Dear Officer,
Thanks for the good work here. Last year I secured tourist visas for my family hoping that the quality time together would save our troubled marriage but sadly it still ended in a divorce later in the year. Soon afterwards with the support of her family my wife(ex) travelled to the US with the kids to visit one of her uncles and has refused to return.
I have decided to move on and have even visited to see the kids a few times. On my last visit I met an American lady and a relationship has developed maybe because we had similar marital experiences. She want us to take the relationship further and she's even ready to file a 1-129F petition for me. But I have two concerns
1. Am I eligible for such petition, am I qualified for a K1visa?
2. If I get a K1 and eventually marry my American fiancée, is it possible legally in the US to get custody of my kids back from my ex wife?

I had an interview for immigrant visa August 6 and was told by the interviewer the visa should be ready after five working days.I have been to Lagos twice from Abuja and the visa is not ready. I have purchased ticket for travel based on the information the interviewer gave us after the interview. I rescheduled our flights from last week Sunday to this Friday and the visa is still not out. I'm a bit confused.I have sent an email to support service for them to expedite action to enable us travel on Friday 21st August since we have purchased tickets.
I tried to track our passports but it provided no information on it and the call center number is not going through.
Could you help check if our visas are ready for collection or expedite action on it ?

I already contacted a Nigerian immigration officer who told me that when a new passport is issued to her based on marriage(change of name), it will bear a new number.

Ah, now I understand. Yes, it's okay to use her current passport number. That can be updated later, if need be.

Unfortunately Lagos is no longer my office, so I can't assist. I'm in the U.S., training for my next position. I'll keep answering questions until I arrive at my new job, but I can't check on individual cases these days.

Thanks for your efforts and very useful responses on this thread. I have a b1b2 multiple entry visa that will expire in November which I have not been able to use due to (1) primarily work schedule, (2) was to use it last year but couldn't secure a release because I had just returned from India where I spent over three months on training.

Now I intend to travel to US, before end of this month and return before the expiration of the Visa. Are there any issues or penalties on unused visa I should be concerned of? Kindly advise.

If you are free to marry, and have a bona fide fiance relationship with the petitioner, you would qualify for a K-1 visa. Qualifying and being eligible are two different matters; if you have ever misrepresented yourself to a Consular officer, or if you have a criminal history, you might not be eligible even if you qualify.

The custody question is outside my realm of knowledge; I advise you to contact an attorney. Good luck!

I'm afraid I have no way of knowing or speculating -- there are simply too many possible explanations. The best course of action is to continue asking for updates, every week or so.

Yes, that's a perfectly safe assumption. We always check to be sure that the most current passport number is on file; getting a new passport is a common occurrence.

I miss Nigeria! Nairaland keeps me from getting too homesick. smiley

No, don't worry about the petition. For immigrant visas, the one moment that we absolutely must know the accurate passport number is right before the visa is really, truly being printed. And even then we can fix it if we get it wrong.

I would love to come back. It's a country you fall in love with.

In her current passport which bears her maiden name, her first name appears as her second name and vice versa.

Example: my petition at the NVC bears her name as DOUGLAS Cynthia Blessing while the passport bears DOUGLAS Blessing Cynthia (her first name Cynthia appears as the second name in the old passport). Aside changing her last name to mine, this is another change we intend to do in her new passport. In this situation, would you advise me to go ahead with application?

Dear Visa Officer, I got a mail from the embassy after administrative processing was concluded that i should drop off our international passports on any Monday or Wednesday. does this mean the visa has been approved or what? Also my child passport was 7 month plus before expiration as at when we attended the visa interview, but now the passport is 5 months and some weeks to expire. Should i still drop the passport like that or i should renew it? thank you

I went to the DHL office in VI to collect my passport but was told they didn't have it. the CEAC website says visa ISSUED on the 3rd of September and after the interview the Consular said my passport would be ready for pick up in 2weeks which actually falls on the 2nd of September and all I needed to do was to go pick it up. I sent an email to the LagosIV email on saturday and no response yet just the automated one hmm but then I am wondering if I made a mistake when I went to the DHL office because I signed my details under the Immigrant collection and not NonImmigrant visa collection cos when I think of it K1 falls under both.

Hi i came across this website accidentally and you are doing a good job VO. Now to the question my case was completed at NVC on july and now i am awaiting for an interview date at ABU DHABI embassy.. When ever my wife calls NVC all they say is still trying to get an date from abu dhabi embassy. Do u have any idea how long will it take i know it depends on the embassy but any light would just make us happy..

JUST WANTED TO KNOW HOW THIS SCHEDULE THING WORKS!!

Dear VO,
Please I urgently need your advise. I know you've rated NVC so high especially after your visit to their offices and honestly, they've greatly improved in their communications since March 2015 but I have a big problem now. My Police Certificate was included and also marked on the Document Cover Sheet in the package we sent to them last month. My husband and I cross-checked everything one-by-one to be sure that everything we put in the NVC package was checked on the Document Cover Sheet. Surprisingly, when I called them 2 weeks after, they told me the Police Certificate is missing in the file. Without question, we went ahead and mailed another one and even the FedEx tracker confirmed it was delivered and received by NVC but they're still saying they don't have it. I don't know what else to do. My Category is F2A and my Priority date is current (Dec 8, 2013). Please what do you advise Thanks so much.

I am CR1 and my case was completed since April my husband was able to get NVC two weeks ago and he was told about the technical problem but somebody on this forum said that their case was completed in may 26th and they have already booked them for interview. kindly assist me because I don't know what is happening.

Different cases are affected by our technical problems in different ways. I know it's hard to wait, but please be patient -- NVC will schedule your case for an interview as soon as it can.

Still very worried my V.O ,I'm short of words. kindly assist me.


My V.O I am still worried about my case. Up till now I have not heard from NVC ,even my husband who is the petitioner has written to them but no reply yet. Good day VO.. my husband was denied the i-129 fiancee visa in Lagos because we were presumed "Already Married" by him paying my Dowry. We were then advised by you to file for alien relatives. I have now filed the Form i-130 and I also submitted copy of the denied letter by you. The USCIS have cashed my check for $420 according to my bank statement and I have also received a letter called Form i-797c.. my question now is what is: 201 B INA SPOUSE OF USC.
I do not understand this abbreviations, please help me.

My wife filed form 1-130 for me around November 2014 and last month they sent her an email notifying her that her case has been sent to California for premium processing, it was formerly at Vermont. please I want to know what this means and the consequences of it since she is a legal permanent resident

Ma so I went into the DHL office again today this time around asked under both Immigrant and NonImmigrant still nothing in regards to my passport Ustraveldocs as well keeps saying There is no status update available for this passport but before the CEAC changed to ISSUED it was always showing Passport still with the consulate. Furthermore Ma, I got an email from LagosIV today and the reply I got was they can't track the progress because my case number starts with LND ma I was flabaggastered with the reply for crying out loud my case was transferred and the case number was never changed besides I made sure the email contained the case number correctly which is LND20******** 01LGS... Ma its really sad your not in Nigeria anymore but your assistance would be very much appreciated.

I think you're fine to go ahead with the application now. The changes you describe make sense. Regardless of the names in the petition and documents, the visa will match the name on the passport presented at the interview, so it's really up to you and your wife.

(We'd get worried if none of the names matched at all, but again, what you describe makes sense to me.)

It sounds like the visa has been approved -- otherwise, no reason to ask you for your passport.

Technically, as long as the passport hasn't actually expired, it should be acceptable by the airlines and customs agents. Unfortunately not all airlines abide by that policy. It's probably safest to go ahead and get a new passport for the child. Sorry for the inconvenience...

K1s are handled like immigrant visas. It sounds to me like the collection center ought to have it by now. Have you tried calling them? Their telephone number is on the pick-up letter you were given when your case was approved.

I don't know what Abu Dhabi's staffing / scheduling situation is, but if your case is complete, NVC will schedule you for the next available appointment date. So it shouldn't be long now!

I'd send them the FedEx tracking information. That should help them locate the document. Also, just in case, remind them that you'll bring another police certificate to the interview -- I think that if they really can't find the one you sent, they'll probably go ahead and continue to process the case without it. I could be wrong, but that seems logical to me.

We do conduct interviews throughout the holiday season. NVC should contact you both by e-mail and by regular mail. I don't have a guess as to what's delaying your case, but have you tried contacting them through this site? https://secureforms.travel.state.gov/ask-nvc.php

The petition is being processed in accordance with section 201(b) of the Immigration and Nationality Act ( "INA" ), which defines "immediate relatives" to include: spouses, minor children (under the age of twenty-one), and parents of U.S. citizens (if the citizens are at least 21 years old). USC means "U.S. citizen." Basically, it means your visa category will be IR-1, spouse of a U.S. citizen.
