Petition Tribunal is currently
reading its judgement in the
petition filed by the APC
candidate Dakuku Peterside
against the election of
Governor Nyesom Wike.
PREMIUM TIMES brings you
the live updates from the
judgement of the three-
member panel which is
sitting in Abuja for security
reasons.
10:41 The presiding judge
reviewed the witnesses and
stated that Peterside/APC
called 56 witnesses and of the
respondents: INEC-16;
Wike-24; PDP-none. The
panel states that the
petitioners submitted three
issues for determination.
10:46 INEC argued that the
petitioners failed to prove
their case polling unit by
polling unit in line with
Supreme Court earlier
decisions.According to the
panel, Governor Wike’s final
written address on the
petition is dated October 14.
10:55 The Tribunal is now
reviewing Mr. Wike’s second
major argument. Governor
Wike’s first major argument
is that most of the petitioners’
witnesses gave hearsay
evidence, according to the
tribunal. Governor Wike’s
other major arguments,
according to the tribunal,
include: Petitioners are
required to prove polling unit
by polling unit but they only
called few polling unit agents.
Non-usage of card reader
cannot be grounds for
nullifying election.
Mr. Wike also argued that the
election was free and fair
and he was duly returned
governor. He asked the
tribunal to strike out the
petition.
The tribunal states that PDP’s
final address was on October
16.
11:02 The PDP argued that the
Petitioners leveled allegations of crime
against the military which was not
joined as a party. The PDP also argued
that non-usage of card reader cannot be
grounds of nullification of election. PDP
thus argued that the petitioners failed to
prove their case and case should be
struck out.
11:18 The petitioner, Mr. Peterside,
argued that the card reader machine was
made mandatory by INEC’s guideline
and has the backing of the Electoral Act.
11:31 The tribunal adopts only one issue
for determination – whether or not the
petitioners have proved their case.
11:40 The Tribunal dismisses preliminary
issues concerning the competence of the
tribunal raised by the respondents. It is
now dwelling on its sole issue for

Truth be told, Rivers election was a sham though I don't see Dakuku winning the re-run; Wike is more popular and likely to win the re-run but this time with a lower margin than the previous election. It is a WinWin for democracy.

That Akwa Ibom submission is at variance with the submission of the River state court of Appeal.


#AkwaIbom: The card reader was not contemplated by section 49 of the Act on accreditation.
#AkwaIbom: That INEC press release cannot override section 41 of the Electoral Act on accreditation.

#AkwaIbom: but the silly Akwa Ibom tribunal failed to realise that it is the same Electoral Act that gives INEC the authority to conduct a free and fair election. Even though the Electoral Act did not expressly permit the use of Card readers/bar the use of card readers, it has given INEC the mandate to conduct the election and INEC can do so within the ambits of the law!

#AkwaIbom: That Akwa Ibom Election tribunal must be revisited and the records set straight.


If APC appropriately appeals that Akwa Ibom judgement, they should be able to get a full re-run in all the Local Governments. This does not mean APC stands a chance at all in the election, but things most be done properly!

Those two elections (Akwa Ibom and Rivers) were a total sham and an embarrasment to democratic process.

What marvels me is that why rig an election that you most likely will win??

This is a victory for democracy. The age and time of senseless rigging is over! If you dont win clearly, then you stand a chance to rerun.

In the future sef, there should be a law barring those that engages in manipulations from contesting reruns.

Simple answer. To show your opponent that he's no match for you on the field and in the rigging room. To pass a silly message across to your opponent

Rivers state is overwhelmingly a PDP state. In short Wike has won more people to his side in this few months as governor. Even if a free and fair election is conducted 10 times in Rivers state, PDP will still flaw APC. Dakuku will be shamed again. Mark my words! angry
