It is dangerous to resist arrest in some countries. You could be shot. Authority could simply place handcuffs on him. A lesson to all in position of power be accountable and follow due processes. If you escape human justice you will definitely not escape Baba God's own.

Security operatives whisked away the former Director General of the Nigerian Maritime Administration and Safety Agency, NIMASA, Patrick Akpobolokemi, from the Federal High Court, Ikoyi on Monday.

One of the counsel to the embattled former NIMASA boss, Wilson Ajuwa, made this known to PREMIUM TIMES in a telephone interview.

Mr. Ajuwa said he feared for Mr. Akpobolokemi’s life.

The legal practitioner said the ordeal of the former NIMASA boss started shortly after President Muhammadu Buhari took over power.

“For some reasons, he has been under investigation for the last six months since President Muhammadu Buhari came into power,” Mr. Ajuwa told PREMIUM TIMES.

“He has been going to the EFCC back and forth and all sort of things are happening. The EFCC has invited the wife, his brothers and maltreated them.

“Eventually, they charged him to court before Justice Salihu Sa’idu on a 30 count charge and penultimate Friday while he was in their custody; they charged him again before Justice Mohammed Buba, all of the Federal High Court, Ikoyi Lagos.

“Both courts granted him bail after he was remanded in Ikoyi Prisons for seven days. His trial was supposed to start last week Tuesday but the court was adjourned for today.

“While we were in court, they filed a 2000 page proof of evidence and the counsels were unable to review the document and prepare their defence.

“The judge was averse to a prolong adjournment but decided to give the defence the benefit of the doubt by adjourning further hearing on the matter till January 18, 2016.”

Just as the former NIMASA boss stepped out of the courtroom, Mr. Ajuwa said persons suspected to be SSS operatives appeared with a detachment of policemen and beat up Mr. Akpobolokemi.

He said the operatives used force to re-arrest his client even then he had secured bails from two different court where he was charged by the Federal Government.

“It took us seven days to perfect the bail in both courts and so he is under two bails at the time they took him away,” he told this newspaper.

Asked if the government prosecutors had sought to squash the bails granted Mr. Akpobolokemi during the court sitting, Mr. Ajuwa responded in the negative.

Already, he said the matter had been reported to Justice Buba and a motion filed for the former NIMASA boss to be produced in court on Tuesday.

“With the way they treated him, we don’t know whether the man is alive or not. They beat him thoroughly before bundling him into their vehicle. The video is there for people to see,” Mr. Ajuwa said.

Because you are stucked in your little village and have no idea how the criminal justice works. People are rearrested every day all over the developed world in front of the court, detained and slammed with fresh charges. He shouldn't had been granted any bail in the first place. How do they grant balls for people that has the capacity and reason to abscond?

Flash! Nigerian police do not need warrant to arrest.. They are empowered to do that and he should have complied so that his lawyers can sort out the necessary legalities. Therefore, he acted foolishly by resisting arrest

I read through most comments and I wonder if this forum is filled with uneducated people. No sane lawful country will treat even hardened criminals the way this man was treated. It is wrong on every level. Even if you are thief or a murderer, you still hav rights.

Section 4 of the Administration of Justice Act (AJA) 2015 states: "In making an arrest, the police officer or other persons making the arrest shall actually
touch or confine the body of the suspect, unless there is a submission to the custody by word or action."
Also, section 18 (a) of the same statute provides that "a police officer may, without an order of a court and without a warrant, arrest a suspect whom he suspects on reasonable grounds of having committed an offence against a law in Nigeria or against the law of any other State, unless the law creating the offence provides that the suspect cannot be arrested without a warrant."

Arrest is valid like fire. grin

How did they harass him or infringe on his rights? They probably read him his Miranda rights and asked him to put his hands behind his back to be handcuffed and whisked away quietly, yet he blatantly refused the orders. Well, guess what? He deserves every treatment he got. If he hadn't stolen all that money, it could've probably been used to properly train the Police and he would have been treated more leniently and professionally. Did you see the environment the court was situated in? Is that how court grounds look in normal countries? So, just imagine how Prison in Nigeria must be like when the Police force and Judiciary look so unkempt. No wonder he was scared to leave with them.
Again, he shouldn't have stolen all that money. Now he has to deal with the consequences of his action.

The Police is not required to show a warrant at the point of arrest insofar as they are not on YOUR private property. If he feels his arrest was unconstitutional and illegal then his lawyers know what writs to file to get him justice. Even though he was granted bail, he could also have been indicted in another district on another case that required his presence in court. A common tactic my office often used when I worked in DOJ was present a slew of charges at first in hopes that the defendant would "expose" his supporters when bail was set. Then once he reached bail, we unseal another indictment or charge him with a superceding indictment. So, now, not only will his remaining supporters flee, even he will become overwhelmed fighting so many cases at the same time and this would usually force him to quickly aim to settle the cases,even if it meant signing off to a plea agreement for as much as 20yrs (even Life imprisonment sometimes when we inform the defendant that because of the severity of the offense the Govt intended to seek the Death Penalty) because realization would've set in by then that he wasnt going nowhere anytime soon---not at least for a few decades ---and that there was no way he was beating all the charges filed against him.

Warrant kwa. I feel u though. But the system has been messed up for long. Every country with its system. If this big men don't experience what we see everyday, it won't change. When they are done, he will use his influence to make positive changes. Dis he even make any positive change in NIMASA? This is what Buhari promised us. nothing wrong in this video, he wasn't kicked, punched or slapped. He resisted arrest and appropriate force was applied to put him in the vehicle. first time I would see Nigerian police act professionally to someone resisting arrest.
