anybody that takes TonyeBarcanista serious nowadays is just as shameless as him that's my take.

see no matter how much someone hides his character it will surely suffice one day and TonyeBarcanista is a good example of that.

and the worst part is that he's a chronic lair and a history twister who cannot make a single sense without long useless epistle he calls write up.
if he feels that he's brilliant enough he should go to Twitter where few words are required to make sense no he can't because he's a local champion and an attention seeking nigga an unstable human being that doesn't know exactly what he wants.

the most pathetic part of the whole issue is that he thinks he know anything while he's a dunce.

He's now teaching a learned judge that even in his next hundred years he'll never become 1% learned as the judge his job.
He's now better than the judges that acquitted kanu
smh for him
just look at who's applauding him the same bigots as him
nairaland is now infested with 90% bigots facts

this is what bigotry, hate and lies can do to someone.
this is the press release on the case, i'm quoting a small portion

The Chief Magistrate Shauibu Usman, in a ruling yesterday discharged and acquitted Kanu of all criminal charges brought against him by the Department of Security Service (DSS).

Usman's ruling is inline with the request by the DSS to drop the charges against the Biafran activist in order to enable them pursue his trial at the higher court for terrorism.
The DSS had argued that the Magistrate Court lacked the jurisdiction, since they have obtained the Federal High Court
(FHC) order to detain him for 90 days based on terrorism charges.

If u read well, u will see kanu was discharged because DSS dropped their case against him. DSS decided to go to a higer court to get permission to hold kanu 4 90, the case is now beyond d juridiction of d magistrate court and d dss is going to a higer court with a new charge of terrorism.

All this your gra gra won't stop Kanu's dream from coming to past.

When it does, you will either accept it or be exiled out of SS/SE if truly you are SS

SS/SE remains one.
they didnt grant kanu bail. DSS simply dropped its earlier charge and went to a higher court.

I remembered that some people also promised to form a parrllel government. Just wondering if we have different laws for different people or are we being hypocritical with the TRUTH

And the same man claiming saintly status now also committed treason wen he incited his followers to violence in 2011 and also threatened blood of baboon and dogs. But no! That is not treasonable felony, its his fundamental right of expression! Mtschewww! Hypocrisy of the highest sort.

@Tonyebarcarnista, I get it that you do not like Mr. kanu, in fact I believe you hate him with a passion as demonstrated in the past by your posts, but separate sentiments from your judgements and you'd try to see more clearly.

I only blame GEJ for not arresting the mad man from Daura in 2011. He was just tring to let peace reign.

It's very disturbing the way we do selective arguments in Nigeria. We can write in support of the indefensible simply because of our political and other leanings and has unwholesome fellowship of like minds even in the face of obvious dishonesty and lies

In the case of Dasuki the judge clearly prohibited all security agencies from rearresting him, a fact that is public and part of the judgement yet Barcanister, in his haste to achive a prejudiced intention, conveniently quoted the portion of the judgment which he seeks to use, knowing full well most people are not going to research this and believe whatever he said to be factual

It is all well and good to prosecute people and uphold the constitution but same must be done within laid down rules and judicial principles. Without some of the reforms introduced in our electoral and political processes by the last administration, I doubt the present government would have been where they are. Under the obasanjo government the chances of an opposition party winning at the centre was almost non existent. We all know how elections conducted then were

The point is we must shun a system where the executive tries to take away the gains we have made as a society and takes us back to the dark ages where political, judicial and clanish success are completely predetermined and controlled by the executive and meted out to those they seek to reward or punish

We the governed should try to be apolitical and demand the government toes the path of the law rather than an illogical display of support even in the face of stone age and draconian tendencies simply because such Present tendencies are targeted at those we hate. There is a reason our forefathers insisted on the courts and laid down processes. If there wasn't such the present government surely won't be where they are now

Dont waste your ink on barcanista, he is trying to port back again stylishly. He is missing out on all the goodies all the other e-rats are enjoying now and wants to creep his way back in. Let him be, don't knock his hustle. He will first try to sound like he is a fair judge, then the leftist leanings will blossom from there. Hustle on bro!

You speak about an acquittal. How can there have been an acquittal when there was no charge in the first place?

All the judge did was to vacate an earlier detention order he had granted the DSS. He did not acquit Director Kanu neither did he give a restraining order against the DSS.

On Colonel Sambo Dasuki...
Did the DSS contravene any law or disobeyed the court by re-arresting Sambo Dasuki? I don't think so. The Court judgement of December 21 granted Sambo Dasuki and others bail in a N9billion fraud case. Though Dasuki and others were released from prison after meeting bail condition, he was re-arrested after stepping out of prison.

We have to note that the bail was respected by the DSS but unfortunately for him(Dasuki), the judgement of the court didn't grant him any immunity from further arrest. Hence, the government committed no offence in re-arresting him. But why is he even looking for bail when he should be more concerned with clearing his name as regards the $2.2billion arms fund that he allegedly looted with his friends? Why should a "big thief" be using bail to walk free while a poor man languish in prison for years on "awaiting-trial"? I think the government should be encouraged to re-arrest him each time he's granted bail.

I don't believe in abuse of the law but I believe that people should be encouraged to keep off from crimes while the government must be encouraged to fight alleged criminals with the law irrespective of who the perpetrator is.

It is my opinion that Messrs Kanu, Dasuki and others should prepare their defence and prove their innocence before the judge.

May God Bless Us All and Bless Nigeria
Happy New Year 2016

One thing about you is, you are not a lawyer, you know nothing about the law, the only thing you do is come here with your uninformed and irrelevant opinions. Now who said the court has freed Dasuki or Kanu? No one said so. What the legal counsel of this two are staking for is a bail application which is a fundermental right of every one. Whatever trail or case can continue after the court has granted them bail to gain their freedom and still continue the case. Just 2 days agoe Bill Cosby in the U.S. Was granted bail for allegedly raping over 40women through his life, court granted him bail of 1 million dollars and he was released. Did the court say they won't continue the trail? No. When we come as informed people and celebrate the president sitting in a media chat and convicting people based on a crime that has not been convicted by the court of law is a total slap on the Judiciary and one which the Judges must resist or else they loose their relevance. In the mind of Bihari he won't accept anything other than the conviction of the two said people which is absolutely wrong and cannot be accepted. Everyone must have faith in the courts as they are the only recognized institution for convicting a suspect. People are out to celebrate the media chat of such where no serious issue was given a serious answer, for Nigerian residents, it is a shame the way we let passion and sentiments out law reason and due process.

TonyeBarcanista:
Since the pronouncement of Buhari justifying Nnamdi Kanu and Sambo Dasuki's detention, some people have gone public to abuse the President and seeking to score cheap point. Has Buhari or DSS really violated the law in Kanu and Dasuki's trial?

On Nnamdi Kanu's Continuous Detention
Firstly, I want to make some clarification. At no time did any court "free or clear" Mr Nnamdi Kanu of any charge against him. What Justice Ademola of the FHC(Abuja) did was to vacate the order it first granted to DSS to detain Kanu for three months. The court vacated the order on the ground that it was unconstitutional to hold a suspect in detention for more than three months without charging such suspect to court. In the words of the learned judge;

What the DSS simply did was to detain Kanu and file case in court on charges that borders on treason. In other words, Kanu is no longer being detained without trial as it was before. It is left for him to argue his innocence with the judge. If the DSS had breached the court ruling, the judge would have summoned them for contempt.

Did Kanu Really Commit Treason?
What constitute treason in Nigeria? The offence of treason can be found in sections 37 to 49 of the Nigeria criminal code.

According to section 37(1) of the Nigeria criminal code; Any person who levies war against the State, in order to intimidate or overawe the President or the Governor of a State, is guilty of treason, and is liable to the punishment of death. Section 37(2) further stated that Any person conspiring
with any person, either within or without Nigeria, to levy war against the State with intent to cause such levying of war as would be treason if committed by a citizen of Nigeria, is guilty of treason and is liable to the punishment of death:
.

Through radio biafra, Kanu preached inciting messages and even went as far as soliciting for arms with intent to wage war against the State. This was captured in a video that has gone viral. I think that breached section 37(2) of Nigeria criminal code(in my opinion). It is however left for the judge to make pronouncement.

Kanu was unconditionally released by the high court on the 16th of December. His Lawyer, armed with this court ruling went the next day to the DSS office to effect Kanu's release. He was denied access to his client. The DSS then filed fresh charges against Kanu on the 21st which meant that Kanu was illegally detained for 4 days. Against this backdrop, we have a president who went on air not only to support the flouting of court judgements but also to turn into judge, jury and executioner. This is highly shameful.

When we come to the law you quoted, even a lay man can see it doesn't hold any water. What exactly is "levying war"? Has Kanu actually started any armed struggle? No. Is there any terrorist activity that can be ascribed to him? No. The fact that he solicited for arms in America holds no water because to solicit for arms and to levy war are two different things. Kanu might solicit for arms, but did he get them? Did he levy war? It's like me publicly asking for guns so that I can rob a bank. If I never got the gun and I never robbed the bank, how can you then charge me for a bank robbery that never happend? Nigerians should start using their brains. As for all the inciteful comments Kanu made, his right to freedom of of speech lays them useless.

@Tonybarcanista. Ar u a lawyer or a judge? How a can you call Dasuki a "big thief" when a competent court of law have not yet found him guilty. Please be careful., and in another development how can you say mr Nnamdi Kanu was begging for arms to wage war against Nigeria. Do u have evidence of that? I am disappointed at you, Tonyebarcanista.

When the court granted Kanu bail on meeting certain conditions, and he met those conditions, there was no reason to hold him for an extra minute.

When a judge asks DSS to release him verbatim, what part of that statement do you not understand. Spewing lies and half-truths on social media is very unbecoming of you.

When people hail Buhari's so called anti-corruption campaign, makes me laugh. Amaechi has been probed and accused of corruption, Buhari turned deaf ear. Fashola is also accused of embezzlement, that's not news to Buhari. Silver and Audu allegedly stole billions, yet APC and Buhari forgave them and even gave them Guber tickets in Bayelsa and Kogi respectively.
Bukola Saraki lied in his assets declaration form, APC only remembered this when he went against his party.
I am not against anti corruption crusades, but selective persecutions, that's bullshit.

Nnamdi Kanu case is different. Secession struggles could be deadly, so if Kanu is consumed it's a pity.

But Dasuki release and re arrest does not make sense to me. He could be given house arrest, until justice is speedily served. He is human though might have taken in-human actions.
