VisaOfficer: Hello ma'am, trust you are fine and well I just got my Affidavit of support form and Sponsor's U.S tax returns docs, from the USA this week, though I was told to take them to the GSS collection centres since July 18th. I hope there's no time limit as regards submission? |

Titilayodeji13: The interview won't be scheduled until the case is current. Also, it might not be scheduled "immediately" -- it depends how many other current cases are in the pipeline. |

Badgers14: Technically, it's the number of people you file K petitions for that's limited, not the number of petitions you file. So you'll only need a waiver if you've already filed for two other fiance(e)s before this one. IRS transcripts are great! |

bamakoe: By itself, the fact that there's an existing F4 petition shouldn't affect the B1/B2 application, especially if the prior B1/B2 was used correctly. |

Thank you for your prompt response. I received a call from my husband telling me that the NVC have replied his congress man,that what is missing in the documents submitted is my birth certificate. I summited the one I got from National Population Council ( NPC ) which means that one is not acceptable. I was born in the eighties, I went to the hospital where I was born to get it they issued me this one from this council telling me that the don't issue birth certificats again. Kindly advice me on what to do. Remain blessed An NPC birth certificate ought to be acceptable at NVC. Perhaps the one you submitted was somehow misplaced? What exactly did NVC say? They said that the NVC received the following; Passport,Marriage certificate,Financial evidence, Nigerian police report. That they will still need a copy of my birth certificate and after the NVC receives all the required forms and document,they will now schedule me for immigrant visa appointment and forward to Consulate General in Lagos. |

Dear V.O. i gave birth to my baby some months ago in the United states (i am still in US as we speak). My baby has been ill from birth due to bacteria infection. He has been transferred from one hospital to the other due to different reasons. he recently had a surgery due to fluid found in his brain. As at last week, the medical team met with me and discussed his case. The prognosis indicated that he will require medical attention per time especially during this tender age and the team requested he stays for treatment. This medical care will be difficult to come by in my country and the cost to bring him quarterly for follow up will be much for me to afford. My duration of stay in the states expires early November and the hospital is yet to give a definite time of discharging my son (hopefully before the expiration of the duration of stay STAMPED ON MY PASSPORT). However, i wish to stay back for better health care for my son even if i have to go back to my country and apply from there. This brings me to my questions please: 1. am i to apply for extension or change non-immigration sttaus 2. if i am to apply for an extension, do i need to wait for a feedback before i leave the states? or i am eligible to stay back once i put in my application 3. if i am to apply for change non-immigration status, what will the new status & effective date be? 4. is there a difference between change of non-immigration status and requesting for permanent stay / immigration visa 5. is it possible i apply for immigration visa? 6. if i am to apply for immigration visa, which category / visa type am i to apply for? and on which grounds? apologies for the long epistle, i am confused and worried....kindly advise. thank you. |

So my V.O what do you suggest I do ? Because having seen this ; Here is the official guidance for Nigeria: Birth and Death Certificates Generally available, particularly for events occurring after 1970. Registration of births and deaths is compulsory in Lagos. The National Population Commission issues birth certificates for births after 1992. For Lagos records, certified copies of records for dates ending with 1979 can be obtained at the Lagos State Ministry of Health, Old Secretariat, Ikeja, Lagos. For records after 1979, contact the local government that issued the original certificate directly. Most births and deaths outside of Lagos are also registered at the time of the event. Applicants can obtain certified true copies of certificates directly from the local government. The guidance goes on to say "Alternatively, acceptable identity/parentage documents are infant baptismal certificates and hospital or maternity clinic records of birth. Home births are rare in Nigeria and medical records are available in most cases. Affidavits may be acceptable as substitutes for documents for those born outside Lagos prior to 1960 or born in the eastern part of Nigeria in the 1960's at the time of the Biafran War, when presented in combination with convincing secondary evidence of relationship" -- but if someone who should be able to provide a government-issued document shows up and claims that all he has is a hospital certificate, the officer will very likely strongly recommend a DNA test. I get more confused because I was born in the 80's and was wondering if I could go to the local govt of my place of birth and get a birth certificate with my own affidavit to back it up or should I still go ahead and resubmit the NPC copy ? VisaOfficer: Thank you. We finally submitted at the GSS centre in Isolo yesterday, but we were told to go the embassy for the VISA in the next 7-10 working days. I initially thought the VISA would be dropped off at the collection centre, was surprised when we were told we have to go the embassy again. *Scared* |

Dear V O Please we are using a surrogate because we have been trying to have a baby for about 15 year. We will like the lady to give birth in Atlanta and we have already contacted a Lawyer in Atlanta who is helping us with the legal part. We will like to know the procedure of obtaining a visa for the surrogate. All Doctor and Hospital bills have been paid and we also have a receipt of paid accommodation. We also have the bank statement that can show that we can afford it.Myself and my wife have US visa as we have been to USA couple of times. We only need a visa for the surrogate. We will appreciate it if you can help as we will like to know if we can actual apply for a visa for the surrogate and how to go about it. |

They quoted something from a USCIS gazette about births before NPC, they expect a birth certificate from the local council, or Lagos Birth Registry, if born in Lagos. A few people have experienced this issue also. I called to find out exactly what they want and they specified that they require the letter of certification that one's birth was registered with the local government, along with an affidavit from a close relative, preferably the mother. 3 Likes |

Goodmorning VO, I am aware you dont respond much to question for NVC but I really want know, if I need to write my name or case number at the back of the passport photograph am sending to NVC or leave it blank? This information is really delaying me. My wife is filing I-130 for me and we are about to send documents required to NVC. Anybody in the house can also respond to this, if the person is very sure of what I should do. Thanks all. |

Hello VO, thanks for a job well done here. Here is my question I have applied for Tourist visa to visit a friend (My mums friend; i told the consular during the interviews). I got denied 4 times between July 2010 and january 2014)… I was married (traditional wedding) through out these times. The marriage ended by divorce in Dec 2014. I started a new relationship with an old friend (US citizen) in February 2015, she came to visit me in August, she is about filling d K1 petition. I went to my DS 160 forms used during the tourist visa applications and realized in the spouse name section i stated her names as (My last name, her first name & her middle name)… On the divorce decree, her name is stated as (her maiden name, her first name & middle name) Can this affect the petition though the first name & middle name & date of birth is d same.. do you think the person handling the petition and consular for the K1 visa will understand d divorce decree is still d same person in my previous applications or i have to write a note stating it Do you think the time frame for wanting to get married is too short since i got divorced in dec 2014 and my fiancee wants to file a fiancé petition in september 2015 Can my previous Tourist visa denials affect my new K 1 application? Should my interview date of 23rd September be cancelled by the embassy due to public holiday (which they are yet to do as of today), what should I do? How do I rescheduled for an emergency interview? According to our records, he needs to return with the following Month Day Year by Time New medical report New police certificate International passport Resubmit DS-260 application Thank you for your email. Another Email stated this According to our records, what is expected of Mr Name for now is to submit his international passport, valid medical and police certificates & and as well resubmit the DS260 and have his oath retaken. He has been scheduled to return on Month Year at Time !!! What likely of been expectin? Prepared another interview after field investigator? Need Responce pls |

rushchild: You should contact USCIS and ask them what to do. There is no way to apply for an immigrant visa unless someone files a petition on your behalf, which is a lengthy process that takes months or years. Please see http://www.uscis.gov/about-us/contact-us . |

lindababy2u: As long as it's a government-issued birth certificate (the NPC certificate or the certificate from the local government office that registered the birth), you'll be fine. I know it says we accept hospital certificates, but we only do so in exceptional circumstances. If you were born in the 1980s, we'd expect you to submit a government-issued birth certificate. 1 Like |
