MTN Group Ltd in South Africa is making some moves to get the $5.2 billion fine imposed by the Nigerian Communications Commission (NCC) reduced by as much as 80 per cent and it is considering borrowing money from banks to help settle the penalty, should its request for fine reduction sail through.

Bloomberg reported that the head of research of Renaissance Capital (RenCap) in Nigeria, Mr. Adesoji Solanke, shared a note with clients on Wednesday, where he said: “MTN is pushing to reduce the fine by 60 per cent to 80 per cent.”

According to Bloomberg, a second lender said: “MTN is considering borrowing from banks, as it recently checked what the banks’ lending capacity to it is.”

It however quoted MTN’s Group spokesman, Chris Maroleng, as saying: “We don’t comment on banking matters, and banking regulators in Nigeria are best placed to provide context on these matters.”

It also quoted the Director of Public Affairs of NCC, Mr. Tony Ojobo, as saying: “I don’t have that information.”

MTN has until November 16, 2015, to pay the penalty, which relates to the timing of the disconnection of 5.1 million subscribers and is based on a charge of N200,000 for each unregistered customer.

Should the telecom giant’s request be granted, the fine may be reduced by as much as $4.16 billion, which represents 80 per cent of the fine. That will leave a balance of $1.04 billion.
Meanwhile, the NCC has confirmed that it had received an apology letter from MTN, asking for leniency over the fine. NCC said it was not in doubt whether MTN would pay the fine, since it has to do with the law, which MTN was part of the signatories.

NCC however said that having received the apology letter, it would proceed to discuss it with the Chief of Staff to President Muhammadu Buhari, where a decision on the matter would be taken.

“We have received the apology letter from MTN, but it is not in our position to take decision on it, since the matter is being handled by the Presidency,” a source from NCC told THISDAY.

In a related development, the South African lawmakers are planning to summon MTN Group Ltd. officials to explain why MTN Nigeria was fined $5.2 billion by Nigeria’s telecoms industry regulator for failing to disconnect customers with unregistered SIM cards.

According to Bloomberg, the Chairwoman of South African Parliament’s telecommunications committee, Nkhensani Kubayi, said on phone from Cape Town yesterday that “the fine is a worrying issue” that demands explanation from MTN Group.

The panel also intends summoning the South African industry regulator to determine whether MTN is compliant with local rules, with hearings likely to take place next year, she said, according to Bloomberg.

Nigeria is Johannesburg-based MTN’s biggest market with 62 million clients as of September this year.

MTN is being advised by some unidentified banks as the company pleads its case with the regulator, according to Solanke. A decision to borrow would be one of financial management rather than an indication of stress, he said

However, MTN shares gained as much as 4.1 per cent and traded 3.5 per cent higher at 160.89 rand yesterday in Johannesburg. The stock is down 27 per cent this year, valuing the company at 297 billion rand ($21.5 billion)

Fuuktard nation!

Fuuktard people!

Fuuktard youths!

Fuuktard future!

Look at all the cretins talking from their moronic arsse where their brain is located.

Cretins that cannot understand the implications of actions. All they know is "Us vs Them".

Moronic fuuktards!

A country that is currently broke and in dire need of investments to create jobs, in environments where these same cretins don't have jobs or are underemployed, has some fuuktards in NCC helping them to destroy their future.

I have never been so shocked in my life when I heard the news of the fine.

How can fuuktards fine a company about 20% of its total market value?

How can fuuktards fine a company about 75% of its total annual revenue in Nigeria?

How can fuuktards fine a company more than 3 years of its annual profits in Nigeria?

All for an offence that was not even market manipulation?

That is not heard off.

How is that going to be encouraging to foreign countries that want to enter Nigeria?

To these NCC fuuktards, a fine is suppose to completely cripple a company?

This is a company that is one of the largest foreign direct investors in Nigeria helping to diversify the economy. The company that has been the lead case study in showing that the shithole called Nigeria, despite all the bad portrayals it has, is a place you can invest profitable outside of the Oil & Gas sector. If they are being treated like this, how can it encourage others to invest and create jobs?

This fine is going to already lead to thousands of job cuts and more people (previously well paid) on the streets looking for job.

The Nigerian CEO of MTN Nigeria and the Corporate Services Executive are goners for sure. No Doubt! They are going to be sacked after this is settled.

When foreigners don't invest. You will have more Nigerian-owned companies where Baba Salas and products of a failed education system treat people like animals and cannot apply best practice.

Unlike Nigerian banks, do the likes of Stanbic IBTC, Citibank and Standard Chartered send young girls out as ashawos to attract deposit calling them marketers? And the CEOs of these Nigerian banks are calling themselves "Bankers". Awon fuuktards!

Do foreign lecturers behave like Nigerian lecturers? Another example of what happens when you have Nigerians running things unchallenged by foreign competitors.

Fuuktard people!

The directors of NCC need to be sacked ASAP!

The fine should never have exceeded more than 50% of annual profits (EBIT).

GEJ has finished destroying the economy, public sector salaries cannot be paid, the country is broke and yet you are rejoicing that cretins in the NCC are chasing investors away.

My brother why are you so uninformed?

Go and check the fines imposed by US authorities to companies convicted of paying bribes in Nigeria inlcuding Siemens, Tecnip, Halliburton.

Tecnip a french company payed to US government 240 million Euro fine for paying bribes to secure NLNG project, the amount is 200% the profits it made over the years it ran the project. And this in not for a crime that has direct security implication to USA.

I can't understand how Nigerians so undervalue ourselves that we are quick to join the side of law breakers.
Many lives have been lost due to MTN's refusal to disconnect those lines, the Falae family and many others had to pay kidnappers to save the life of their patron due to this infraction. Yet some Nigerian defend them for violating our rules, talk of very low self esteem.

Go to South Africa and violate their laws and see how many SA citizens will call for you to freed from paying for your crimes.

You can read and write yet you think like an illiterate. What has market value got to do with a crime? which law or convention states that a company can't be fined entirety of it's market value? Is there a universal law on fines from country to country? The people getting 2 years jail term maximum for stealing billions in Nigeria will get death penalty in China for the same offence, does that make either verdict invalid?

The gravity of a crime or infraction varies from one jurisdiction to another and it will do you well to educate yourself about the laws governing whatever space you operate in. Was MTN ignorant of the $1000 fine in the NCC rules for each unregistered SIM? Yet they kept 5 million illegal lines connected to be used for nefarious activities. Can the fine at any amount bring back any life lost due to this infraction?

Enron committed infractions in USA that necessitated the complete winding up and disbandment of the company so what are you saying. They probably would have gotten away with what ever they did in another country or pay a token fine if convicted. Even the companies fined heavily for paying bribes in Nigeria are still operating freely and some cases got slap on the wrist using Nigerian laws

Even the SA government intervened by asking SA companies to comply with the laws of the climes where they operate yet some Nigerians with low self-esteem so used to lawlessness are complaining even louder than the accused.

Not even MTN is saying it did the right thing or did not incur the hefty fine, but are only appealing for a review to help their bottom line
