I just got my Affidavit of support form and Sponsor's U.S tax returns docs, from the USA this week, though I was told to take them to the GSS collection centres since July 18th.
I hope there's no time limit as regards submission?

My V.O I am still worried about my case. Up till now I have not heard from NVC ,even my husband who is the petitioner has written to them but no reply yet. I believe if there is any problem they could have written to us giving us situation report. We do conduct interviews throughout the holiday season. NVC should contact you both by e-mail and by regular mail. I don't have a guess as to what's delaying your case, but have you tried contacting them through this site? https://secureforms.travel.state.gov/ask-nvc.php

Thank you for your prompt response. I received a call from my husband telling me that the NVC have replied his congress man,that what is missing in the documents submitted is my birth certificate. I summited the one I got from National Population Council ( NPC ) which means that one is not acceptable. I was born in the eighties, I went to the hospital where I was born to get it they issued me this one from this council telling me that the don't issue birth certificats again. Kindly advice me on what to do. Remain blessed

An NPC birth certificate ought to be acceptable at NVC. Perhaps the one you submitted was somehow misplaced? What exactly did NVC say?

The interview won't be scheduled until the case is current. Also, it might not be scheduled "immediately" -- it depends how many other current cases are in the pipeline.

I have few quick questions.. I previously filed K1 but later it was withdrawn by me. My question is, am planning on filing for the same beneficiary do i need to request for a waiver on filing limitations?
I tried contacting USCIS customer service but they were not sure. Could you please assist?

Also in filing out the affidavit of support,instead of attaching my 1040 tax forms, would IRS tax transcripts suffice?

Technically, it's the number of people you file K petitions for that's limited, not the number of petitions you file. So you'll only need a waiver if you've already filed for two other fiance(e)s before this one.

For someone that has a pending F4 petition, would it affect the spouse renewing his/her B1/B2 visa since the F4 petition would include the family

By itself, the fact that there's an existing F4 petition shouldn't affect the B1/B2 application, especially if the prior B1/B2 was used correctly.

My question does not pertain to an immigrant visa, but I felt I should ask anyway. I applied for, and was granted an F-1 visa on Tuesday, the 8th of September. I was told at the interview that my visa would be ready by today, the 11th. However, until now, at 2:15 pm, I have not gotten an email stating my visa was ready for pickup. I called the visa center, and they said they had no specific timeline, but I should watch my email. In my desperation, I called the embassy themselves and they stated that they shut down early for the day as it is 9/11. Madam, I am desperate because my classes have begun already, and I am already late. I was given a grace period with which to sort these issues out, but even that time is running thin. If there is anything that can be done, your help would be greatly appreciated.

If there's no action on a case for 12 months, the case may be closed. It sounds like you're well within the time limit.

It sounds like they didn't receive (or like they misplaced) your NPC birth certificate, not like they wouldn't accept the one you sent. I'd send another NPC certificate. Sorry for the delay..

i gave birth to my baby some months ago in the United states (i am still in US as we speak). My baby has been ill from birth due to bacteria infection. He has been transferred from one hospital to the other due to different reasons. he recently had a surgery due to fluid found in his brain. As at last week, the medical team met with me and discussed his case. The prognosis indicated that he will require medical attention per time especially during this tender age and the team requested he stays for treatment. This medical care will be difficult to come by in my country and the cost to bring him quarterly for follow up will be much for me to afford. My duration of stay in the states expires early November and the hospital is yet to give a definite time of discharging my son (hopefully before the expiration of the duration of stay STAMPED ON MY PASSPORT). However, i wish to stay back for better health care for my son even if i have to go back to my country and apply from there. This brings me to my questions please:
1. am i to apply for extension or change non-immigration sttaus
2. if i am to apply for an extension, do i need to wait for a feedback before i leave the states? or i am eligible to stay back once i put in my application
3. if i am to apply for change non-immigration status, what will the new status & effective date be?
4. is there a difference between change of non-immigration status and requesting for permanent stay / immigration visa
5. is it possible i apply for immigration visa?
6. if i am to apply for immigration visa, which category / visa type am i to apply for? and on which grounds?

apologies for the long epistle, i am confused and worried....kindly advise. thank you.

Birth and Death Certificates

Generally available, particularly for events occurring after 1970. Registration of births and deaths is compulsory in Lagos. The National Population Commission issues birth certificates for births after 1992.

For Lagos records, certified copies of records for dates ending with 1979 can be obtained at the Lagos State Ministry of Health, Old Secretariat, Ikeja, Lagos. For records after 1979, contact the local government that issued the original certificate directly. Most births and deaths outside of Lagos are also registered at the time of the event. Applicants can obtain certified true copies of certificates directly from the local government.

The guidance goes on to say "Alternatively, acceptable identity/parentage documents are infant baptismal certificates and hospital or maternity clinic records of birth. Home births are rare in Nigeria and medical records are available in most cases. Affidavits may be acceptable as substitutes for documents for those born outside Lagos prior to 1960 or born in the eastern part of Nigeria in the 1960's at the time of the Biafran War, when presented in combination with convincing secondary evidence of relationship" -- but if someone who should be able to provide a government-issued document shows up and claims that all he has is a hospital certificate, the officer will very likely strongly recommend a DNA test.
I get more confused because I was born in the 80's and was wondering if I could go to the local govt of my place of birth and get a birth certificate with my own affidavit to back it up or should I still go ahead and resubmit the NPC copy ? Please advice me for I don't know what to do again.

Thank you. We finally submitted at the GSS centre in Isolo yesterday, but we were told to go the embassy for the VISA in the next 7-10 working days. I initially thought the VISA would be dropped off at the collection centre, was surprised when we were told we have to go the embassy again.

We will like the lady to give birth in Atlanta and we have already contacted a Lawyer in Atlanta who is helping us with the legal part.
We will like to know the procedure of obtaining a visa for the surrogate.
All Doctor and Hospital bills have been paid and we also have a receipt of paid accommodation. We also have the bank statement that can show that we can afford it.Myself and my wife have US visa as we have been to USA couple of times. We only need a visa for the surrogate.
We will appreciate it if you can help as we will like to know if we can actual apply for a visa for the surrogate and how to go about it.

Yes, they accepted it, along with the sworn affidavit by my mom. I suggest you call and speak with them to know exactly what applies to you.

I am aware you dont respond much to question for NVC but I really want know, if I need to write my name or case number at  the back of the passport photograph am sending to NVC or leave it blank?
This information is really delaying me.
My wife is filing I-130 for me and we are about to send documents required to NVC.

Hello VO, thanks for a job well done here. Here is my question
I have applied for Tourist visa to visit a friend (My mums friend; i told the consular during the interviews). I got denied 4 times between July 2010 and january 2014)… I was married (traditional wedding) through out these times. The marriage ended by divorce in Dec 2014.

I started a new relationship with an old friend (US citizen) in February 2015, she came to visit me in August, she is about filling d K1 petition.

I went to my DS 160 forms used during the tourist visa applications and realized in the spouse name section i stated her names as (My last name, her first name & her middle name)…
On the divorce decree, her name is stated as (her maiden name, her first name & middle name)
Can this affect the petition though the first name & middle name & date of birth is d same.. do you think the person handling the petition and consular for the K1 visa will understand d divorce decree is still d same person in my previous applications or i have to write a note stating it
Do you think the time frame for wanting to get married is too short since i got divorced in dec 2014 and my fiancee wants to file a fiancé petition in september 2015
Can my previous Tourist visa denials affect my new K 1 application?

You should contact USCIS and ask them what to do. There is no way to apply for an immigrant visa unless someone files a petition on your behalf, which is a lengthy process that takes months or years. Please see http://www.uscis.gov/about-us/contact-us .

As long as it's a government-issued birth certificate (the NPC certificate or the certificate from the local government office that registered the birth), you'll be fine. I know it says we accept hospital certificates, but we only do so in exceptional circumstances. If you were born in the 1980s, we'd expect you to submit a government-issued birth certificate.
