dammie12: Yes, all cases must wait for their priority dates to become current before they are sent to post. (The only exception is Immediate Relative [IR] cases, which are always automatically current.) |

blinkdr: It depends. It's possible that the field investigation answered all our questions, but it's also possible that we're waiting to hear back from other sources as well. Sorry I can't be more definitive. But, in general, if the field investigation is complete, chances are good that you'll hear from someone very soon. |

winnie123: You'll need to see one of our panel physicians for your medical paperwork. http://photos.state.gov/libraries/nigeria/487468/pdfs/PANELl_Phys_handout_Applicant.pdf has their contact information. Hospital birth certificates aren't acceptable for immigration purposes, generally speaking. We prefer to see birth certificates issued by a government office, which in Nigeria typically means the NPC. |

nazn: Based solely on what you've written here: It sounds like the ineligibility would be under INA 212(a)(6)(C)(i), material misrepresentation. The application for a waiver is the I-601, and in my experience USCIS is typically generous about granting waivers for situations like the one you've described. I can't guarantee that, of course, but it does sound like you have a good chance of success. |

9jaStar: It's a good idea to bring evidence to the interview -- but the most important thing will be the interview itself. As long as your wife can reasonably discuss your relationship, a lack of photographs shouldn't really count against anyone. The fact that you have children, plural, together is pretty good evidence that you two have an ongoing relationship. So, if your photos aren't easily accessible, I wouldn't worry about that too much, personally. |

john2son5: We accept laminated documents. It's true that we prefer to see them unlaminated, but we know that many people choose to laminate them to keep them safe, so it's not a disqualification or a strike against the applicant. |

Dyke004: The wait time for F4s (sibling visas) is running around 12 years. It's fine to use your non-immigrant (tourist) visa while you have an immigrant petition pending -- no problem at all. |

olukenny12: It generally takes only a few weeks for the laboratory to send the results to post. But after that happens, it can take another week or two for post to contact you. Embassies and consulates get a lot of mail, which has to be sorted -- then the cases have to be pulled and matched with the results -- results scanned into the relevant computer records -- cases reviewed by an officer -- and only at that point can the applicants be contacted for follow-up. So, unfortunately, it's not instantaneous. But we know families are eagerly waiting to hear from us, so we do it all as quickly as we can. |

torawno: Sounds legit! And, since your son is now divorced, from our point of view his marital status is "unmarried," just as it was when you filed for him. So it doesn't matter if you didn't keep NVC updated; you can just list him as divorced in the DS-260. It is more difficult to qualify for a non-immigrant visa when there's an immigrant petition pending, but it's not impossible. If he wants to come visit you in the meantime, there's no harm in applying for the non-immigrant visa; the worst thing that can happen is that he'll be refused. But that wouldn't adversely affect his immigrant petition in any way. |

Keyla11: Greetings! Personally I think that "because I was nervous and scared" is a perfect answer in this situation. We know that people want to visit their fiancés, and that they often don't tell us they're engaged because they're afraid they won't get a visa. But that's not the sort of misrepresentation that leads to a permanent ineligibility. Based on what you've written here, I wouldn't worry about being banned. We save bans for violations that are a little more serious than what you describe. |

Dvs. ati fost "derivative applicant" la tatal dumneavoastra... dar doar copii necasatoriti pot fi inclusi ca si solicitanti derivati. Acum ca sunteti casatorita, nu puteti sa primiti viza F33. Tatal dvs. poate sa depuna o petitie de imigrant (I-130) pentru dvs. si familia, dar nu poate s-o faca inainte de a deveni cetetean american. Joboms: Your priority date is the date that your petition was filed with USCIS. But as an IR2, you don't need to worry about your priority date. As soon as your petition is approved and your case is documentarily complete, it will be scheduled for the next available interview. Immediate Relative (IR) cases are always current -- no waiting period. |

IdiAmin1: Yes, that's right, she'll have to wait until her case is current before it can be scheduled for an interview. The good news is that because you're an LPR, the child can be included as a derivative in her case -- you wouldn't need to file a new petition (and wait for it to be approved, etc.). That's one of the few advantages LPRs have over U.S. citizens. 1 Like |

Not sure if you're still answering questions but I need answers so I'll just ask. I am a DV winner from NBO (principal applicant) with a husband and a daughter and a child on the way in November.we're current but was shocked that they found a small scar on the husband's CXR. He has been asked to undergo sputum testing which requires 2 months culture. That means his result will be out around 10th of October 10 days after the 30 September deadline. In such a case will our visas be issued except his or do none of us get it? Or can the Embassy issue the visas and detain all our passports until his TB clearance comes in. In case the sputum comes back positive, they can cancel the visas without prejudice? This is because clearance can only come in 2 weeks after end of dv 2015. |
