Hello VO, My interview is in 2weeks for i-130. My wife is a USC, we did a court wedding and traditional engagement. We filed our case with pictures from this 2 events, but I just paid my wife's pride price last week and we did a very big ceremony. My question is, will the pictures from the last week traditional pride price ceremony complicate issues for us since we didn't file our case with it or will it make it more convincing that we are truly married? |

@LagosNIV I have a pending immigrant visa application in the EB3 category. My priority date is current in the visa bulletin for December 2015 and my documents are currently being reviewed at NVC. I assume that if there are no issues in the process (in form of a retrogression or checklist), my exit interview will come up within the 1st quarter of 2016. While submitting my civil documents to NVC, I realized that the police character certificate I obtained has a 3-month validity and will expire in December. Will I be required to present another PCC at the time of my interview? Thanks |

Dear VO, I am in the process of filing a K1-visa petition and was hoping you could answer the following questions: 1)Is one visit enough? I know USCIS says you need to have met at least ONCE, but since Nigeria is considered a "high-fraud" country, it may have a higher standard. 2) The Dept. of State website doesn't list documents needed to provide proof of bonafide relationship specific to a fiance visa. It only lists those for marriage, child, sibling, and parent. For evidence of ongoing communication, how detailed do call logs/chats need to be. How frequent (every day, once a month, couple a month?) Do you need content of chats or just evidence of contact? I'm concerned that I do not have any letters or emails. Are phone bills that show frequent and lengthy calls using a Nigerian long-distance calling card acceptable? This coupled with screenshots of skype video calling history? 3) Does USCIS send initial petition package to US Consular/NVC for use during interview? If so, will beneficiary be allowed to present additional evidence of ongoing relationship at interview (i.e. call logs and photos that took place after the original petition was submitted). I heard that some CO's make their decisions prior to the interview (solely based on initial petition package) and do not allow the beneficiary to present additional evidence. THANKS FOR YOUR HELP. |

[quote author=LagosNIV post=39861946 So this isn't a rule, per se, but I would think it best to submit your new petition for the Spouse of an LPR (F21) and once you have received confirmation that it has been received/accepted go ahead and file for your waiver. Since you already know the ineligibility to are in a good position to know what you actually need waivers for compared to some of the other folks here who think they may need a waiver and are just blindly applying.
Thanks so much for your response. The I-130 petition has been approved. We got the NVC Welcome letter last week with our LGS.... case number and now working on the instructions. So we could go ahead and file the waiver now, right?Just making sure that we are on the same page please. |

Hi VO.. Please kindly enlighten me : I had a K1 visa issued to me at Johannesburg embassy , nothing was returned to me from the package/petition my USC fiancee had filed with USCIS/NVC... I assumed this stuffs were included in the sealed envelope given to me to present at the POE but to my surprise i wasn't given back anything after presenting all to the officer at POE in Houston TX, all that i got after about an hour of drilling session was welcome to America and my passport handed back to me. My concerns are: when will they return our documents from the filed petition ? am i not supposed to receive a form i-94 at the POE which enables me to apply for a SSN? Our 90 days ends in January but intend to marry this month but how do i go about adjusting my status after marriage and what documents are needed to do so? Thanks for your selfless service ! Hope to hear from you soon ... |

meme1987: The only thing that will matter is that your are honest at the time of your interview and have as much information on hand as will be needed to determine your case. We don't coach people on how to get through a visa interview, for obvious reasons. |
Re: U.S. Immigration Questions: Ask A U.S. Consular Officer by Nobody: 7:00am On Nov 12, 2015 |
auschris: This all depends on how quickly the documents are processed - you will be contacted with additional information when you are scheduled for an interview at the U.S. Consulate in Lagos. |

Bless247: The more information you can provide to prove your relationship, the better. There are obviously going to be questions about why you have only met a person once. The point of the interview will be to provide all of the evidence that you have to the VO. |

Re: U.S. Immigration Questions: Ask A U.S. Consular Officer by Nobody: 7:04am On Nov 12, 2015 |
Jasmine007: All of those processes are dictated by USCIS - it is best to contact them in the U.S. to get details on adjusting status. As far as the I-94, or any other form, is concerned... do a Google search. All of the forms are available online. |

Re: U.S. Immigration Questions: Ask A U.S. Consular Officer by Nobody: 7:10am On Nov 12, 2015 |
DpdNKerosene: Use of a false name and date of birth to obtain a government document (i.e. a passport) is pretty clearly a material misrepresentation. He needs to come in, explain his situation fully, and will then be eligible to apply for the waiver; unless he has already been denied under 6C1. So basically, yeah, it is material and he needs to come in to have information updated before the waiver can be submitted. 1 Like |

Hello VO, I paid an agent for an America visa and he used impersonation method, we were three he applied for, two of us were granted the visa but one was caught and then the embassy wants the other two of us to return to the embassy with our visa for further questions. I understand I might be arrested if I go back to the embassy, and I don't want that to happen or rather get banned at the embassy. Please what do I do to withdraw my application and re-apply. Please need your assistance. |
Re: U.S. Immigration Questions: Ask A U.S. Consular Officer by Nobody: 1:53pm On Nov 12, 2015 |
fionawench: Well, to be honest your only option is to return to the embassy. Your visa is likely already cancelled and you will be arrested if you attempt to travel on the visa. If you return to the embassy and cooperate there is a chance that you can resolve this in your favor. Either way, they already know who you are and have your fingerprints on file so you can't just re-apply and hope it goes away. |

Thank you for your response. I just want to ensure that my fiance's additional evidence provided at the interview WILL be considered. Can you confirm that this is indeed the policy of the Lagos Consulate? The more information you can provide to prove your relationship, the better. There are obviously going to be questions about why you have only met a person once. The point of the interview will be to provide all of the evidence that you have to the VO.
|
Re: U.S. Immigration Questions: Ask A U.S. Consular Officer by Nobody: 3:11pm On Nov 12, 2015 |
Bless247: You have to submit a petition to USCIS. They make the determination. If USCIS approves your petition then we will call you for an interview. |
Re: U.S. Immigration Questions: Ask A U.S. Consular Officer by Bless247: 4:58pm On Nov 12, 2015 |
Thanks for your quick response. I am aware of the USCIS petition process. I am actually referring to the interview stage at the Lagos Consulate. (assuming the petition is already approved by USCIS). Are VO's required to look at and consider additional evidence presented by the beneficiary during the interview? LagosNIV: |
