How To Truly Separate Democratic Powers In Africa by EternalTruths: 7:23pm On Jan 01, 2016 |
Buhari's media chart finally proved my theory right on the need to hand over the security apparatus to the Judiciary Check link below for my theory https://www.nairaland.com/2820370/se-ss-new-order-must There are 4 major sources of power that backs all Democratic Governance which are a) Popular choice of the people b) Power to make laws c) Power to control national wealth/resources d) Power to wield the sword In Africa Democratic setup, The legislative has the following powers backing it a) Popular choice of the people b) Power to make laws The Executive has the following powers backing it a) Popular choice of the people b) Power to control national wealth/ resources c) Power to wield the sword The Judiciary has the following powers backing it a) Nothing b) Nothing c) Nothing d) Nothing For this reason, court orders can be disobeyed by the Executive arm of government and the peoples rights trampled In Africa, whenever the Executive arm of government steals the national wealth/resources or elongate its stay in power and its being questioned by its citizens , it uses the Power of the Sword to suppress all oppositions eg Nigeria and Burundi. For this reason do I propose that for our democracy to have true separation of powers, the Power of the Sword should be taken from the Executive and placed under the control of the Judiciary and also the appointment of the Chief Justice should be abolished and given to the people to choose. In other words, the Judiciary should have the following powers backing it a) Popular choice of the people b) Power to wield the Sword With these powers under the control of the Judiciary, whenever the Executive arm of government abuse its power eg steal national wealth/resources, illegal elongation in power etc it won't be able to use the Power of the Sword to oppress peoples voice This will also ensure that court orders are promptly obeyed Until this is done , Africa will continue to experience impunity by the Executive arm of government leading to poor leadership which will affect African growth and development For further understanding of how this will work check the link below https://www.nairaland.com/2820370/se-ss-new-order-must 2 Likes |

EternalTruths: 1. I totally disagree on this portion above. 2. Neither the DSS or the President has committed any offense by Re-Arresting Kanu on fresh charges. It is as legal as Kanu being a UK citizen. 3. No court has free or acquitted Kanu of the offenses he has been accused of. 4. Finally when we are done with Kanu, Nigeria's National Anthem will be his favorite song. Bonus, Kanu will go to jail. If not for anything, it will be for coming into Nigeria illegally despite having 2 international passports. So OP, don't start crying yet - because after playing him the Reggae, Nigeria will still force Kanu to dance the Blues as well. |

egift: Your immigration law say you deport any person who comes to your country illegally after a stipulated holding time of 7 days. you guys just sit and write down your imagination as law. 1 Like |

anticabal1: Not when he is a Nigeria Citizen. That is why he is being prosecuted here. He is far more a Nigerian that UK. You are the one allowing your imaginations to run wild - that Nnamdi Kanu can commit treason against Nigeria, float our laws and get away with unhurt. |

egift: Stop running from pillar to post, you were the one who mentioned coming to nigeria illegally without a passport. You see him as a foreigner, so you can deport him instead of breaking your own laws. I'm sure even you illiterate buhari is not aware of the immigration law. 1 Like |

anticabal1: He has two passports (Nigeria and UK), but he did not enter Nigeria with neither of the two. That one is a crime of its own. Run your mouth all you want, it will not stop Kanu from eating the poorly cooked watery beans in DSS custody. |

egift:What do you mean by Kanu coming to Nigeria illegally? Are you now saying most Nigerians living in Nigeria without passport are illegal? |

hollywater: Sneaking in and out across the boarder of any country is a criminal offense. Keep spinning this shittt to see if you can justify his crime. |

egift:I'm not justifying him neither do i acknowledged he has committed any crime by asking for freedom which is his right as a citizen of Nigeria. Except you have something else against him bro. |

hollywater: You are the one dribbling yourself. Let me clear it for you: 1. No court has set him free of the charges he is facing (ie: declare him innocent). And the bail he was granted earlier, were for the first set of charges he was arrested for. Also note the court never barred anyone from arresting him again. 2. Kanu is now arrested the second time on a fresh set of crimes. And there is no pending bail for Kanu. If he wants to make bail now, he will start the entire bail application afresh. We told Kanu that Aligbo needs mobilization for development and enterprise, not some disgruntled miscreants who are spreading hate on radio. We are still starting the reggae. Kanu will still be made to dance the blues as well. |

egift: If you believe the Judiciary has powers, why then are they powerless against the Executive Why then are court orders disobeyed Put aside your political inclinations and use that thing between your ears The Judiciary in African Democratic setup has no true power that is why Africa should empower the Judiciary with two of these powers a) Popular Choice of the people b) Power to wield the Sword. |
