agreed with the lead judgment. http://www.thisdaylive.com/articles/supreme-court-upholds-right-of-female-child-to-inherit-properties-in-igboland/176214/#.VaU5WsreukI.twitter 3 Likes 1 Share |

Go to igbo land and inherit our property now? No be for mouth. Also go to igboland and change our customary law too. no be for mouth. Lazy yorubas dreaming about igbo property. That will not happen as even me will be handing my property to my sons. How do u change that? That issue is a case of customary court and customary law which is the igbo civil law. Thus this decision is ultra virus decision. They need to make sure our Judges are qualified by conducting test/exam. 6 Likes |

See how Igbo culture disregard the value of a woman? So unfortunate and yet they will be the ones to first insult others culture and belief. Thank God for how Islam values the women. 7 Likes |

Great move by the supreme court, but as they say, "old habits die hard". Many grumpy old-fashioned igbomen will vehemently kick against it. To such men I say the world has changed so get with the program. 3 Likes |

Ofeakwu: If it is not igbo house in Lagos, it is igbo traders in Ladipo. Then it is obession to marry from igbo stock. Then it is inheritance. Wat a bunch of failures. I grow to find the comedy in the average yoruba inferiority complex issue hilarious. Let them come first and will my property to my daughter, let us see how possible. 10 Likes |

If we have not been able to remove the Osu Culture, as we desperately want to, it is handing land to women heading out to their husband house that we will do. U are so daft and dat is why yoruba men always sleep with their daughters. Them no dey commot for house. On dat note, am out of this dead thread. 4 Likes 1 Share |

How many "tastes" did you pass? I wonder why you want to check the qualification of the "Juges", when your own qualification is in question. Stolen:I don't know which customary law you're standing on,my part of Igboland the only thing females don't inherit are their father's share of communal lands. And even that is dependent on the man not making any provisions for it,oral or written, before his death.A way of circumventing that situation is for the male progeny of the females to rightly lay claim to such lands. |

It's fair judgement as far as the said properties are in Lagos and not her late fathers village estate which is exclusively reserved for male children. 1 Like 1 Share |

Whether urban or village, unless the father include her. In most cases, the father will not include her. The girls in igbo land inherit their mother property and look to the property in her husband house which they inherit. Igbo dont believe women inherit from father and husband. That will cause a clash. She is suppose to inherit her husband property as it is igbo culture. That is igbo customary law. 6 Likes 2 Shares |
