LagosNIV: Since it would be found out that i used fraudulent documents/passport in the past, no need wasting my time and money going for medical/police report since you will still deny the immigrant visa. |

Hello everyone, I have a very big question here. My parent were visiting me in the US this weekend but they were sent back to Nigeria because the immigration officer called my school to know if I'm still a student at the Sch which unfortunately I'm not in Sch this semester. This is the last thing I expected them to do, but however it has happen and I'm looking for a solution for my parent to be here by nxt year. Already, I just got married to an akata girl and I haven't just put my paperwork in. My question here is that will it be possible for them to visit me again at any point in time when I'm a greencard holder, or when I will graduating? I know I messed up I will really appreciate your help. |

musabones: This is a non-immigrant visa question but I will answer it anyways - it is unlikely that your parents will be issued non-immigrant visas. |

lindaayim: As has been previously stated in this very thread, travelling to the U.S. on a B1/B2 tourist visa with the intention to adjust status is an abuse of the system. The proper way to submit the immigrant visa petition would be to send it in to USCIS; once the information is processed he will be called in for an interview. I cannot advise you on whether or not investing in an immigration lawyer is a wise decision. |

myself and my wife went for an interview in 2011 and we were both denied on misrepresentation of marriage and alien smuggling for false claim of marriage. in a reality we were both genuine husband and wife blessed with 3 years old boy now. what happen during our interview was that we were asked several question and one individual among our several photo was misnamed by us different. and as a matter of fact this was due to tension and the lost of a 2 month baby then that we submitted our application alongside with our that we could not attend interview with owing to its demise. this made my wife to be devastated and it happen 9days before our interview and we were told not to change interview date. We were so jinxed to be classified among those with fraud intention which we are not part of. since that time we have been living happily with our baby boy. pls, if we apply for a visa, and the consular found out that we are both genuine husband and wife , even with the DNA proof of our baby and other evidences against a formal allegations on us, is there any correction the embassy can make on our case. knowingful that we were misjudged in our last interview every of our document is genuine and correct But we were alleged of not be husband and wife which we are. |

Thank you LagosNIV for re-creating this thread. I had appeared for K1 visa interview in September, on 18th to be precise, and I was denied under 221g. The VO had cited my misrepresentation on a previous B1 the year before ,as creating doubt in my relationship with my fiance. I did not get a visa on that B1 though, but I have a genuine relationship with my fiance, and I really want to meet her and her son so we can start our lives together. We all have a bond already, but mistakes in the past have a way of catching up. but we are really genuine. I had also recanted the misrep on my DS 160 before I appeared at the interview. At the interview, I also recanted orally under no pressure. The VO was very nice and stated that because I was forthcoming, that he was going to put some good notes on my file and suggested two ways for me to get the visa, and also stated that he was just delaying the inevitable. two ways he suggested were i either refile on a K1 or get married. My fiance and I thinks refiling the K1 will show depth of our relationship versus running off to marry just to see how to beat the immigration process, so we are refiling. I have discussed with people, friends, who said that the VO just got rid of me by being nice, and telling me he will give me good notes on my file, I do not believe because he was very sincere, I was the only one who saw him talk to me, no one else was there and I saw he was very sincere with me. My question, is is it possible for a VO to just lie to get rid of someone even when he does not have a reason to do that ? second question, how will I get into the building without a medical because my medical was taken from me in september, during the interview? efosa010: If your initial petition has been recommended for revocation then you should just wait for USCIS to contact your fiancé. She will have a chance to respond to all of the points and then USCIS will determine whether or not the revocation will stand. With regards to your allegations about the VO 'lying' to you, the only information you have provided is your interpretation of what occurred. Based on the facts it does not appear that anything illegal transpired. |

Thank you sir for your prompt response. I wanted to know how to get into the embassy without a medical since the other one was taken at the embassy on my last appointment? Again, I did not intend to say the VO lied to me, my "english " must have come out badly. I am sorry about that. I meant to say, in my earlier post that I have absolute confidence in the VO and respects his decision as final, versus what people who have not been at the embassy are wanting me to believe. Hello sir, how's bn your day ? Pls my sister had her k1 interview in Lagos on 15th of October and was approved she was told her visa would be ready in 2 weeks, she was at the collection center on the 30th of October but was told it's not ready tho her status on ceac website shows "ready" and was last updated on the 27th of October and each time she tries to track her passport it says" there is currently no status available for the passport number" although for 2weeks it was showing " passport still at us embassy" the question is when is the passport most likely be ready for pick up? Must the status on ceac website show "issued" before she can go to the dhl again? Pls help. Tnx |

Hello VO. My passport is to expire by June 2016 while my interview date is December 15, 2015 for a 4 year PhD program Student Visa. Do you foresee any problem with my passport as Nigeria Immigration Office is not ready to renew my passport until it is within 6 months of expiration? |

Good afternoon Lagos NIV... I could use a little clarification here.... I previously filed I-129F but we had some issues and i withdrew the petition... But we got back together again... I remember before i filed for the second time, I called USCIS to check if i needed a waiver but reps i spoke to dont seem to understand what the waiver was.... One of them asked me after placing me on hold for like 45 mins ..if i met my fiancee through a marriage broker and i said no and he was like then you don't need a waiver on filing limitations.. Also I asked the Former VO and she said Since thats my 2nd time for the same person, I don't need one.. Now I filed a new I129F and USCIS sent me a RFE requesting that I submit a waiver... Am kinda confused.... I have sent in the waiver though but i just want to understand the process a little more.. Could you please assist? Thank you very much. |

teetee12: The Diversity Visa is only valid for the fiscal year in which you've won. At this point, unless you have some other qualifying relationship, you will remain ineligible. |

Badgers14: I can't really help you with the USCIS side of the equation. If that is what they are asking for before they move forward then I would just go through the waiver process - or let them know that you have a waiver already. The VOs don't see a petition until it has been approved by USCIS. |
