But the Senate president told the tribunal that he was trained in the medical line and not in law, and that it would be unfair to ask him to defend himself in a terrain he knew nothing about.

As much as l wish that Sakari be tried & sentenced if found guilty, l wish to say that their should be fair hearing & respect to the rule of law. If CCT can adjorned bcs of an appeal in the appelate court, wht stops him to adjorn whn the matter was taken to supreme court. CCT shouldn't have proceded on trial of the matter brought before supreme court. Moreso why is CCT in a hurry?. l think Saraki's legal team are right on this. CCT chairman should watch it so that he will not be seen to be bias the matter. |

He is wrongly accussed? really and his only defense is to prevent the trial from taking place in order to prove his innocence, who would think so many Nigerians are bereft of logic. |

"law and practice so as far as am concerned there is no Tradition in Law, Law is Law because it has always been their crook tradition does not make it a Law....Here is the Law CCT Chairman base his ruling.........The CCT chairman did not give his ruling from abstraction. He relied on an updated Nigerian law which says such trial can go on! Just that if a judgement emanates from it, it will not be executed until the higher court dispense the issues before it. This Mr. Chukwudi419 is always vomiting sentimental and baseless argument even on issues he lacks understanding. No matter how wrong or otherwise a presiding judge or chairman is, it is the training of a lawyer never to walk out. That's is gross contempt and now they are threatening the Chairman. We have many fools in nairaland dt knows little or nothing about Judicial system including chukwudi44. Those Saraki's lawyers think they are smart, they hv first committed handball by going to federal high court seeking 4 injunction which CCT stroked out. In judicial system, CCT has her own independency even as d case is in apex court, justice Umar can go ahead with his ruling since is a criminal proceeding.... let's not 4get Bola Tinuba of 26/10/2011.... |

Why do you see rubbish and you want to paint it good. Everything is a script! They want to frustrate the Tribunal and they don't want hearing/proceeding to begin. They don't want witnesses to start coming for evidences. It s a shame. My worry isn't the show of shame yesterday, which in itself is a contempt of court. My worry is about masses like you and me, who wants these to continue. Do you think a poor man facing the law in court will have the luxury of nonsense they displayed yesterday? These lawyers have seen Democracy vs Dictatorship in the System. In a three "Power Parallel" Presidential system such as ours, The Executives are very likely to VICTIMISE others in the system. The NASS may INTIMIDATE others in the system and the Judiciary may be PARTIAL. While they are designed to compliment one another and never to impede one another's work, may our God of Nigeria protect Nigerians from bokoharam, biafra, Fulani herdsmen and other jinggoes and isotopes. |

chukwudi44:What makes them think that supreme court will over rule the Appeal Court earlier decision? The job of the appeal court and supreme court is to hear an appeal over the judgment emanating from first instance courts. But corrupt Nigeria lawyers are desperate to turn them into tools to stop a judicial process. The two appellant courts has rather become the first court of instance rather than being the last. If the political lawyers refused to defend their client, the judge can assign Saraki any willing counsel from the state counsels or let him defend himself if he so wished. He cannot claim that he wasn't privy to the walkout but the judge refused to be bullied or fooled. This seems to be their last card in the delaying tactics game from day one. |

favourlove1: Mr, this line of argument of yours does not hold water.A lot of us are not conversant with the applicable law in this regard. The CCT chairman new that all actions taken so far are meant to delay trial or worse yet abort the trial. He based his decision on the relevant law currently applicable in situation like this were the intention is to delay trial.Yes before now, it was the 'tradition' for the lower court to suspend trial when there is an appeal in a higher court.But that is no longer the way it goes.The defense lawyer knows this.However he has a duty to defend his client so any means within his reach would be used, including whipping up public in support of his client and against the chairman through a staged walk out. If a case is instituted against anyone, it raises suspicion of guilt for the person to seek protection not to be tried at all and most surprising when we, the general public seem to be supporting that position. |

Samandgrace:What is fair hearing, in a hurry, allowing a deliberate attempt not only to delay the trial but to find a way of sculttling it? Court is about facts, figures and the law. Not sentiment. The judge quoted an Act of the law he based his decision on. The so called lawyers should have quoted what law they have based their arguments on? They claimed tradition. Whose tradition? Where was this tradition when they were at Appeal court earlier? It was a tradition, that judicial corruption has built over the years above proper judicial process they are gunning for. Its the job of the Supreme Court to have called for a stay of execution if they deem it necessary but they didn't and the corrupt lawyers threw a tantrum because they were not allowed to delay the proceedings. |

chukwudi44:My friend you are not a lawyer! There is actually something called time wasting, and yes a lower court can continue side by side with a higher court. E.g Wike vs electoral tribunal. Wike took the case of jurisdiction of the electoral tribunal sitting in abuja to the Supreme Court and not only did the tribunal continue, it also gave judgment before the Supreme Court did. |

Samandgrace: The CCT adjourned because the date of ruling was set and was close. Now, the appeal has not even been heard by the supreme court. If you think every appeal should stall the CCT, then the case may last till 2030 when probably Saraki and his team would have exhausted all forms of appeal and retired from active politics. Nigerians have always complained that the judiciary is slow, now they try to move faster people like you say, "why the hurry". 1 Like |
