To establish a rape case there should be a proof there is no romantic relationship between the people involved. But here there is hanging out and consensual romantic touches at different times before the alleged rape.

And the girl has reached the age of sex consent.

"That the accused penetrated the victim/complainant and that he did it without her consent".

Whether or not she is the accused's girlfriend doesnt matter here (unless they are married couple).

Even if you've had 10 rounds with a girl and she says no to the 11th round it is rape and as long as there is evidence of a struggle, bruising etc the perpetrator will go to jail like any other rapist.
