Judge Withdraws From Nnamdi Kanu’s Trial by Rizstar: 3:17pm On Dec 23, 2015
A federal High Court judge has recused himself from hearing treason charges brought by the government against Nnamdi Kanu, the leader of the Indigenous People of Biafra.

Justice Ahmed Mohammed announced the decision on Wednesday in Abuja after Mr. Kanu objected to the case, saying it was needless, as the federal government had repeatedly disobeyed previous court rulings.

The government is accusing Mr. Kanu of plotting to split Nigeria, by creating a Biafra Republic with south east, south south states, and parts of Kogi and Benue states, as component units.

Mr. Kanu, who was arraigned before Justice Mohammed Wednesday, told the court before commencement of the prosecution’s plea that he preferred being held in the detention, than subjecting himself to a trial, which outcome will not be respected.

He said his previous trials had various outcomes that were abused or neglected by the office of the State Security Service, SSS.

Mr. Kanu therefore stated his outright objection to the trial in the court.

The counsel to the prosecution, who is also the Federal Director of Prosecution, office of the Attorney General, Mohamed Diri, told the court that based on section 396 (2) of the constitution, the defendant had no right to object to being tried by the court until after the plea is heard.

But the judge said he was standing down from the case, saying Mr. Kanu had the right to reject the trial, “after all justice is rooted on confidence”.

“If any of the parties has no confidence in the court, he has the right to say so”, Mr. Mohammed ruled.

He noted that the prosecution would have done the same thing if they were in Kanu’s shoes.

“Assuming it was the prosecution, if they had no confidence in the court of jurisdiction; would they not have done so?”

“I hereby remit the case file to the honourable chief judge of this court to reassign it,” the judge said.

And the charade continues.
The government has shown on several occasions their utter disregard for court rulings.
When it's citizens toe the same path, let it be known that government set the precedent for this.

Our law courts have been reduced to kindergarten playgrounds. No one shows respect for the rule of law anymore.
If this isn't a pointer to the fact that we are approaching a failed state, nothing else does.

That judge did the honorable thing. Why waste his time to preside over a case he knows the government will not respect it's outcome, except it favors the government.

Why won't the Judge excuse himself when Buhari keeps disrespecting court orders.


Kanu tendered a valid plea too strong for the court to dismiss..."justice indeed is rooted in confidence".
Kudos to the judge.

Buhari needs to respect democratic institutions. Flouting court orders portends danger for our democracy.

I would assumed that this was a bad reporting. I also would assumed that Kanu's argument was that he has no confidence in the judicial system but must had used the technical legal terms of referring to that particular court's jurisdiction. As in reality, no one has right to refuse trial unless a plea of guilt had been entered, hence the judge agreed with him.

Kanu must have argued that courts based in Abuja cannot seem to enforce their own judgments based on previous events, therefore the judge has no choice other than to abandon the case to be reassigned to a different jurisdiction that the accused has confident in.
It really exposed the Nigeria unrecognizable federal system where everything now has to go to Abuja. What is wrong with all the courts in occupied B.i.a.f.r.a.l.a.n.d?

You go to court to seek justice or clear your name.

In the event that you do not trust the courts jurisdiction and ability to deliver a fair ruling you can refuse to stand in for trial.

This is similar situation where an accused can opt to give testimony. In the US it is called claiming the 5th Amendment.
