I was just wondering with all this corruption fight against Dasuki, Dokpesi and the rest, what is the likely jail term these guys can earn if found guilty on misappropriation of security found.

Looking at the previous fight against corruption, the likes of Bode George and Alamieyeseigha were given a jail term of just two years or so which the term period also include period of prosecution, compare this to Ibori sentence in Britain and the resources involved in prosecuting these guys. The pension boss was even given an option of jail term or paid seven fifty thousand naira or so.

So lawyers in the house and Nairalanders who knows about the law, what is the expected jail term based on Nigeria constitution?

I don't know for others but dasuki is likely like to get a Death sentence for treasonable felony.

Meaning & Nature of Treason
The offence of Treason is a capital offence
which is defined by
section 37(1) of the Criminal Code Act
as follows;
a.
Any person who
levies war
against the state, in order to
intimidate or overawe
the president or the governor of a state is
guilty of treason and is liable to the
punishment of death.
b.
Any person conspiring with any person, either
within or without Nigeria, to levy war against
the state with the intent to cause such leving
of war as would be treason if committed by a
citizen of Nigeria, is guilty of treason and is
liable to punishment of death. Again, by
section 38 of the Criminal Code
any person who instigates any foreigner to
invade Nigeria with an Armed Force is guilty
of treason and is liable to the punishment of
death. Thus, the offence of treason has three
arms. Note that the word
war
in this context does not bear the restricted
meaning which it bears in international law.
In order to constitute
levying of
war
; it is not necessary that the accused persons
should be members of a military force or even
trained in the use of arms and the type of
weapons used is not material. It is also
immaterial that the no persons engaged in
levying the war are small:

Even if you embezzle the whole budget,you would be sentence for three years.

The point here is not the jail term really,the point is to confiscate all his properties,sale all the saleable to raise atleast part of the money,he might not get more than 2yrs jail term

Using the case of the former commissioner in Adamawa state, who is given a ten year jail term for stealing fifty-one million naira, for every five million naira stollen give him a year. Divide the total amount stollen by Dasuki by five million, what you get is the number of years he'll get.

I have to look at the case of former commissioner of Adamawa and the charges against him, the charges against Dasuki and Co were misappropriation which is similar to that of Bode George and the likes and the bag a jail term of two years, I don't even think the money were recover in their case.

With all this media publicity, two years jail term will be an encouragement for others to continue looting. Assuming Bode George bags 15-20 years he will still be in prison rather than been free and be involve in another looting.
