Second, don't worry abt the cost of litigation, the judge will award that to you at the end of the case in addition to your 5%. I.e. the defendant (scammer) willl pay the fees of your lawyer
Third, do not listen to the kids here on NL who haven't worked/earned a dime all their lives. Hence 700k to them is like their annual income.
Fourth, you seem to know very lil abt real estate. Buy lots of Nigerian and foreign books on real estate. You don't really need a lawyer, be it senior or junior. The knowledge from these books will enable you draft loop-hole proof agreements and help you survive in the vermin-infested world of real estate and biz generally
Voraciously read that book in less than 3 days. You'll know the line of action to take.
You're palpably scared already. I can feel it as i type. Stop all communication with that fraudster so you don't reveal ur weaknesses any further.
Get a lawyer to serve him immediately and all future communication should be between him or his lawyer and yours.
Should he agreee to an out of court settlement, paying your legal fees will be part of ur new terms of settlement aand your FULL 5% as well. Anything short of that, see him in court.

next time use an escrow service and have all the money, the documents, and keys held in escrow. This will ensure that everyone, including you, gets what's due. prevents fraud too. The escrow service will give the seller his money, the buyer his keys, and you your money |

*Straight to the point* What would you do if you were in a situation were you had a client who so needed a house for sale after searching for quite sometime, he got nothing. *not mentioning any names* Realtor or no Realtor pls help me.
This supposed buyer need a 4bedroom semi detach house with 1room bq and had 35m for the house in an estate around chevron that's the area we could try searching for a terrace not duplex for that amount, at that amount but we couldn't secure it. I recalled my client wanted to sell his house off so he could commence other projects.
It was almost impossible if not after a week of constant calls and friendly discussions, the owner agreed. The privately developed house was been sold in lekky county estate, valued at 45m and after much he heeded after days of constant discussion on why he should sell at N35m.
Earlier, the buyer was happy and said ahh! Bro if you could secure and convince the owner to sell at N35m, I'd give you an additional 100k asides the 5percent. I didn't care about the promised additional 100k but my 5% commission which we already had undertook an agreement for effect of agency fee after House documents has been transferred.
This was in August 2015, Now his finance wasn't even transfer or direct but a supposed bank finance that was to take 3weeks, I had to convince the owner that buyer is a serious man. Meanwhile the owner was in the UK, doing distant convincing was another ball game entirely. This has been a very annoying, stressful transaction that has really weighed and stressed me out for months, but I no shout. I can do all things through christ who strengthens me.
I had to be convincing the owner in the Uk that this man his serious and wants to buy, we were yet to hear from him since 2weeks after his offer for N35m was accepted. He said he was waiting for the bank to contact him with the ready funds, that they have opened the facility for him to buy the house that they would send their valuer to come and inspect the house. Now the story had changed after some of his bankers inspected and said a valuer would come for inspection. It was now a mortgage company handling the transaction. This now had turned to one month, owner was pissed that his giving this offer cheap and yet all this back and forth.
I was just in the middle of the tragic drama. The Buyer now sent a letter of exclusivity that the owner should remove the property off the market so he'd be convinced that as he has paid the bank to facilitate the transaction to buy the house and doesn't want the money to hang that he'd lost it because it wouldn't be refundable if he sells the house. The period that was to last was for another 2weeks.
I adviced him to drop money to commit some funds to owner so he'd believe he is serious, he told me he doesn't have that bank is financing I should just be talking to the owner and convincing on his behalf.
The owner was unhappy with me because he had been stressed with documents here and there yet no head and no tale and no commitment from buyer after 2months, He trusted my judgement and believed I knew what I was doing, how can in the 3rd month your buyer hasn't come through, even to commonly drop 500k to commit he can't. Before buyer put pen to paper was something else.
I still cajoled and professionally lead the owner on to know he is very interested. I had met the mortgage bankers and I inquired from them and they say *we are on it* they had been on it for months.
Even going to the head office to get documents which wasn't my business, as owner accepted 35m that's were my business crosses. Basically, i was in the heat for 3 and a half months but didn't complain but I have to. Fast forward to yesterday : 10/11/2015 they exchanged documentation and the house key and buyer is saying the light connection, house transfer documents cost him like additional N4m and an Outstanding management fees on the house from year 2013- year 2015 and he paid that yesterday.
After handed documents I asked for my cheque because in the morning he told me that he'd sign Me a cheque because exchange, I asked for my change. He said change of plans that he used that money to pay for those fees and till tomorrow(today 12/11/2015) he call me for my cheque.
Last night(11.11.15) the buyer mailed a new agreement and said the old agreement is cancelled because I told him only after the transaction had started that there were extra charges.
That he'd pay 700k and that's after convictions. I am a family man and have my own responsibilities, 3months took a lot. I still have my agreement dated on 24/08/2015 that he acknowledged paying me 5% commission as soon as transfer of document has occurred.
My Brothers and sisters, if you were in my shoes and someone is ripping you off from your hard, stressed earned funds. At the end of year you were expecting to get of N1.750m but surprisingly telling you he will give 700k, he actually said 600k before, what would you do? Seriously need your opinions.
Please, what would you do if this was on you?

I'll tell you my own experience from the other side of a property acquirer. I don't intend to put all you "agents" in the same boat, but i know for sure there's a common streak running through you guys' activities. When I got back from the US and wanted to get an apartment on the island, I went through hell from one agent to the other. The only thing i saw in all of them was an intent desire to simply take my money and vanish. Some of them hadn't even been to the house they wanted to let out for years and yet are willing to immediately claim that everything was okay and working. And each time i ended up in the house, there was much more i had to fix with my own money. Even at this, the agents are never willing to let go one naira of their own money/agreement, which for the life of me i don't even know what it means. Did you verify first that the house was in order and papers complete before moving to sell and supposedly putting in hard work? I think the owner was well within his rights to pay you less cos u didn't do a good job to start with. Apparently, all your attention was on the paltry 1.75m to start with, and never was on doing a good, thorough job. |

Jodesky: The Buyer's reason for not paying your full fee is very genuine. You were not diligent in disclosing what turned out as extra charges amounting to N4m. This is more so when you are aware he was relying on bank loan.
You should he happy he's paying you a lesser sum which l advise you grab with both hands.
I always make it clear to Agents that l want to know all charges beforehand as my budget may not accommodate surprises.
This is a lesson to all. We should be mindful of hidden charges when buying properties as this may crash budgets.
Our so-called professionals are won't to ignore these possibilities just in the eagerness to sell only to spring surprises just as deals are closing.
So my friend, no tears for your lamentations.

Am not a Lawyer, so imho get your 700k 1st, then press charges against him if you are lucky you , you might get the balance but if other way other way round then poor you.

It is clear from your write-up that u are only hustling. you are not a professional in this line of business. if u were, u wud have taken appropriate steps to ensure that this sh.it does not happen. so just take what he offers, but dont sign his new agreement yet. Also some earnest money should have been committed to the escrow account upfront. Regardless if he was having bank financing. If the buyer couldn't afford earnest money or unwilling to make an earnest money deposit with his offer, you shouldn't take him to seriously at all. After all that you have mentioned with the buyer communicating directly with the seller etc. As the seller I wouldn't have sold my property to you two. I would have thought you were scammers |

I'm sorry but that is wrong. An agent who charges both buyer and seller is simply being greedy and more often than not causes problems with the transaction. Properties are hard enough to sell or rent because of all the price loading by intermediaries. If a fee has been agreed with the buyer and he reneged, we all know how slow and expensive the legal option can be. I would advise that all client agreements are established clearly in writing, and if you can afford to sue, do so, if not settle and blacklist the client. But make sure others know of your experience with this untrustworthy person so that they are forewarned. Thank you. I flatly refused to pay agent fee when I was buying my land as in my opinion that is a sellers expense. The fee finally came out of the Lawyers fee. The Real Estate market in Nigeria needs a shrewd investor to come in to do the following: Escrow Services Property Valuation Services Rules Of Engagement Services - who pays what, how much, to whom, etc There's a lot of cowboys just floating around who become overnight realtors without any education or services being offered. Can you believe that one Neanderthal thought I owed him fees because he showed me a land and the seller changed his mind to sell it after I made an offer? Another one from Nairaland here wants me to pay him in advance before he can show me lands for sale. 1 Like |

Also document fees and power connection are paid by the buyer. I would gather that the buyer in this deal is inexperienced and probably scamming. Did the check clear? |

A good Realtor will visit the item for sale before he lists it (many of these cowboys don't, based on personal experience), observes any deficiencies and causes them to be repaired. Certainly a Realtor shouldn't be surprised to see a defect when he is showing the property as he should be intimately familiar with his listings. |

In as much as I've loved the advice and very useful suggestion and tips, Some of you have still managed to just jumping into conPOOsion (conclusion incase your wondering) Some of you that said I didn't thoroughly do my job and just wanted my 5%, am thorough in my job, am not a hypocrite. Here's why you should ask questions:
I told this dear client from day one to first and foremost do a search on the property, doing this would let the client confirm the full information and the produce details on the property as well as identifying the real Owner of the property.
The estate main office request for 10k for facilitating this search and getting a full on report on the property and what follows is the status of the property. He(buyer) never agreed to this search until. *His reasons: I want to be sure the owner wouldn't sell the property because the owner didn't sign the exclusivity agreement which the owner said he would if only he(buyer) commits funds that he is serious to buy but (buyer) doid not, not even 500k that the owner complained buyer should.
Anyways, back to it. Getting to the 2nd month a search was done and this was how we saw the outstanding on the property after the 2months of me telling him(buyer) and He'd be like, I don't want to commit yet until he is certain that the owner wouldn't sell the property. He said this because He(buyer) didn't fulfil the owners obligation to pay a commitment fee before he signs the exclusivity agreement which the buyer didn't oblige to. Just a refundable 500k to sign to remove property off the market.
So please tell me, am I making sense? To me I have every right to get my money, should I just chicken out? Its my right, my money. He doesn't have to pay me at once. Can pay half and remaining within an agreed time frame. I'd be very fair on his terms as long as he pay me complete. Write and sign on it. Would this suffice?
Ps: some of you said, am not a professional and others say am just trying for the money. Lol! Am just chilling because just last week this buyer was on his honeymoon as he just got married and I was here holding the forte for him. 3 and a half months. From august to now is a longtime. From one excuse to the other. 3weeks to 3months.
*if I was desperate, I would have loaded on the property as they do or done some other thing in it. I wouldn't lie, when I noticed the excess charges I was like wow! If only he had heeded, he wouldn't be in this and most clients are guilty of this. They would be coming with fear to transactions and wouldn't know how to open up. They have the mentality that if am relaxed, they would cheat me or scam me. That fear of 419 agents. Its disgusting. Once a client is that way, there wouldn't be good and agreed communication.
