Good day nairalanders!!!!
please i have been asking myself questions on what will be the faith of a cheating partner if sued.
for example, husband came back home and met his wife on there matrimonial bed with another man.
my question now is,
can he sue the man to court?
what will be action of the court?
will the man be sentence to prison?
thanks as you clarify me on these.

Let me help you.

You can sue your wife for divorce (in the USA, you maybe entitled to alimony if she is richer than you and there is no prenuptial agreement)

You could potentially sue the man for emotional trauma(good luck proving that in the court of law though) he won't be sentenced to jail but may pay you compensation. kiss

If you attack the man, you could be charged to Court but your defence team can successfully argue that you acted based on crime of passion.
Husbands have killed their cheating wives and have been discharged based on emotional trauma.
Again you will need a good defence team, an incompetent prosecution and a battery of psychologist who will stand for you that you were emotionally traumatized.

In all likelihood, in Nigeria, you will be stunned and rush the man and beat him or he beats you wink
Then the family will.settle.you all later.

Its his wife he'll sue not d man. If he sue d man and he goes to prison, are there not many other men out there that d wife can still sleep with? The person bringing shame to d matrimony and families is d cheating wife so if anyone shd be taught a lesson by d husband, its d wife. Or better still, let them settle their differences dat cld make d wife do such a thing. Its may just be hard to do on d basis dat no matter what may have happened btwn d woman and her hubby, cheating on him wasn't d way out.
